Mr. Albright's letter finds two areas of noncompliance:
1. the maximum contaminant level of nitrate-nitrogen "consistently exceeded" the allowable limit of 10 mg per liter in Disposal Fields A and B for several months
2. the maximum contaminant level of fecal coliform "consistently exceeded" the allowable limit of zero in Disposal Fields A and B for several months
The letter also states, "EPA understands that PTP, Inc. believes it subleases the land to the Pineview Estates HOA, who operates the wastewater system which discharges effluent into Disposal Fields A and B. Please note that EPA makes no claims as to the validity of the alleged sublease agreement between PTP, Inc. and the HOA, nor to any other alleged ownership arrangement at Pineview Estates Subdivision. "
