Government of Gujarat, Industries and Mines Department, Sachivalaya, Gandhinagar Dated the 12/02/2015 No. GU/2015/(2)/GMR/102014/1829/CHH:- In exercise of the powers conferred by sub-section (1) of section 23 C of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Government of Gujarat, hereby makes the following rules further to amend the Gujarat Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules, 2005 namely:- 1. These rules may be called the Gujarat Mineral (Prevention of legal Mining, Transportation and Storage) (Amendment) Rules, 2015. In the Gujarat Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules, 2005 (hereinafter referred to as “the said rules”) in rule 18, for the words “may release the same on the execution by the owner there of a bond”, the words “may release the same on the execution by the owner there of a bond in form L” shall be substituted. The said Vehicle/ Instrument/ Machine/Machinery of ownership was scized by Government employee/officer Mr. . At. : Taluka... , District. on for illegal mining/transportation/ storage and has been surrendered at . in custody of Mr. .... My Vehicle Instrument/Machine/Machinery has been seized for . times for illegal mining/ transportation/ storage. Therefore, I, . provide a bond of Rs. . (As per the seizer order) under rule 18 of Gujarat Mineral (Prevention of Illegal Mining, Transportation and Storage) Rules and request to release my vehicle/instrument/machin machinery. 1. I shall not alienate any of ownership rights through gift or sale or will make any kind of change in ownership rights of the vehicie/instrument/machine/ machinery so released. 2. I shall not make any change in the colour or appearance or physical form of the vehicle/ instrument/machine/machinery so released. 3. I shall not use the vehicle/instrument/machine/ machinery so released for transportation outside the State of Gujarat. 4. I shall be bound to pay penalty decided by the competent authority of the Government for illegal mining/transportation/storage at the conclusion of the case proceedings and the amount of penalty so decided would be paid by me. 5. It shall be my responsibility to take necessary precautions for assuring that the vehicle/instrument/ machine/machinery so released or any other vehicle/ instrument/machine/ machinery of my ownership is not misused for illegal mining/transportation/storage and also complying strictly with Gujarat Mineral (Prevention of illegal Mining, Transportation andStorage) Rules, 2005 and Gujarat Minor Mineral Concession Rules, 2010. 6. After the vehicle/instrument/machine/machinery is released, it shall be my responsibility to be present along with the ~—_vehicle/instrument/machine/ machinery so released, before the competent authority within 48 hours of the notice received from the competent authority. 7. Lam aware that it is a criminal offence to make false affidavit and legal actions may be taken for doing so and for which I shall be responsible.
