MEANING OF CONSENT
According To Section 13 Of The Indian
Contract Act 1872, Two Or More Person
Are Said To Consent When They Agree
Upon The Same Thing In The Same
Sense.

This Means That There Should Be

Perfect Identity Of Mind Regarding The
Subject Matter Of The Contract.

FREE CONSENT
To Make Contract Valid Not Only Consent Is Necessary But The Consent Should
Be Free.
Section 13, Says The Consent Is Said To BE Free When It Is Not Caused By Any
Of The Following.
(1) COERCION:- (section 15) indian contract Act 1872.
Coercion Means, Forcibly Compelling Somebody To Enter Into The Contract.

(2) UNDUE INFLUENCE:- (Section 16) indian

contract Act 1872.
Undue Influence Is The Improper Use Of Any
Power Possess Al Once The Mind Of The
Contracting Party.
The Relation Subsisting Between The
Parties Are Such That One Of The Parties Is In a
Position To Dominate The Will Of Water.

(3) FRAUD:- (section 17) indian contract Act

1872.
Intentional OR Willful Misrepresentation Of
a Material Fact Essential To The Contract Is
Called As Fraud.
A Wrong Representation Of Facts
Would Amount To Fraud Is There IS An Intension
To Deceive The Other Party.

(4) MISREPRESENTATION:- (section 18) indian

contract Act 1872.
The Term MISREPRESENTATION Means a
False Representation Of a Fact Made Innocently
OR Non-disclosure Of a Material Fact By The
Party Without Any Intention To Mislead The Other
Party.

(5) MISTAKE:- (section 19&20) indian contract Act

1872.
The Term Mistake Means An Incorrect Belief
About Something It Is In Fact ,
an Incorrect Belief Which Leads On Party To
Misunderstand The Other.
IT Take Place Where The Concerned Parties Are
Not Fully Aware Of The Terms Of The agreement.
They Take The Terms In Different Ways.
Hense There is no Consent at all Because
The Two Parties Do Not Understand The Same
Thing In Same Sence.
