DECLARATION
OF COVENANTS, CONDITIONS AND RESTRICTIONS
THIS DECLARATION, made on the date hereinafter set forth by
U.S. HOME CORPORATION, a Delaware corporation, hereinafter
referred to as the "Declarant".

WHEREAS, the Declarant {is the sole owner of certain real property
in Seminole ‘county, Florida, which le more particularly describea ov
Bxnibit A attached hereto and incorporated herein by reference,
NOW THEREFORE, Declarant hereby declares that the real pro-
perty described on Schedule 1 shall be held, sold and conveyed
Subject to the following easements, restrictions, covenants” and
conditions, which are for the purpose of protecting the value aad
desirability of, and which shall run with, the real property asd
be binding on ail parties having any right, title or interest Te
the Bxhibit A property or any part thereof, their respective
heirs, personal representatives, successors and assigns, and
shall'inure to the benefit of each owner thereof.

DEFINITIONS
Section 1, *association® shall mean and refer to the NORTHLAKE
VILLAGE COMMUNITY ASSOCIATION, INC., "a Florida non-profit cone
poration, its successors and assigns.
Section 2, "Owner" shall mean and refer to the record owner,
whether ono or more persons or entities, of the fee simple title
to any Unit or Parcel which is a part of the Properties,
including contract sellers, but excluding those having such ~
interest morely as security for the performance of an obligation.
The term "Owner" shall include U.S. Home Corporation.
Section 3, "Properties" or association owned properties shall
mean and refer to that certain real property described on attacied
Schedule 1, and such additions thereto as may hereafter be browghe
within the jurisdiction of the Association.
Section 4, ‘Common Area* or Association owned Properties shall
mean all real property (Including the improvenepts thereon}: cuned. by
the Association for the common use and enjoynent of the owners. The
Common Area to be owned by the Association at the time of the cone
veyance of the first Unit shall be that described on Schedule 2
attached hereto and incorporated herein by reference.
Section 5. "nit" shall mean a condominium parcel, as
that term is defined in Chapter 718, Florida Statutes (1984),
herein called the "Condominium act", pursuant toa recorded
declaration of condominium affecting all or part of the
Properties, and for which a certificate of occupancy has been
issued.
Section 6. "Parcel" shall mean any part of the Properties
owned by the Declarant which has not been submitted to con-
dominium form of ownership and improved with completed Units.

Section 7. "Declarant" shall mean and refer SEMMQLE Gefhy

Section 8. “Mortgage” means any mortgage or other instrument
gncumbering “any interest ina Unit, or any portion therest, on
security for performance of an obligation,
Section 9- “Mortgages” méans any person naned as the obliges

interest to such person under such Mortgage.
Section 10, "First Mortgagse" means the holder of any

Section 11. "YA" mean the Veterans Administration.
Section 12. "Recorded" means filed for record in the Public
Records of Seminole County, Florida.
Section 13, “Board of Directors" means the Association's
Board of Directors
Section 14. "Person" means any natural person or artifical
legal entity.
Section 15. "Articles" means the Articles of Incorporation of
the Association, including any and all amendments or moditiccs
tions thereof, a copy of which is attached hereto as Benintcng
‘and incorporated herein by reference,
Section 16. "By-Laws" means the By-Laws of the Association,
including any and all modifications thereof, a copy of which as
attached hereto as Exhibit # and incorporated herein by reference,
Section 17. Interpretation. Unless the context otherwise

ARTICLE 11
PURPOSE
Section 1. Operation, Maintenance and Repair of Common Areas.
The Declarant, in order to inure that the Connon Aras and these’ por-
tions of the roadway which have been dedicated to condominium
ownership pursuant to the Condominium act, will continue to be main=
tpine in @ manner that will contribute to the comfort and enjoyment
of the Owners and provide for other matters of concern to thod hen

including the punps and equipment, and the sprinkler system servicing
the Properties; and (e) take such other action as the Association is
authorized to tako with regard to the Properties pursuant to its
Articles of Incorporation and By-Laws.
