BIA's notes indicate:
- EPA was concerned that Pine View was constructed without EPA stormwater permits or full NEPA compliance, like the other two developments.
-"EPA's opening thrust was that BIA is an 'owner-operator' under its lease approval authority and therefore is 'liable' in the event of any default or failure to comply with the sundry laws affecting protection of the environment, land, water, air, etc."
EPA and BIA planned the following action items:
-on-site inspections of the three developments, including Pine View, on 11/20/03, with BIA participation
-EPA would provide comments to environmental assessments by 11/28/03, and BIA would work "toward completing all compliance documents and processes, ensuring full compliance"
-EPA would notify developers of required stormwater permits before more construction can be done, while BIA would use EPA to "obtain enforcement and compliance with applicable laws"

Carol Bowker and Stan Webb agreed to "assess the exten[t] of our/BIA liability as 'owner'operator' per EPA allegations"
John Krause stated, "We'BIA are technically 'owners of land title'" but "We/BIA ARE NOT 'owner/operators' and therefore not liable"
