Auction Properties
What is an auction property?
An auction property is a property, be it residential or commercial, that
goes up for sale through an open and competitive process whereby
interested buyers will place bids on it. The buyer who makes the
highest bid during the auction process will get to buy the property as
long as the bid price meets or exceeds the reserve price.
Once the hammer falls, the legal binding contract is set between the
seller and purchaser, a deposit is paid and a set completion date is
confirmed. The auctions are the most effective way to recognize,
create and channel demand.

Buying Tips

Conduct an external inspection of the property to ascertain the


condition of the property.

Conduct an official search with the relevant Land Office and


make general enquiries with the developer or management office.

Get a copy of Proclamation of Sale (POS) and Condition of Sale


(COS). Interested bidders are required to register their details
with CIMB Property Mart, prior to the auction.

Secondary Sale Properties

Take note of the auction time, date and venue. Prepare a bank
draft or cashiers order for the deposit amount equivalent to
either 5% or 10% to the Reserve Price before the auction date.

On the auction day, please ensure that you reach the auction
venue earlier and register at the auctioneer registration counter.

The auctioneer will announce the commencement of the auction,


and then provide a briefing on the bidding process. He/she will
then read out the important clauses in the COS and property
information.

The bidder is to raise his/her bidding card to indicate the bidding


price. The bidding process will stop when the highest price is
called out 3 times by the auctioneer and no further bids are
made. At the fall of the hammer, the property is sold.

The successful bidder is required to sign Contract of Sale and


pay the difference on the deposit sum between the successful
bidding price and the reserve price, if there is an increment in
bidding price. The balance of the purchase price must be paid
within the time frame given.

If you are not the successful bidder, you may redeem your bank
draft or cashiers order at the registration counter immediately
after the auction.

What are secondary sale properties?


Secondary sale properties are properties that have been foreclosed
and acquired by the Bank or its subsidiaries as bidder of last resort
during auctions. It also refers to properties that are acquired by the
Bank or its subsidiaries, arising from compromised settlements with
borrowers. The ownership of these properties lies with the Bank or
its subsidiaries. CIMB Property Mart sells these properties through
negotiated sales with interested buyers.
Additionally, secondary sale properties also consist of properties
owned by third parties or the Banks customers who have enlisted
CIMB Property Marts assistance to market these properties.
Interested buyers or Real Estate Agents (REA) will then negotiate
directly with the owners or the Banks customers for the sale.

for sale on the CIMB Property Mart website or booklet, to
select a property.
Get further details on the selected property from CIMB
Property Mart.
Interested buyers/REAs are required to fill up the Offer to
Purchase Form and submit to CIMB Property Mart, together
with a 2% earnest deposit or RM1,000, whichever is higher,
in the form of a bank draft payable to CIMB Bank Berhad.
If represented by a panel REA, the interested buyer should
ensure that the REA signs the Offer to Purchase Form.

CIMB Property Mart will revert within 30 days. If offer is accepted,


the interested buyer will receive a Letter of Award (LOA). From the
date of LOA issuance, the successful buyer is required to sign
the Sale and Purchase Agreement (SPA) and pay a 10% deposit
within 30 days thereof. This includes a 2% retention sum for
Real Property Gains Tax purposes. If the offer is rejected, CIMB
Property Mart will refund the 2% earnest deposit submitted
earlier, free of interest.

Balance 88% of the purchase price (less retention sum) is


payable within 3 months from the SPA date or 1 month after the
SPA becomes unconditional, whichever is later.

The property is sold on an as is where is basis, with no warranty


or representation on title, description, fitness for purpose, quality,
condition or vacant possession of the property either expressed
or implied.

Interested buyers are advised to inspect the property and


conduct the necessary searches or enquiries with the relevant
authorities, prior to submitting their offers.

End-financing is available from CIMB Bank for eligible buyers.

Stamp duty and registration fees, in respect of the transfer of


property, will be borne by the buyer. The buyer should appoint
their own solicitors to represent them in the sale transaction.
The SPA will be prepared by the banks solicitors and legal fee,
in respect of the SPA, is borne by the bank. The buyer will be
responsible for legal fees charged by their own solicitors.

The outstanding quit rent and assessment prior to the SPA date
will be absorbed by the bank. Buyers will be responsible for
payment of quit rent and assessment after the SPA date. All other
outstanding outgoings e.g. maintenance charges and utilities will
be borne by the buyer.

5. Q: Who will bear all the quit rent, assessment,


maintenance outstanding and utilities bills?
A: The outstanding quit rent & assessment will be borne by
the bank, up to the date of auction. However, the payment
of the outstanding maintenance and utilities charges will be
subject to the terms and conditions stated in COS. Interested
bidders are advised to read the relevant clauses of the COS.

3. Q: What is the Reserve Price?
A: The Reserve Price is the lowest price at which the property
can be sold. The auctioneer will start the bidding process with
a price not less than the Reserve Price, in the event that there is
more than one registered bidder for the same property. If there
is only one registered bidder for the property, the property will
be sold at the Reserve Price.
4. Q: What is Current Market Value (CMV)?
A: The Current Market Value is also known as Open Market
Value (OMV). It is the property value quoted by a licensed
valuer and it is usually based on a comparison method with the
recent transaction price of a similar property in the surrounding
areas of the said property.

6. Q: What are the benefits of buying auctioned properties?


A: a) It is a smarter investment choice as auctioned properties
are sold at a fair market value without having to go through
any long drawn negotiations.
b) The risk of abandoned housing developments can be
avoided.

7. Q: If I cannot attend the auction, what should I do?
A: If you cannot attend the auction, you can authorize anyone
who is 18 years old and above to bid on behalf of you.
However, the bidders representative must bring along the
original authorization letter together with a photocopy of your
identification card and bank draft to the auction.
8. Q: What if the Successful Bidding Price is higher than the
Reserve Price?
A: Be prepared to top-up the difference on the deposit sum
between the Final Successful Bidding Price and the Reserve
Price by cash immediately after the auction. Please ensure
that the final price or the purchase price is within your
budget. If you have a limited budget, you can always find
out from any CIMB Bank loan officer whether you are eligible
for a financing of the balance of the purchase price, prior to
the auction.
9. Q: Do I need to appoint my own lawyer to handle the transfer
of property ownership?
A: Yes, you need to appoint your own lawyer to act on your
behalf to execute the transfer of the property ownership. The
lawyer attending the auction will act on behalf of CIMB Bank
Berhad only.
10. Q: What is the length of time given to complete the
Contract of Sale?
A: The duration is either 90 days or 120 days from the auction
date, depending on the Conditions of Sale. Thus, should you
wish to obtain financing, it is advisable to apply the same as
soon as possible after the auction.

Hartanah Lelongan
Apakah itu hartanah lelongan?
Hartanah lelongan ialah hartanah kediaman atau komersial yang
dijual melalui proses yang kompetitif dan terbuka, iaitu pembidaan
oleh pembeli yang berminat. Pembeli yang menawarkan bidaan
tertinggi semasa proses lelongan akan dapat membeli hartanah
tersebut asalkan harga bidaan mencapai atau melebihi harga rizab.
Selepas ketukan tukul terakhir, kontrak yang sah telahpun
ditetapkan antara penjual dengan pembeli, deposit dibayar dan
tarikh penyempurnaan akan ditentukan. Lelongan adalah cara paling
berkesan untuk mengenal pasti, menghasilkan dan menyampaikan
permintaan.

Catit masa, tarikh dan lokasi. Sediakan Bank Draf atau cashiers
order untuk jumlah deposit yang bersamaan dengan 5% atau
10% daripada Harga Rizab sebelum tarikh lelongan.

Pada hari lelongan, sila pastikan yang anda tiba di lokasi awal
dan daftar di kaunter pendaftaran lelongan.

Pelelong akan mengumumkan bermulanya lelongan dan


memberikan maklumat ringkas mengenai proses bidaan.
Seterusnya, dia akan membaca klausa-klausa penting dalam
Syarat-syarat Jualan (COS) dan maklumat hartanah.

Pembida hendaklah mengangkat kad bidaan sebagai


menunjukkan harga bidaannya. Proses pembidaan akan tamat
apabila harga tertinggi disebut sebanyak tiga kali oleh pelelong
dan tiada bidaan lain yang dibuat. Sebaik sahaja penukul diketuk,
hartanah lelongan tersebut dijual kepada pembida dengan harga
bidaan yang tertinggi.

Pembida yang berjaya dalam bidaan wajib menandatangani


Memorandum Jualan dan membayar perbezaan nilai deposit
seandainya terdapat kenaikan pada harga bidaan berbanding
Harga Rizab. Baki harga pembelian mesti dibayar dalam tempoh
masa yang diberikan.

Jika anda tidak berjaya membida, Bank Draf atau cashiers order
boleh dituntut kembali di kaunter pendaftaran sejurus selepas
lelongan berakhir.

Apakah itu hartanah jualan sekunder?


Hartanah jualan sekunder (secondary sale properties) ialah hartanah
lelongan yang diambilalih oleh pihak Bank atau subsidiarinya
sebagai pembida dalam lelongan terakhir. Ianya juga merujuk
kepada hartanah yang diperolehi oleh pihak Bank atau subsidiarinya
daripada peminjam dengan cara penyelesaian berkompromi.
Hak milik hartanah-hartanah ini dimiliki oleh pihak Bank atau
subsidiarinya. CIMB Property Mart berunding dengan pembeli yang
berminat untuk menjual hartanah tersebut.
Selain itu, hartanah ini juga terdiri daripada hartanah yang dimiliki
oleh pihak ketiga atau pelanggan bank yang telah mendapatkan
khidmat CIMB Property Mart untuk menjual hartanah tersebut.
Pembeli yang berminat / REA akan berunding secara langsung
dengan pemilik atau pelanggan bank tersebut untuk urusan jualan.

Pembeli yang berminat / REA dikehendaki mengisi Borang


Tawaran Pembelian dan menghantarnya ke CIMB Property
Mart bersama bayaran deposit sebanyak 2% atau RM1000
(mana-mana yang lebih tinggi), dalam bentuk Bank Draf atas
nama CIMB Bank Berhad. Jika diwakili oleh REA panel, pembeli
yang berminat perlu memastikan bahawa REA menandatangani
Borang Tawaran Pembelian tersebut.

CIMB Property Mart akan menghubungi anda dalam tempoh


30 hari. Jika tawaran diterima, pembeli akan menerima kontrak
(LOA). Pembeli yang berjaya perlu menandatangani Perjanjian
Jual Beli (SPA) dan membuat bayaran deposit sebanyak 10%
dalam tempoh 30 hari selepas tarikh pengeluaran LOA. Bayaran
ini termasuk 2% jumlah tahanan wang untuk tujuan Cukai
Keuntungan Harta Tanah (CKHT). Jika tawaran ditolak, CIMB
Property Mart akan mengembalikan bayaran deposit sebanyak
2% yang dibayar sebelum itu (tanpa sebarang faedah).

Baki sebanyak 88% daripada harga belian (setelah tolak jumlah


tahanan wang) mesti dibayar dalam tempoh 3 bulan daripada
tarikh SPA atau 1 bulan selepas SPA menjadi tidak bersyarat
(mana-mana yang lebih lewat).

Hartanah tersebut akan dijual Dalam Keadaan Sedia Ada (as


is where is) tanpa sebarang waranti atau representasi mengenai
hak milik, keterangan, kesesuaian untuk tujuan, kualiti, keadaan
atau pemilikan kosong hartanah tersebut sama ada secara
tersurat atau tersirat.

Pembeli yang berminat dinasihatkan untuk memeriksa


keadaan hartanah tersebut dan membuat carian / pertanyaan
yang sewajarnya dengan pihak berkuasa berkaitan sebelum
menghantar tawaran mereka.

Pembiayaan disediakan oleh CIMB Bank untuk pembeli yang


layak.

Duti setem dan bayaran pendaftaran berkaitan pemindahan


hartanah akan ditanggung oleh pembeli. Pembeli perlu melantik
peguam mereka sendiri untuk mewakili mereka dalam transaksi
jualan. SPA akan disediakan oleh peguam bank dan bayaran
guaman berkenaan SPA akan ditanggung oleh bank. Pembeli
akan bertanggungjawab untuk membayar bayaran guaman yang
dikenakan oleh peguam mereka sendiri.

Bayaran cukai tanah dan taksiran tertunggak sebelum tarikh


SPA akan ditanggung oleh bank. Pembeli bertanggungjawab
untuk membayar cukai tanah dan taksiran selepas tarikh SPA.
Tunggakan bayaran lain seperti bayaran penyelenggaraan dan
utiliti akan ditanggung oleh pembeli.

5. S: Siapakah yang akan menanggung cukai tanah, cukai


taksiran, kos penyelenggaraan dan bil-bil utiliti yang
tertunggak?
J: Bayaran cukai tanah dan taksiran yang tertunggak setakat
tarikh lelongan akan ditanggung oleh pihak bank. Namun
tunggakan kos penyelenggaraan dan bil-bil utiliti akan
bergantung kepada terma dan syarat seperti yang termaktub
dalam Syarat-syarat Jualan (COS). Pembida yang berminat
dinasihatkan supaya membaca klausa yang releven dalam
COS.

3. S: Apakah itu Harga Rizab?
J: Harga Rizab ialah harga terendah dimana sesuatu hartanah
itu boleh dijual. Pelelong akan memulakan proses bidaan
dengan harga tidak kurang dari Harga Rizab dalam situasi
jika terdapat lebih dari seorang pembida yang berdaftar untuk
hartanah yang sama. Jika hanya terdapat seorang sahaja
pembida berdaftar untuk satu hartanah, ianya akan dijual pada
Harga Rizab.
4. S: Apakah itu Nilai Pasaran Semasa (NPS)?
J: Nilai Pasaran Semasa juga dikenali sebagai Nilai Pasaran
Terbuka (NPT). Ia merupakan nilai aset yang disebut oleh
penilai berlesen dan lazimnya bergantung kepada keadah
perbandingan dengan harga transaksi terkini aset yang sama
dalam kawasan aset yang dilelong.

6. S: Apakah kelebihan membeli hartanah lelongan?


J: a) Ia merupakan satu pelaburan yang bijak kerana hartanah
lelongan dijual pada harga pasaran yang adil tanpa perlu
melalui proses tawar menawar yang berpanjangan.
b) Risiko projek perumahan terbengkalai dapat dielakkan.
c) Membeli hartanah lelongan melalui proses jual beli yang
pendek.
d) Dilelongan CIMB Property Mart terdapat pelbagai jenis
hartanah yang dilelong dalam satu tempat dan anda dapat
membuat perbandingan pelbagai hartanah lokasi yang
sama.
7. S: Jika saya tidak dapat hadir pada hari lelongan, apakah
yang boleh saya lakukan?
J: Jika anda tidak dapat hadir pada hari lelongan, anda boleh
membenarkan sesiapa yang berusia 18 tahun dan keatas
untuk membida bagi pihak anda. Walaubagaimanaupun,
wakil pembida mesti membawa bersama surat kebenaran
yang asli bersama dengan salinan fotostat kad pengenalan
anda dan Bank Draf ke lelongan tersebut.
8. S: Apakah yang akan terjadi jika Harga Bidaan Berjaya lebih
tinggi dari Harga Rizab?
J: Anda harus bersedia untuk menambah jumlah perbezaan
nilai deposit diantara Harga Bidaan Berjaya dan Harga Rizab
secara tunai sejurus selepas lelongan tamat. Sila pastikan
harga muktamad atau harga jualan adalah dalam lingkungan
bajet anda. Jika anda mempunyai bajet yang terhad, anda
boleh bertanya kepada pegawai pinjaman CIMB Bank
samada anda layak untuk mendapatkan pinjaman baki harga
jualan sebelum lelongan bermula.
9. S: Adakah saya perlu melantik peguam bagi menguruskan
pindahmilik aset?
J: Ya, anda perlu melantik peguam bagi pihak diri anda untuk
menguruskan pindah milik hartanah. Peguam yang hadir
pada hari lelongan hanya bertindak bagi pihak CIMB Bank
Berhad sahaja.
10. S: Apakah jangka masa untuk memenuhi Kontrak Jualan?
J: Jangka masa yang diberikan adalah sama ada 90 hari atau
120 hari dari tarikh lelongan, bergantung kepada Syaratsyarat Jualan. Jika anda ingin memohon pinjaman, anda
dinasihatkan untuk memohon pinjaman secepat mungkin dari
tarikh lelongan.
