WHEREAS, on Merch 91, 2015 the Mayer and Council ofthe Borough of Lodi ‘adopted Resolution No. 15-58 authorizing tne acceptance ofthe bid by Sterling Carting Inc. (Vendor) and entering into Contract for the collection and digposal of solid waste, vegetative waste ard recycable materials for Bid Option 3 in the amount of '$685,800.00 for the frst year withthe Borough's option to extend the Contract for a Second year in the amount of $696,000.00 with Borough's option to extend the Contract {ora third year in the amount of $707,700.00 as set forth in the Bid Speolications and Bid Proposal and whereby the Borough entered into sald Contract (Contract); and WHEREAS, the Bid Specifications at page 28 stated that: “VEGETATIVE WASTE will be picked up in the following manner: GRASS AND YARD WASTE on the fiat four Wednesdays of each month from April throunh September. Grass cen be rmoxed wih yard waste and tree timmings-; and WHEREAS, the Borough Manager of the Borough of Lodl as Chief Executive Officer has determined that Vegetative Waste including grass end yard waste and tree {trimmings including leaves must also be picked up during the months of October, November and December and has negotiated a price withthe vendor for same at the ‘ate of $2,000.00 per week on each Wednesday during the months of October, November and December not to exceed 13 waeks or $26,000.00; and WHEREAS, N.J.A,C.5:90-11 et seq provides forthe issuance of change orders to contracts entered into with vendors whare the change arder does not exceed 20% of the Contract price; and WHEREAS, this change order amounts to merely 3.79% of the original Contract price; and. The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions promigated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the Borough Clerk and is available for public inspection. Now, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Lodi, County of Borgen, State of New Jersey that Section 1. The Mayor and Council of the Borough of Loci hereby determines that itis in the best interests of the Borough of Lodi to enter into a Lease Agreement as “Tenant to lease real property and improvements known as 168 Union Stree, Lodi, New Jersey also known as Biook 97, Lot 712 on the Tax Assessment Map ofthe Borough of LodHomshe V.EW.
