Oe HARD ARCANGEL CONTRACT OF LEASE KNOW ALL MEN BY THESE PRESENTS: ‘This Contract of Lease shall evidence the complete terms and conditions under which the parties whose signatures appear below have agreed. Landlord, Richard Montafio Arcangel, shall be referred to as "OWNER" and Tenant(s)/Lessee, Mark Baltazar, shall be referred to as resident. As consideration for this agreement, OWNER agrees to rent/lease to RESIDENT and RESIDENT agrees to rent/lease from OWNER for use solely as a private residence, the premises located at Greenhills Hotel M 219 Ann: n Ju WITNESSETH 1. LEASED PREMISES: The premises subject of this contract is that building existing thereon, which belongs to the LESSOR, located at Greenhills Elan Hotel Modern # 49, unit 3219 Annapolis Street, Greenhills, San Juan City. ‘The LESSEE has examined said premises prior to and as a condition precedent to its acceptance and execution hereof, and is satisfied with the physical condition thereof, and its taking possession hereof shall be conclusive evidence of its receipt thereof in good order and tenantable condition, LEASED PERIOD: The lease shall be for duration of Three Years (3) commencing on August 1, 2015 and ending August 12018 unless sooner terminated for causes hereinafter provided. bocce ARCANGEL 2. RENTAL: For the duration of this lease contract, the LESSEE agrees to pay a monthly rental of Forty Thousand Pesos only (40,000php), payable in advance on or before the _1st. day each calendar month. The LESSEE shall pay the LESSOR interest on rent not paid on time at the rate of three (3) percent per month, safd interest to be computed from the date of delinquency until paid in full 3, GENERAL SECURITY DEPOSIT AND ADVANCE PAYMENT: Upon execution of this contract, the LESSEE shall deposit in cash, an amount equivalent to ONE HUNDRED AND TWENTY THOUSAND PESOS ONLY. for the faithful compliance by the LESSEE of all the covenants and conditions of this contract and to answer for any and all damages which may be suffered by the LESSOR and other necessary liabilities or obligations of the LESSEE under this contract, which deposit shall bear no interest. Reimbursement of the deposit or any part of thereof may be made earlier upon surrender by the LESSEE to the LESSOR al official receipts showing payments of the utility bills for the duration of the lease and upon the LESSEE’s compliance with all its obligations hereunder, 4, UTILITY BILLS: During the terms of this contract, all bills for utilities such as water and electricity shall be for the account of the LESSEE. Payment shall be made directly to the public utilities concerned, whenever possible, Should there be any disconnection of the said services thru the fault of the LESSEE, the expenses to be incurred in re-connecting the same shall be for the account of the LESSEE and any advances by the LESSOR for this purpose shall be reimbursed by the LESSEE. 5. PRE-TERMINATION: In the event of pre-termination of this contract by the LESSOR in case of breach, default or non-performance by the LESSEE of the terms and conditions of this contract, or in any event of pre-termination hereof by the LESSEE for whatever reason, the general security deposit or any balance thereof shall be automatically forfeited by the LESSEE in favor of the LESSOR, without prejudice to other remedies available to the LESSOR hereunder, or as may provided by law and without limiting the amount LESSEE's liability for said breach default or non-performance, 6. USES OF PREMISES: That premises hereby leased shall be used by the LESSEE for residential purposes only and shall not be diverted to other uses, It is hereby expressly agreed that if at any time the premises are used for other purposes, the LESSOR shall have the right to rescind this contract without prejudice to its other rights under the law. 7. INJURY OR DAMAGE: The LESSEE hereby assume full responsibility for any and all injuries or damages which may be cause to the person or property of third persons while in the leased premises and further agrees to hold the LESSOR free and harmless from any such claim for injury or damages unless such damages is due to the gross negligence of the LESSOR. LESSEE further binds himself to hold the LESSOR free and harmless from damages as a result thereof, unless such damage or liability arose out of structural or other inherent defects in the leased premises or is due to the fault of the LESSOR, his agent or representatives ‘The LESSOR shail not be liable or responsible: a. For the presence of bugs, vermin, ants, termites, insects, rodents and other pests, ifany, in the Jeased premises, b. For the failure of water, electricity service in the leased premises, For any injury, loss or damage which the LESSEE, his visitors might sustain in the premises for any cause. 8. INSPECTION OF PREMISES: To ensure that the lease premises is being maintained in good and tenantable conditions, the LESSOR or his authorized representative is hereby given the right after due notice, to enter and inspect any part of the leased premises during reasonable hours and as the occasion thereof might require. Furthermore, during the last two months of the term of this lease, the LESSOR shall have the right to advertise or display “FOR SALE” or “FOR RENT” sign and to show leased premises to prospective tenants. 9, HAZARDOUS AND PROHIBITIVE MATERIALS: The LESSEE shall not keep or store in the lease premise any hazardous and obnoxious substance or inflammable material or substance that might constitute a fire hazard or other chemicals and materials or prohibitive drugs in violations of the laws of the Philippines. 10. REPAIR AND OTHER MAINTENANCE WORKS; All repairs minor or ordinary, major or extra-ordinary, from and after the execution of this shall be undertaken and shall be for the exclusive account of the LESSER. a, All damages caused to the leased premises due to the fault, misuse, carelessness, and/or negligence or on account of the use thereof by the LESSEE and other occupants therein shall be made good and repaired by the repairs done. b, Should the LESSEE fails to make the necessary and appropriate repairs within five (5) days from demand, the LESSOR shall undertake the needed repairs and shall charge the costs thereof to the LESSER.
