BOX 1547 BEDFORDVIEW 2008 PERMIT IN TERMS OF SECTION 20 OF THE ENVIRONMENT CONSERVATION ACT, 1989 (acy 73 OF 1989) By virtue of the powers delegated to me by the Minister of Water Affairs and Forestry (hereinafter referred to as "the Minister"), 1, Stéfan van Biljon, in my capacity as Acting Manager: Scientific Services in the Department of Water Affairs and Forestry (hereinafter referred to as "the Department"), hereby, in terms of section 20(1) of the Environment Conservation Act, 1989 (Act 73 of 1989), authorise the abovementioned Permit Holder to develop and operate the abovementioned waste disposal site, subject to the conditions specified herein. PERMIT CONDITIONS In this Permit, "Director" means the Director: Water Quality Management of the Department who may be contacted at the address below: Director-General Department of Water Affairs and Forestry Private Bag x313 PRETORIA 0007 ATTENTION: DIRECTOR: WATER QUALITY MANAGEMENT LOCATION This Permit authorises the operation and further development of @ waste disposal site on Portion 285 of Portion 19 of the Farm Rietfontein 63 IR, Distict of Germiston (hereinafter referred to as “the Site"). PERMISSIBLE WASTE The Site may be used for the disposal of ail waste types listed in Annexure I but excluding those where specific control has been established in terms of the Nuclear Energy Act, 1982 (Act 92 of 1982). The disposal of waste types listed in Annexure IT are prohibited. For waste types listed in Annexure III, the specified handling or pretreatment procedures shall be adhered to before disposal may commence on the Site. The Permit Holder shall take all reasonable steps to ensure that no medical waste be disposed of on the Site, unless it has been incinerated at 800°C or higher for at least 1 second. CONSTRUCTION The Site or any portion thereof may only be used for the disposal of permissible waste if the Site or any such portion has been constructed or developed according to condition 3 of this Permit. The construction of further development within the Site, can only be undertaken by the Permit Holder after specified engineering plans have been provided to and approved by the Director. Further development within the Site shall be done under the supervision of a suitably qualified person proposed by the Permit Holder and approved by the Director. Should a portion of the Site be further developed, the Permit Holder shall notify the Director of such a development within the Site before disposal may commence on that portion within the Site. The completed construction works of the development within the Site shall be inspected by an official of the Department and the person referred to in condition 3.3. If the Director is satisfied with the construction of that further development within the Site and has given written permission, the Permit Holder may use that portion of the Site for the further disposal of waste. The Permit Holder shall take all reasonable steps, such as suitable zoning and/or written agreements with adjacent landowners, to prevent the development of further residential and/or light industrial areas closer to the Site than any 3.6 3.8 3.9 3 existing residential areas during the operative life of the Site. Heavy industries or industries which may create nuisance conditions may be permitted within the buffer zone in terms of the appropriate legislation Works shall be constructed and maintained on a continuous basis by the Permit Holder to divert and drain from the Site in a legal manner, ali runoff water arising on land adjacent to the Site, which could be expected as a result of the estimated maximum precipitation during a period of 24 hours with an average frequency of once in fifty years (hereinafter referred to as the “estimated maximum precipitation"). Such works shall, under the said rainfall event, maintain a freeboard of half a metre. Works shall be constructed and maintained on a continuous basis by the Permit Holder to divert and drain from the working face of the Site, all runoff water arising on the Site, which could be expected as a result of the estimated maximum precipitation and to prevent such runoff water from coming into contact with leachate from the Site. Such works shall, under the said rainfall event, maintain a freeboard of half a metre. Runoff water referred to in condition 3,7 shall comply with the quality requirements of the General Standard, prescribed in terms of section 21(1)(a) of the Water act, 1956 as published in Government Notice 991 of 18 May 1984, or with such quality requirements as may from time to time be determined by the Minister and shall be drained from the Site in a legal manner. Runoff water referred to in condition 3.7 which does not comply with the quality requirements applicable in terms of condition 3.8 and all leachate from the Site shall, by means of works which shall be constructed and maintained on a continuous basis by the Permit Holder be evaporated in dams and/or be evaporated by spraying over portions of the site. Works constructed in compliance with condition 3.9 shall be of a capacity to accommodate all runoff and leachate which could be expected as a result of the estimated maximum precipitation. such works shall, under the said rainfall event, maintain a freeboard of half a metre The Site shall be constructed in accordance with recognised civil engineering practice to ensure that it remains stable. The slope of the sides of the Site shall be constructed in such a manner that little or no erosion occurs, ‘The Permit Holder shall make provision for adequate sanitation facilities on the Site. we OPERATION Waste disposed of on the Site shall be compacted and covered on a daily basis with a minimum of 150 millimetres of soil or other material approved by the Director. The Permit Holder shall take all reasonable steps to ensure that the Site is operated in a manner that shall prevent the creation of nuisance conditions or health hazards. The Permit Holder shall make use of moveable fences to control wind~blown waste. he Permit Holder shall apply sufficient dust control measures to prevent wind-blown dust from causing nuisance conditions or health hazards. Waste disposed of on the Site may not be reclaimed. The Permit Holder shall take all reasonable steps to curtail ash blending and treatment with sodium hypochlorite. The Permit Holder shall ensure that the method of trenching will be carried cut as follows: The eppropriate equipment must be immediately available to dispose excavated material. Each trench must be covered with plastic. Trenching must be done during the hours of 08h00 and 16h00 in order to avoid known atmospheric inversion in the early morning and evening MONITORING A monitoring borehole network for the Site shall be established and maintained by the Permit Holder to the satisfaction of the Director so that unobstructed sampling, as required in terms of this Permit, can be undertaken, Monitoring boreholes shall be equipped with lockable caps. The Department reserves the right to take water samples at any time and to analyse these samples or have them analysed. Surface water monitoring shall be performed in all stormwater drains on and adjacent to the Site at locations selected in conjunction with the Director and at a frequency as determined by the Director. Treated leachate discharged into a water course shall be monitored and the standards, parameters and sample frequency of 5.8 5.8.1 5 monitoring shall be determined and from time to time be adjusted by the Manager: Scientific Services. Background monitoring Samples from the borehole where the ground water in the borehole is at an expected higher hydraulic pressure level than the hydraulic pressure level of the ground water under the Site, shall be considered as background monitoring. Background ground water monitoring shall be conducted during each monitoring occasion in terms of conditions 5.6, 5.7 or 5.8 for the water quality variables listed in annexure Iv. Detection monitoring Monitoring shall be conducted monthly for the water quality variables listed in Annexure Vv. Investigative monitoring If, in the opinion of the Director, a water quality variable listed under the detection monitoring programme, as referred to in condition 5.6, shows an increasing trend, the Permit Holder shall initiate a monthly investigative monitoring programme for the water quality variables listed in Annexure Iv. Post-closure monitoring Ground water monitoring by the Permit Holder, in accordance with condition 5.6 or 5.7, shall commence immediately upon closure of the Site and be maintained for a period of 30 years, or such lesser period as may be determined by the Director. Further monitoring The Permit Holder shall keep a record of and update all the information referred to in Annexure VI on an annual basis. METHODS OF ANALYSIS The Permit Holder shall carry out all tests in accordance with methods prescribed by and obtainable from the South African Bureau of Standards (SABS), referred to in the Standards Act, 1982 (Act 30 of 1982), to analyse the samples taken under the monitoring programmes specified in condition 5. The Permit Holder shall only use another method of analysis if written proof that the method is equivalent to the SABS method, is submitted to the Director. 10. 10.1 RECORDING The Permit Holder shall record all borehole data and chemical analyses in the format depicted in annexure VII. REPORTING The information required in terms of conditions 5.5 to 5.8 shall be submitted to the Director within a period of 30 days following the analysis of the said samples. The information required in terms of condition 5.9 shall be submitted to the Director within a period of one year from the date of issuing of this Permit and annually thereafter. The Permit Holder shall within 24 hours notify the Director of any incident at or incidental to the operation of the Site which causes or has caused water pollution, pollution of the environment, health risks or nuisance conditions. The Permit Holder shall within 14 days inform the Director in writing of measures taken to correct and prevent a recurrence of any incident referred to in condition 8.2. REHABILITATION AND CLOSURE OF THE SITE Should the Permit Holder want to close or indefinitely cease operations on the Site, he shall notify the Director by registered mail of such closure and submit final rehabilitetion plans for his approval, at least 60 days prior to the said closure or cessation of operations. Immediately following the cessation of operations with the intention to close the Site, the surface of the Site shall be covered in such a way that — the formation of pools due to rain is prevented; ater is ensured; and free surface runoff of rain- no objects or materials which may hamper the rehabilitation of the Site are present. The Permit Holder shall rehabilitate the Site in accordance with a rehabilitation plan which shall be submitted by the Permit Holder and which shall be to the satisfaction of the Director. LEASING AND ALIENATION OF THE SITE Should the Permit Holder want to alionate or lease the Site, he shall notify the Director in writing of such an intention at i. This Permit shall not be construed as exempting the Permit Holder £rom compliance with the provisions of the Health act, 1977 (Act 63 of 1977), the Water Act, 1956 (Act 54 of 1956), the Occupational Health and Safety Act, 1993 (Act 85 of 1993) or any other applicable act, ordinance, regulation or by-law. This Permit is valid until 31 December 1995. Any information which may be required and which shall be to the satisfaction of the Director, shall be submitted to the Department not later than three months prior to the abovementioned Gate. Whe Permit Holder and the Director shall agree on the content and extent of the information required in terms of condition 11.3 within 60 days of the issuing of this Permit. The Manager: Scientific Services retains the right to withdrew this Permit in writing at any time, The Permit Holder shall then be responsible to submit the required documentation mentioned in condition 11.3 within 60 days of the date of withdrawal of the Permit. TYPES 9 ANNEXURE 1 OF WASTE FOR WHICH DISPOSAL ON THE MARGOLIS CLASS H SITS ARE ROHIBITED Wastes which are difficult to analyse or for which data are not available. All materials which fall in Class 1 (explosives), Class 2 (compressed gases} and Class 7 (radioactive materials) of the IMDG classification, are prohibited. Wastes for which the pH of the waste or the pH of a 1:1 w/w extract with water are below pH4 or above pHi2. Waste with a free cyanide concentration greater than 0,4 mg 1. Waste with a free sulphide concentration of more than 10 mg 14. Waste with a flashpoint, as measured by the closed cup method, below 60°C. Waste which react with air or water within the pH range 4 to 12, to produce inflammable, explosive or toxic gases. Waste which contains highly reactive redox compounds.
