You will report to Mickey Misra and will work at our location at 1598 Clark Boulevard ia Brampton. 1. Term of Employment ‘Your employment will commence on May 5, 2015. As a casual employee, your work schedule is determined by project demands and will uctuate based on the volume of work availble. 2. Remuneration ‘Your hourly rate will be $15.00. You will be paid in accordance with exp's payroll practice which is currently ‘on a bi-weekly basis. 3. Vacation ‘You will receive 4% vacation pay om all earnings for each pay period. You will lso receive paid days off for starutory holidays, in accordance with the Employment Stondands Ac, Ontario. ‘During the petiod between Christmas and New Years, exp reserves the right to close the work facility. It will be the responsibilty of the employee to utilize vacation time, banked overtime or to be unpaid ducing this scheduled closure 4. Benefits Exp will provide you with those benefits to which you ate ented by law. ‘These include the Canada Pens Plan/Quebec Pension Plan (CPP/QD?), Employment Insurance (EI), Workplace Safety Insurance/Woske ‘Compensation (WSIB/WCB), aad Employer Health Tas (BHT). 5. Overtime ‘You are eligible for overtime pay under the ESA. For the purpose of calculating overtime pay, your base salary compensates you forall ime worked up to 37.5 hhours in a weeks In accordance with the ESA, overtime accumulates atthe regular pay rate forall hours ‘worked up to 44 per week. All hours in excess of 44 per weck will be compensated at 1.5 time's regular pay. Termination ‘This Agreement and your employment with exp may be terminated for the following reasons: 5) You may resign from employment at any time upon providing two wecks’ notice, which can be ‘waived in whole or in part by exp; b) —_expmay terminate your employment without cause during the term ofthis Agreement by providing you with the minimum notice of termination or pay i licw of notice required bythe ESA. This shall constitute your entire entitlement to notice of termination or pay in lieu of notice under any applicable statute, common law and contact; or exp may terminate your employment without notice or pay i lieu of notice For cause. 7. Business Protection Agreement “This offer is contingent upon your signing the enclosed Business Protection Agreement. 8. Miscellaneous All amounts payable to you referred to in this letce are subject to all egally required deductions. ‘This Agreement, together with the other agreements and plans referenced in this agreement (the “other ‘agreements and plans”), are the entre agreement between you and exp regarding your employment and replaces all previous written or oral communication, understandings and agreements between you and exp. ‘This Agreement and the other agreements and plant shall be governed by and construed in accordance with the laws of the Province of Ontatio and the federal laws of Canada as applicable herein. In the event that any term ofthis Agreement or the other agreements and plans are determined to be illegal ‘or unenforceable, the remainder ofthis Agreement and the other agreements and plans shall not be affected, ‘but cach remaining term shall continue to be valid, effective and enforceable. Any term determined to be illegal of uncaforceable shall be severed from this Agreement and/or the other agreements and plans to the ‘extent of such illegality or unenforceability without affecting the remaining terms of this Agreement and the ‘other agreements and plans. ‘This Agreement, together with the other agreements and plans, shall continue to apply notwithstanding your length of service or any changes to your terms and conditions of employment including job title, duis, responsibilities, compensation or benefits, except as agreed to by you and exp in waiting. “This offer, which sets out the terms and conditions of your employment and will constitute your Employment Agreement once signed by you, will remain open for acceptance for one week from the date of this letter.
