ORDINANCE NO.

AN ORDINANCE REGULATING GARAGE SALES,

YARD SALES, PORCH SALES, ETC.

WHEREAS, there is a need for limiting the number of garage, yard, porch or tent sales an individual or
business in any area may have in one calendar year,and
WHEREAS, there is a need for the City of Stuttgart to pre-authorize any garage, yard, or tent sale;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STUTTGART, ARKANSAS:

SECTON 1:

For the purpose of these rules and regulation, it is of no significance whether

the sale is called garage sale, yard sale, tent sale or by other name. Any sale or attempted sale of

personal property which involves three (3) or more items of property for which any person does not
obtain a business, occupational or peddlers license or permit, shall be subject to the following rules.
SECTION 2:

It shall be unlawful for any person(s) or business within the City of Stuttgart to
engage in or carry on any sale of the nature described above or any similar type of sale unless that
person

obtains a permit

from the City Clerk,

or

her

agent.

Each permit shall cost ten dollars

10.00). The applicant shall sign a statement stating that the sale shall be of personal property owned
by the person( s) or business conducting the sale and that the property was not purchased for the
purpose of resale. The permit and the receipt are to be displayed in a visible location at the sale.

SECTION 3:

Each permit shall be issued for a maximum of three ( 3) consecutive calendar

days per sale.

SECTION 4:

Two( 2) permits may be issued in a calendar year per address.

SECTION 5:

Any person(s) or business conducting a sale described in this division shall be

responsible for providing adequate parking to avoid the creation of a hazardous traffic condition at or
near the sale location.
