Bechtel IIT, am employed by the Upper Providence Township Police Department in the capacity of a police officer with the rank of Sergeant, assigned to the Criminal Investigation Division, 1 am also cross-swom as a Special County Detective assigned to the Montgomery County District Attorney’s Internet Crimes Against Children (ICAC) Task j Force. As a Detective with the Upper Providence Township Police Department and as a Special = County Detective with the Montgomery County District Attorney’s Office ICAC Task Force, I i am empowered by law to conduct investigations of and to make arrests for offenses involving i crimes against children within Montgomery County, Pennsylvania. On Wednesday, September 23, 2015, and while conducting pro-active investigative searches related to online advertisements posted on the web site Craigslist.com as part of my duties and i responsibilities as a member of the Montgomery County District Attomney’s Office Internet Crimes Against Children (ICAC) Task Force, I happened upon the following advertisement located in the “Casual Encounters ~m4m” section of the site: looking for a twink to flip fuck with NOW (CC/ Rittenhouse) i versatile mature masculine 420 friendly guy seeking SKINNY smooth versatile white guy who loves the feel of a hard dick up his ass but also loves to give it as well as get it only replies with stats (age, height, weight, race) and body pic will be answered put SKINNY in the subject line of your reply anytime but late night is my ideal no pay-to-play ‘The post contained a single image of the area between the abdomen and thighs of a white male with his penis in an erect state. At 8:24 am J responded to the advertisement posing as a fourteen (14) year old male using an undercover e-mail address created specifically for ICAC investigations. Within thirty (30) minutes an individual responded to my e-mail and a Page_ 5 of _&conversation ensued. The following are key points in these e-mail conversations. The undercover responses are listed as “ICAC” and the responses from the target are listed as “UNSUB”. ICAC (Initial response to advertisement): dam! is that really u??2?? im prolly waaayyyy (8:24 am) UNSUB i like young guys as long as they are legal. Tell me about yourself or send a face pic if you are feeling brave (8:52 am) ICAC: ill send a face pic but DON’T make fun im kinda shy.....(9:41 am) j UNSUB: man you could sneak out with me anytime ....you are an attractive young man I 1 don't know where you got this notion that I would make fun of you ...I would be thrilled if you wanted to hook up with me ,,,, if we could work it out to be fucking i each other it would be a dream come true ....maybe we could have some car fun tonight? (11:31 pm) On Thursday, September 24, 2015, the e-mail conversations with the UNSUB continued until i 9:36 am. At 11:51 am the UNSUB reinitiated contact: UNSUB: well maybe we could do some car fun tonight? .... we would have to be very very careful (11:51 am) ICAC: Careful bout what!?! (11:59 am) UNSUB like i said, us hooking up is illegal ..it would ruin my life if we got caught (12:02 pm) UNSUB: i know it is absurd but it's been the law for decades. On Friday, September 25, 2015, communications with the UNSUB occurred both via e-mail and text messaging to the telephone number provided. (8:43 am) UNSUB: Oh nate you are the defintion of insecurity (8:48 am) ICAC: im sorry _ its just ive been trying to learn and meet people and everyone says im 2 young because im 14 and that makes me feel dum and like i cant do anything andu really seem nice and really make me horny —_and im afraid of dissapointing u i totes don’t want to do that (8:50 am) UNSUB: Nate man i have your dick in my mouth u may be ASSURED i like u (8:57 am) During the communications the UNSUB referred to himself as “Charles”, provided me with a cellular telephone number, advised that he lived on 21* Street in Philadelphia between Suburban Station and 30" Street Station, that he drove a Subaru Forester, and that he was a Jazz musician in Philadelphia scheduled to go on an international tour beginning on Tuesday, September 29, 2015. A background check was completed and the telephone number provided was found to be associated with a Charles L. COHEN of 100 block of South 21* Street in Philadelphia. COHEN was found to have a date of birth of October 9, 1945, making him 69 years old. He was also found to have a 2002 Subaru Forester registered in his name. A driver’s license photograph of COHEN was obtained. Communications continued on that date with COHEN and it was tentatively planned that we would meet for a sexual encounter on Monday, September 28, 2015, prior to him leaving the country for a music tour in Europe. The meet was set to occur in a parking lot located at 600 Commerce Drive in the Collegeville section of Upper Providence Township. During the conversation, COHEN discussed his plans when meeting with the UNSUB and indicated that he was interested in a sexual act called “edging” and that it was “sort of erotic torture” and then ‘went on to describe “edging.” On Saturday, September 26, 2015, at 11:22 am COHEN sent me the following e-mail: COHEN: sitting here with a boner thinking of hoping on a bus and coming out there.....well, not really, but damn . here is to hoping ahookup can. be worked out for us on Monday ....tight now I’m thinking about coming out there after dark. (11:22 am) Page _7 of _ 7 _On Sunday, September 27, 2015, at 3:16 pm COHEN e-mailed me and stated that he wanted to start planning the meet for Monday. Additionally, he stated that he could bring a big blanket to hide under, and that we would kiss and give each other oral sex. ‘On Monday, September 28, 2015, at 9:29 am COHEN began e-mailing me and we discussed the possibility about meeting later that day. It was subsequently agreed via e-mail that he would meet me in the area of 600 Commerce Drive in the Collegeville section of Upper Providence Township. At 11:42 am I received a text message from COHEN reading “On my way now”. We continued text messaging and at approximately 12:29 pm COHEN was observed walking out of the business located at 600 Commerce Drive and was taken into custody. He had in his possession a dark gray Samsung cellular telephone.
