SachchidanandaSinhatobethetemporaryChairmanofthisAssembly.Dr.Sinhaneedsno
introduction.Youallknowhim.Heisnotonlytheoldestamongusbutalsotheoldestparliamentarian
inIndia,havingserved,asyouknow,asamemberoftheImperialLegislativeCouncilfrom1910to
1920.TheenteredtheCentralLegislativeAssemblyin1921notonlyasoneofitsmembers,but,'Is
DeputyPresidentalso.HewasthenentrustedwiththeportfolioofanExecutiveCouncellorand
FinanceMemberoftheGovernmentofBiharandOrissa.SofarasIrememberDr.Sinhawasthefirst
IndianwhowaseverappointedasaFinanceMemberofaProvince.Hehasaparticulartastefor
educationhavingbeenViceChancellorofthePatnaUniversityforeightyears.Overandaboveall
this,Dr.SinhaistheoldestCongressmanamongus.Uptill1920hewasamemberoftheCongress,
beingatonetimeitsSecretary.
Aftertheyear1920whenwestartedonanewwaytogainfreedomhepartedcompanywithus.He,
however,neverwhollyleftus.Hehasalwaysbeenhelpingus.Heneverjoinedanyotherorganization
andhissympathieswereeverwithus.SuchapersonisentitledtobethetemporaryChairmanofthis
Assembly.Hisworkisbriefbutitisallthesamemostimportant.Itisinauguratingtheproceedingof
thisHouse.AswebegineveryworkwithDivineblessingswerequestDr.Sinhatoinvokethese
blessingssothatourworkmayproceedsmoothly.Now,Ioncemore,(inyourbehalf,calluponDr.
SinhatotaketheChair.]

TheChairman:ThenextthingwhichIhavetobringtothenoticeoftheHouseisthatIhavereceived
anelectionpetitionfromKhanAbdusSamadKhanofBritishBaluchistanchallengingthevalidityof
theelectionofNawabMohammadKhanJogazaiasamemberoftheConstituentAssembly
representingBritishBaluchistan.TheHousewilldoubtlesslookintothismatter,induecourse,after
theelectionofthepermanentChairman.Butmyrulingatthisstageisthatthegentlemandeclared
electedwillcontinuetoberegardedasaMemberofthisHouseuntilthematterisdisposedof,ata
laterstage,bytheHouse,aftertheelectionofthepermanentChairman.

CHAIRMAN'SINAUGURALADDRESSHON'BLEMEMBERSOFTHEFIRSTINDIAN
CONSTITUENTASSEMBLY:
IamdeeplybeholdentoyouforyourhavingagreedtoacceptmeasthefirstPresidentofyour
ConstituentAssembly,whichwillenablemetoassistyouintransactingthepreliminarybusiness
beforetheHosuchastheelectionofapermanentPresident,theframingoftheRulesofBusiness,the
appointmentofvariousCommittees,andsettlingthequestionofgivingPublicityto,orkeeping
confidential,yourproceedingswhichwillultimatelyleadyoutocrownyourlaboursbyformulatinga
suitableandstableconstitutionforanIndependentIndia.Inexpressingmysenseofappreciationof
yourgreatkindness,IcannotconcealfrommyselfthatIfeelcomparingsmallthingswithgreatthatI
am,onthepresentoccasioninthepositioninwhichLordPalmerstonfoundhimselfwhenQueen
VictoriaofferedhimthehighestOrderofChivalry,namely,theKnighthoodoftheGarter.In
acceptingtheQueen'soffer,LordPalmerstonwrotetoafriendasfollows:
"IhavegratefullyacceptedHerMajesty'sgraciousofferas,thankGod,thereisnoquestionofany
damnedmeritaboutthehonourconferredonme."
IsayIfindmyselfmoreorlessinthesameposition,foryouhaveagreedtoacceptmeasyour
PresidentonthesolegroundthatIage,theseniormostmemberofthisAssembly.Whateverthe
groundhowever,onwhichyouhavechosentohavemeasyourfirstPresident,Iamnonetheless
profoundlygratefultoyou.Ihavehad,inmyfairlylonglife,severalhonoursconferredonmein
recognitionofmyservicesasahumbleworkerinpublicinterest,butIassureyouthatIregardyour
markoffavourasasignalhonour,whichIshallcherishthroughouttherestofmylife.
Onthishistoricandmemorableoccasion,youwillnotgrudge,Iamsure,ifIventuretoaddressto
YousomeobservationsoncertainaspectsofwhatiscalledaConstituentAssembly.Thispolitical
methodofdevisingaconstitutionforacountryhasnotbeenknowntoourfellowsubjectsinBritain,
forthesimplereason,thatundertheBritishConstitution,
thereisnosuchthingasaconstituentlaw,itbeingacherishedprivilegeoftheBritishParliament,as
thesolesovereignauthority,tomakeandunmakealllaws,includingtheconstitutionallawofthe
country.Assuch,wehavetolooktocountriesotherthanBritaintobeabletoformacorrectestimate
ofthepositionofaConstituentAssembly.InEurope,theoldestRepublic,thatofSwitzerland,hasnot
hadaConstituentLaw,intheordinarysenseofthatterm,foritcameintoexistence,onamuch
smallerscalethanitnowexists,duetohistoriccausesandaccidents,severalcenturiesback.
Nevertheless,thepresentconstitutionalsystemofSwitzerlandhasseveralnotableandinstructive
features,whichhavestronglybeenrecommendedbyqualifiedauthoritiestoIndianconstitution
makers,andIhavenodoubtthatthisgreatAssemblywillstudycarefullytheSwissConstitution,and
trytoutiliseittothebestadvantageintheinterestofpreparingasuitableconstitutionforafreeand
independentIndia.
TheonlyotherStateinEurope,totheconstitutionofwhichwecouldturnwithsomeadvantage,is
thatofFrance,thefirstConstituentAssemblyofwhich(called"TheFrenchNationalAssembly")was
convokedin1789,aftertheFrenchRevolutionhadsucceededinoverthrowingtheFrenchmonarchy.
ButtheFrenchRepublicansystemofGovernmenthadbeenchangedsincethen,fromtimetotime,
andisevennow,moreorless,inthemeltingpot.Though,therefore,youmaynotbeabletoasmuch
advantagefromastudyoftheFrenchsystemofconstituentlawasthatoftheSwiss,thatisnoreason
whyyoushouldnotseektoderivewhatadvantageyoucaninthepreparationofthetaskbeforeyou,
byastudyofit.
Asamatteroffact,theFrenchconstitutionmakers,whometin1789atthefirstConstituentAssembly
oftheircountry,werethemselveslargelyinfluencedbytheworkdonebutacoupleofyearsearlierin
1787,bythehistoricConstitutionalConventionheldatPhiladelphiabytheAmericanconstitution
makers,fortheircountry.HavingthrownofftheirallegiancetotheBritishKinginParliament,they
metanddrewupwhathadbeenregarded,andjustlyso,asthesoundest,andmostpracticaland

workablerepublicanconstitutioninexistence.Itisthisgreatconstitution,whichhadbeennaturally
takenasthemodelforallsubsequentconstitutionsnotonlyofFrance,butalsooftheselfgoverning
DominionsoftheBritishCommonwealth,likeCanada,Australia,andSouthAfricaandIhaveno
doubtthatyouwillalso,inthenatureofthings,payinthecourseofyourwork,greaterattentiontothe
provisionsoftheAmericanConstitutionthantothoseofanyother.
IhavereferredabovetotheselfgoverningconstitutionsofthegreatDominionsoftheBritish
Commonwealthbeingbasedon,toalargeextent,ifnotactuallyderived:from,theAmerican
constitutionalsystem.ThefirsttobenefitbytheAmericansystemwasCanada,thehistoric
Conventionofwhichcountry,fordrawingupaselfgoverningconstitution,metin1864,atQuebec.
ThisConventiondrewuptheCanadianConstitution,whichwassubsequentlyembodiedinwhatis
stillontheStatuteBookastheBritishNorthAmericanAct,passedbytheBritishParliamentin1867.
YoumaybeinterestedtohearthattheQuebecConventionconsistedofonly33delegatesfromallthe
provincesofCanada,andthatConventionof33representativesissuedasmanyas74resolutions,
whichwereafterwardsdulyincorporatedintotalintheBritishNorthAmericanAct,underthe
provisionsofwhichthefirstselfgoverningDominionoftheBritishCommonwealthofCanada,came
intoexistence,in1867.TheBritishParliamentacceptedtileCanadianConvention'sschemeinits
entirety,exceptformakingonlyonedraftingamendment.Ihopeandpray,Hon'bleMembers,that
yourlaboursmaybecrownedwithasimilarsuccess.
TheAmericanconstitutionalsystemwasmoreorlessadoptedintheschemespreparedforframingthe
ConstitutionsofAustraliaandSouthAfrica,which
showsthattheresultsachievedbytheAmericanConventionheldatPhiladelphiain1787,hadbeen
acceptedbytheworldasamodelforframingindependentfederalconstitutionsforvariouscountries.
ItisforthesereasonsthatIhavefeltjustifiedininvitingyourattentiontotheAmericansystemof
constituentandconstitutionallawasonewhichshouldbecarefullystudiedbyyounotnecessarilyfor
wholesaleadoption,butforthejudiciousadaptationofitsprovisionstothenecessitiesand
requirementsofyourowncountry,withsuchmodificationsasmaybenecessaryoressentialowingto
thepeculiarconditionsofoursocial,economicandpoliticallife.Ihavedonesoasaccordingto
MunroastandardauthorityonthesubjecttheAmericanConstitutionisbasedon"aseriesof
agreementsaswellasaseriesofcompromises".Imayventuretoadd,asaresultofmylong
experienceofpubliclifefornownearlyhalfacentury,thatreasonableagreementsandjudicious
compromisesarenowheremorecalledforthaninframingaconstitutionforacountrylikeIndia.
Incommendingtoyouforyourcarefulconsiderationandacceptance,withreasonableagreementsand
judiciouscompromises,thefundamentalprinciplesoftheAmericansystem,Icannotdobetterthan
quotethestrikingobservationsonthesubjectofthegreatestBritishauthoritynamelyViscountBryce,
whoinhismonumentalwork,called"TheAmericanCommonwealth",writesasfollows,puttingina
veryfewlinesthesubstanceofthefundamentalprinciplesoftheAmericanConstitution:
"Itscentralornationalisnotamereleague.foritdoesnotwhollydependonthecomponent
communitieswhichwecalltheStates.ItisitselfaCommonwealth,aswellasaunionof
Commonwealths,becauseitclaimsdirectlytheobedienceofeverycitizen,andactsimmediatelyupon
himthroughitscourtsandexecutiveofficers.Stilllessaretheminorcommunities,theStates,mere
subdivisionsoftheUnion,merecreaturesoftheNationalGovernment,likethecountiesofEngland,
ortheDepartmentsofFrance.Theyhaveovertheircitizensanauthoritywhichistheirown,andnot
delegatedbytheCentralGovernment."
Itmaypossiblybethatinsomesuchscheme,skillfullyadaptedtoourownrequirements,a
satisfactorysolutionmaybefoundforaconstitutionforanIndependentIndia,whichmaysatisfythe
reasonableexpectationsandlegitimateaspirationsofalmostalltheleadingpoliticalpartiesinthe
country.HavingquotedthegreatestBritishauthorityonthegreat,inherent,meritsoftheAmerican
Constitution,youwill,Ihope,bearwithmeafairlylongquotationfromthegreatestAmericanJurist,
JosephStory.Inconcludinghiscelebratedbook,called"CommentariesontheConstitutionofthe

UnitedStates",hemadecertainstrikingandinspiringobservationswhichIpresenttoyouasworthy
ofyourattention.SaidStory:
"LettheAmericanyouthneverforget,thattheypossess(intheirConstitution)anobleinheritance,
boughtbythetoils,andsufferings,andbloodoftheirancestorsandcapable,ifwiselyimproved,and
faithfullyguarded,oftransmittingtotheirlatestposterityallthesubstantialblessingsoflife,the
peacefulenjoymentofliberty,property,religion,andindependence.Thestructurehasbeenerectedby
architectsofconsummateskillandfidelityitsfoundationsaresoliditscompartmentsarebeautiful,
aswellasusefulitsarrangementsarefullofwisdomandorderanditsdefencesareimpregnablefrom
without.Ithasbeenrearedforimmortalityiftheworkofmanmayjustlyaspiretosuchatitle.Itmay,
nevertheless,parishinanhourbythefolly,orcorruption,ornegligenceofitsonlykeepers,THE
PEOPLE.Republicsare'createdthesearethewordswhichIcommendtoyouforyourconsideration
bythevirtue,publicspirit,andintelligenceofthecitizens.Theyfall,whenthewisearebanishedfrom
thepubliccouncils,becausetheydaretobehonest,andtheprofligatearerewarded,becausethey
flatterthepeople,inorderto
betraythem.,'
ToquoteyetonemoreleadingauthorityonthealmostidealConstitutionofAmerica,James(atone
timeSolicitorGeneraloftheUnitedStates)saysinhishighlyinstructivebook,called,"The
ConstitutionoftheUnitedStatesYesterday,Today,andTomorrow"
"Constitutions,asagovernmentalpanacea,havecomeandgonebutitcanbesaidoftheAmerican
Constitution,paraphrasingthenobletributeofDr.JohnsontotheimmortalfameofShakespeare,that
thestreamoftimewhichhaswashedawaythedissolublefabricofmanyotherpaperconstitutions,has
leftalmostuntoucheditsadamantinestrength.Exceptingthefirsttenamendments,whichwere
virtuallyapartoftheoriginalcharter,onlynineothershavebeenadoptedinmorethanonehundred
andthirtyyears.Whatotherformofgovernmenthasbetterstoodthetestoftime?'
Hon'bleMembers,myprayeristhattheConstitutionthatyouaregoingtoplanmaysimilarlybe
rearedfor'Immortality',iftheworkofmanmayjustlyaspiretosuchatitle,anditmaybeastructure
of'adamantinestrength,whichwilloutlastandovercomeallpresentandfuturedestructiveforces.
HavinginvitedyourattentiontosomeaspectsofthequestionofconstitutionmakinginEuropeand
America,Imaynowprofitablyturntosomeaspectsofthequestioninourowncountry.Thefirst
definitereferencetoaConstituentAssembly(thoughnotunderthosewordsorunderthatparticular
name)IhavefoundinastatementofMahatmaGandhi,madesofarbackas1922.Mahatmajiwrote:
'SwarajwillnotbeafreegiftoftheBritishParliament.ItwillbeadeclarationofIndia'sfullself
expression,expressedthroughanActofParliament.Butitwillbemerelyacourteousratificationof
thedeclaredwishofthepeopleofIndia.TheratificationwillbeatreatytowhichBritainwillbea
party.TheBritishParliament.whenthesettlementcomes,willratifythewishesofthepeopleofIndia
asexpressedthroughthefreelychosenrepresentatives."
ThedemandmadebyMahatmaGandhiforaConstituentAssembly,composedofthe"freelychosen
representatives"ofthepeopleofIndia,wasaffirmed,fromtimetotime,byvariouspublicbodiesand
politicalleaders,butitwasnottillMay,1934,thattheSwarajParty,whichwasthenformedatRanchi
(inBihar),formulatedaschemeinwhichthefollowingresolutionwasincluded:
"ThisConferenceclaimsforIndiatherightofselfdetermination,andtheonlymethodofapplying
thatprincipleistoconveneaConstituentAssembly,representativeofallsectionsoftheIndian
people,toframeanacceptableconstitution."
ThepolicyembodiedinthisresolutionwasapprovedbytheAllIndiaCongressCommittee,which
metatPatnathecapitalofBiharafewdayslater,inMay,1934anditwasthusthattheschemeofa

ConstituentAssemblyforframingtheIndianConstitutionwasofficiallyadoptedbytheIndian
NationalCongress.
TheaboveresolutionwasconfirmedatthesessionoftheCongressheldatFaizpurinDecember1936.
Theconfirmingresolutiondeclaredthat
"TheCongressstandsforagenuinedemocraticStateinIndiawherepoliticalpowerhasbeen
transferredtothepeople,asawhole,andtheGovernmentisundertheireffectivecontrol.SuchaState
canonlycomeintoexistencethrough.aConstituentAssemblyhavingthepowertodeterminefinally
theconstitutionofthecountry."
InNovember,1939,theCongressWorkingCommitteeadoptedaresolutionwhichdeclaredthat
"RecognitionofIndia'sindependenceandtherightofherpeopletoframetheirconstitutionthrougha
ConstituentAssemblyisessential.,
ImayaddthatintheresolutionsfromwhichIhavequotedabove(thoseadoptedattheCongress
WorkingCommitteeofNovember1939,andattheFaizpursessionoftheCongressof1936)itwas
declaredthattheConstituentAssemblyshouldbeelectedonthebasisofadultsuffrage.Sincethe
Congressgavealeadonthesubjectin1934,theideaofaConstituentAssemblyhadcometoprevail
largelyasanarticleoffaithinalmostallthepoliticallymindedclassesinthecountry.
ButuntiltheadoptionoftheresolutiononPakistan,inMarch1940,bytheMuslimLeague,that
politicalorganizationhadnotfavouredtheideaofaConstituentAssemblyasaproperandsuitable
methodforframingaconstitutionforthiscountry.Aftertheadoptionofthatresolution,however,the
attitudeoftheMuslimLeagueseemstohaveundergoneachangeinfavouroftheideaofa
ConstituentAssemblyonefortheareasclaimedbytheLeagueforaseparateMuslimState,andthe
otherfortherestofIndia.ThusitmaybestatedthattheideaofaConstituentAssembly,astheonly
directmeansfortheframingofaconstitutioninthiscountry,cametobeentertainedandacceptedby
thetwomajorpoliticalpartiesin1940,withthisdifferencethatwhiletheCongressdesiredone
ConstituentAssemblyforIndia,asawhole,theMuslimLeaguewantedtwoConstituentAssemblies,
inaccordancewithitsdemandfortwoseparateStatesinthecountry.Anyway,whetheroneortwo,
theideaofaConstituentAssemblybeingthepropermethodfortheframingofaconstitutionhad
clearlydawnedbythattimeonpublicconsciousnessinthecountry,anditwaswithreferencetothat
greatmentalupheavalthatPanditJawaharlalNehrudeclaredthat"itmeansanationonthemove,
fashioningforitselfanewGovernmentofitsownmaking,throughtheirelectedrepresentatives".
ItremainstoaddthattheconceptionofaConstituentAssemblyasthemostappropriatemethodfor
framingtheconstitutionofIndiahadalsofoundfavourwiththemembersoftheSapruCommitteein
thereportofwhich,issuedlastyear(1945),isformulatedadefiniteschemeforthecompositionofa
ConstituentAssembly.Wearemeeting,howeverinAssemblytoday,undertheschemepropounded
bytheBritishCobinetMission,which,thoughdifferingfromthesuggestionsmadeonthesubjectby
theCongress,theLeague,andotherpoliticalorganizations,haddevisedaschemewhich,thoughnot
byall,hadbeenacceptedbymanypoliticalparties,andalsobylargesectionsofthepolitically
mindedclassesinthecountry,butalsobythosenotbelongingtoanypoliticalpartly,asonewell
worthgivingatrial,withaviewtoendthepoliticaldeadlock,whichhadobtainedfornowmanyyears
past,andfrustratedouraimsandaspirations.Ihavenodesiretogofurtherintothemeritsofthe
BritishCabinetMission'sschemeasthatmightleadmetotrespassoncontroversialground,whichI
haveno,desiretotraverseonthepresentoccasion.Iamawarethatsomepartsofthescheme,
propoundedbytheBritishCabinetMission,havebeenthesubjectofacutecontroversiesbetween
someofthepoliticalpartiesamongstus,andIdonotwant,therefore,torushinwhereevenpolitical
anglesmightwellfeartotread.
