Blank (“Affiant”), a police officer/investigator with the Arlington, Texas, Police Department, who after being duly sworn on oath deposes and says that AFFIANT HAS GOOD REASON TO BELIEVE AND DOES BELIEVE THAT: On or about November 27, 2015, in the City of Arlington, Tarrant County, Texas, Demetrius Rodriguez Davis a black male with a date of birth July 22, 1982 (“Suspect”) did then and there commit the offense of Capital Murder, a Felony, in that the suspect, did then and there intentionally cause the death of an individual, Jose Garcia, by discharging a firearm at Jose Garcia causing the projectile to strike him, and the said defendant was then and there in the course of committing or attempting to commit the offense of aggravated robbery. MY BELIEF AS AFORESAID IS BASED UPON THE FOLLOWING FACTS AND CIRCUMSTANCES: On or about November 27, 2015, at 908 Highland Drive in Arlington, Tarrant County, Texas, the victim ‘was shot by the suspect thus causing the victim's death during an aggravated robbery. Said offense was reported to the Arlington Police Department as Offense No.150063236.. ‘At approximately 21:25 hours, Officers S. Henry #2633, E. Rivera #2757, K. Miller #2695 and others were dispatched to an emergency shooting call located near the intersection of Highland Drive and Raines, Street. The call text provided that a person had been near this location and that his brother was also shot. ‘When Officers arrived, they were flagged down by a male standing in the intersection. This male told Officer Miller there was a male who had been shot lying in the grass of his front yard. Officer Miller spoke to the shooting victim who was identified as Adolfo Garcia H/M 04-29-98. Adolfo had been shot in the upper thigh. Adolfo was concerned for his brother, Jose Garcia, who had also been shot. Adolfo pointed to a house across the street from his current position and asked for officers fo check Jose's current condition. Adolfo didn't know the identity of who had shot he and his brother, but advised it took place near his brother's car which was parked near the small park around the corner. Adolfo was transported to the Medial Center of Arlington (MCA) for his injuries. Officer Rivera went to the house Adolfo had been pointing at and observed a Hispanic male who had an apparent gun shot wound lying in the doorway. Officers performed CPR on this male, later identified as Jose Garcia H/M 10-26-95, until paramedics arrived and took over emergecny medical care for Jose. Jose ‘was pronounced deceased soon thereafter due to his injuries. Officer Rivera spoke to the adult homeowner of this house on Raines Street who provided he was at home ‘watching television when he observed the decedant, Jose, run up to his doorway and began knocking loudly. Jose told the homeowner he and his brother had been shot and requested they help them. The homeowner noticed Jose was bleeding from his head and opened the door in an attempt fo help. Another adult who was also present inside this residence called 911 while others went outside to help both Jose ‘and Adolfo. No one inside this house knew Jose or Adolfo nor did they know why they had been shot. Officers began searching the area near the park located at 908 Highland Drive and located a green 2009. // Pontiac G6. Officers looked inside the vehicle and noticed a spent shell casing lying on the driver side // front seat. Officers also located an iPhone and a set of Pontiac car keys lying inthe street near this vehicle. Officers secured this area so as protect it for further crime scene purposes. \i\K Page 2 ARREST WARRANT AFFIDAVIT. Warrant # Oh 339 ‘At approximately 22:07 hours, I, Detective C. Blank #2043 herein refered to the Affiant, was notified of the offense by my supervisor, Sgt. K. Fryer #1456, Sgt. Fryer briefed Affiant on what was known thus far and requested Affiant respond to the scene, Detective S. Griesbach #1578 also responded. Upon arrival at the location, Affiant was informed that someone claiming to be the mother of the owner of the Pontiac vehicle had been at the location wanting to know information about the shooting. She had left the scene after hearing her son had been transported to MCA. Affiant was then told there was surveillance video from a nearby home which may have captured the incident. Affiant viewed this video and observed the suspect vehicle, a dark colored four door car similar to the make and model of the victim's car, park in the 900 block of Highland. ‘The victim's vehicle was seen parking facing the same direction as the suspect vehicle but on the opposite side of the street. It appeared that the occupants of the two vehicles then met in the victim's vehicle for several minutes before a strugale is seen inside. This struggle continues outside the vehicle between the driver and another male while the front passenger is seen running from the vehicle, A short while later, the suspect's vehicle was seen driving away from location while the other two subjects were seen running toward the direction Jose and Adolfo were discovered. The video was downloaded and preserved as evidence. Affiant viewed Jose's body and observed at least one gunshot wound. Detective Griesbach and Affiant both spoke to the homeowner and other adult witnesses who confirmed their earlier statement to Officers. On November 28, 2015 at 0:37 hours, Affiant drove to MCA and was informed Adolfo was currently in surgery. Adolfo would be sedated throughout the night due to his injuries. Affiant next met with the mother of both Jose and Adolfo, who identified herself as Ortencie Vargas H/F 02-15-77. Vargas didn't know who could have wanted to harm her two sons. Vargas confirmed the Pontiac vehicle located at the shooting scene belonged to her son, Jose, but that he hadn't registered it yet. Vargas provided that she currently has the vehicle on her insurance policy thus proving ownership. Vargas also provided Affiant with Jose's current phone number (which is in her name) and advised she would attempt to contact the phone number's service provider to obtain a list of recent phone calls/text messages. ‘At 03:00 hours, Affiant met with Crime Scene Investigator K. Boyd #2863 at 1108 Harrison Avenue in order fo process the Pontiac in a controlled environment. During this search, one spent shell casing, marijuana, and marijuana paraphenalia were located. At 12:55 hours, Affiant learned Adolfo was awake from his sedation. Adolfo didn't know the suspect, described as a black male, but that he and Jose were meeting the suspect at the park in order to smoke ‘marijuana together. Once the suspect entered Jose's vehicle, he pulled out a gun and demanded money. ‘Adolfo asked about Jose's welfare and learned about his passing. After he learned of his brother's passing hhe became emotional. Affiant elected to end the interview at this time, Later that evening, Affiant spoke with Adolfo over the phone. Adolfo provided a further suspect description for the suspect as: a black male in his late 20'5 or early 30, 6'0" tall, heavy build (at least 250 pounds) with short hair wearing all black or dark colored clothing. Adolfo also said the supect’s, vehicle was the same make and model as Jose's (i.e. Pontiac G6) and believed it to be brown or gold in color. On December 1, 2015, Vargas provided Affiant with alist of phone calls and text messages associated with her son's phone at the time surrounding the shooting, Affiant noted that at 21:18 and again at 21:19 hours a phone call was made to/from Jose's phone to phone number 817-714-1544. Affiant researched | this phone number in our computerized RMS database and located it associated with a recent Arlington s\y\6 Page 3 ARREST WARRANT AFFIDAVIT SS Warrant ¢_Olo- KK 394 Police Report, Affiant reviewed this police report and found the phone number associated with a Demetrius Davis B/M 07-22-82. Affiant ran a identity verification on Davis and found he is listed as 6'01" in height and 281 pounds in ‘weight according to his current TXDL.. Affiant further researched Davis through a computerized internet website, Accurint, and found he currently owns a 2007 Pontiac G6 vehicle. Affiant met again with Adolfo so as to obtain a full statement. Adolfo said he and Jose had been at some apartments earlier in the evening when they were approached by the suspect. ‘The suspect wanted to buy ‘or smoke some marijuana with Jose but not at those apartments. The two exchanged phone numbers and agreed to meet at the park (offense location). As Josc was driving to the park, he called the suspect to make sure he was there. This was the last phone call Adolfo observed Jose make before they met the suspect. Adolfo said as soon as they began smoking the marijuana, the suspect pulled a gun and demanded money and other items. When Jose refused to give the suspect the keys to the car, the suspect exited the car and opened the driver side door. Jose and the suspect then began fighting over the gun. Adolfo said he was shot as he was attempting to exit the car and run away. As he ran, he heard a second ‘gunshot and saw his brother lying on the ground. On December 2, 2015, Affiant created a six person photo lineup of Davis utilizing his most recent known ‘TXDL photo. This photo lineup was administered to Adolfo in a sequential double blind manner by Investigator D. Brown #1666. Adolfo viewed this lineup and identified Davis as the person who shot him and killed Jose. Investigation reveals the suspect (i.e. Davis) did intentionally cause the death of the victim (ie. Jose Garcia) by discharging a gun causing a projectile to strike Jose Garcia while in the course of committing or attempting to commit the offense of aggravated robbery. Davis is more fully described as a black male, 6101" in height, 280 pounds in weight, with black hair and brown eyes. Davis has been issued FBI #825074RB3, SID #07843894, and TXDL #28422318. WHEREFORE, I request that an arrest warrant be issued for the suspect hereinafter designated according to the laws of this State.
