    Los Angeles March 8 - addendum was filed (copied below) with Brian Moynihan, President/CEO of Bank of America, to the March 6, 2010 request that Mr Moynihan disclose to the Audit Committee of Bank of America his own alleged fraud, pursuant to Sarbanes Oxley Act (2002). The March 8, 2010 Addendum provided a key record that was missing from the March 6, 2010 request - December 11, 2008 notice by Dr Joseph Zernik to Bank of America Officers regarding the resumption of alleged criminal conduct by Brian Cave, LLP. Such conduct was instigated by the former Legal Department of Countrywide Financial Corporation, headed by Sandor Samuels. The December 11, 2008 notice should remove any doubt that Bank of America Officers were fully cognizant of conduct at the Superior Court of California, County of Los Angeles, perpetrated by the former Countrywide Financial Corporation Legal Department, starting December 11, 2008. On March 6, 2010 request was filed by Dr Joseph Zernik, Los Angeles County resident, [1] with Brian Moynihan, President/CEO of Bank of America Corporation, to disclose to the Audit Committee of Bank of America alleged fraud and other criminal conduct by Brian Moynihan himself. The request pertained to the conduct of the former Countrywide Financial Corporation and its Legal Department, headed by Sandor Samuels, and their litigation practices, as evidenced at the Superior Court of California, County of Los Angeles, under caption of Samaan v Zernik (SC087400). The alleged criminal conduct included, but was not limited to false appearances by Bryan Cave, LLP, while not authorized to appear as Counsel of Record; filing of papers under false party designation of "Non Party"; false appearance of Sandor Samuels under false party designation of "Interested Person"; filing of false court actions allegedly aimed to obstruct and pervert justice; additional conduct that was alleged as retaliation/harassment/intimidation against a witness/informant/victim; and alleged monetary transactions in property derived from specified prohibited conduct. It should be noted that similar litigation practices by the former Countrywide Financial Corporation Legal Department were evidenced in courts across the US. Hallmark evidence of such conduct was found in the case of Borrower Hill (01-22574) in Pittsburgh, Pennsylvania, and the case of Borrower Parsley (05-90374), in Houston, Texas. However, to this date, none of the culprits at the former Countrywide Financial Corporation was ever held accountable. Such conduct was initiated under the caption of Samaan v Zernik (SC087400) at the Superior Court of California, County of Los Angeles, in summer 2006 by Sandor Samuels and Countrywide Financial Corporation. However, it was halted after the July 1, 2008 takeover of Countrywide Financial Corporation by Bank of America, when the Legal Department of Countrywide fell under the oversight of the office of the General Counsel of Bank of America, then headed by Mr Timothy Mayopoulos. However, on December 11, 2008, such conduct was resume in full force - within 24 hours after the ouster of Mr Timothy Mayopoulos and his replacement by Brian Moynihan as General Counsel of Bank of America (December 10, 2008). Another alleged fraud by Brian Moynihan pertained to response from office of the President/CEO of Bank of America in January 2010 on complaint (#00971981) filed with office of the US Comptroller of the Currency against Bank of America on the same matter in late September 2009. It should be noted that US Office of the Comptroller of the Currency failed to this date to issue a determination on the complaint against Bank of America, far beyond the standard time frames noted by the staff of the Office of the Comptroller of the Currency for issuing determinations on complaints.     Upon review of my March 6, 2010 request for disclosure to the Audit Committee of Bank of America
    Corporation, it was concluded that one additional critical record, and two support records should be
    brought to your attention.

    1) The attached, December 11, 2008 Notice by Dr Zernik to Office of the General Counsel, attention
    Bank of America Corporation officers listed below, should eliminate any doubt that Office of the General
    Counsel, by then under Brian Moynihan as General Counsel, as well as other officers of Bank of
    America Corporation, should have been fully aware of the resumption of alleged criminal conduct on
    December 11, 2008, at the Superior Court of California, County of Los Angeles. Such conduct was
    resumed merely 24 hours after the ouster of Timothy Mayopoulos and appointment of Bryan Moynihan
    to replace him as General Counsel.

    Dr Zernik's notice was transmitted by fax and by email to the Office of the General Counsel, Bank of
    America Corporation,attention of the following officers:
    1) Teresa M. Brenner
    Associate General Counsel signer of SEC filings
    2) Kenneth D. Lewis
    President, CEO, Chairman
    3) Timothy Mayopoulos
    BOA General Counsel
    4) William J Mostyn III
    Deputy General Counsel signer of statements to share holders

    Zernik, each with his/her own individual certified letter, restricted delivery, as early as February 4, 2008,
    of the alleged criminal conduct by Countrywide Financial Corporation - during due diligence period
    relative to the Countrywide Financial Corporation takeover by Bank of America Corporation.
