= MOTION TO DISMISS =
COMES NOW, movant defendants, by counsel and unto
this Honorable Court, respectfully move to Dismiss the above
entitled Complaint anchored on the following resolute and
valid ground that the court has no jurisdiction over the
subject matter of the claim.
= ARGUMENTS =
1. This Honorable Court is totally bereft of jurisdiction to
hear and try this instant case as the mandatory provision of
B.P. 129, as amended by R.A. 7691 Section 5 provided for an
increase on its jurisdictional amounts adjusted further to
three hundred thousand pesos (P300, 000).
2. The subject matter herein filed by the plaintiffs consist
of a contractual obligation to pay which is capable of
pecuniary estimation amounting to Two hundred ninety
thousand pesos (P290, 000), in which the defendants
allegedly failed to comply with and that subsequently
prompted the plaintiffs to file this complaint for cancellation
of contract.
3. The amount provided under their contract is way below
of what is required by law in which the Regional Trial Court
cannot acquire jurisdiction.

Wherefore, premises considered, it is respectfully

prayed that this instant case be dismissed outright based on
the aforecited ground.
