Litigation, 05-md-01720 (MKB)(JO) (E.D.N.Y.)

Dear Judge Brodie:

We are counsel for the 7-Eleven Plaintiffs in MDL 1720, as well as various objectors in
MDL 2221, the American Express case pending before Judge Garaufis. We write with respect to
the February 6, 2015 letter from Willkie Farr & Gallagher requesting a conference at the Courts
earliest convenience. See ECF No. 6406.
Like the Target Plaintiffs, we were first alerted to this matter by Mr. Greiner on a
conference call on February 6th that was limited to various parties from the American Express
case. We understand that more information shall be provided tomorrow afternoon, which
hopefully will enable our clients to understand the scope of the issue, including the connection, if
any, between the issues underlying Mr. Greiners request for a conference and the American
Express matter. Absent such information, we will be unable to participate productively in a
court conference. As a result, we respectfully join in the Target Plaintiffs request that a court
conference be convened at some time sufficiently after Tuesday to allow us to participate
productively at such conference after consulting with our clients.
We appreciate the Courts consideration of our request.
Respectfully submitted,
/s
