ANALYST'S NOTE: House Bill 398 recodifies the existing Revised Uniform Athlete Agents Act
under Idaho law. The original act was passed in 2001. The new version contains several changes
to existing statute. The biggest change in the existing law is contained in the rewritten Idaho Code
54-4802, in that it no longer provides an exemption from regulation for r a "spouse, parent, sibling,
grandparent or guardian of the student-athlete or an individual acting solely on behalf of a
professional sports team or professional sports organization."
Point No. 1: Does it create, expand, or enlarge any agency, board, program, function, or activity
of government? Conversely, does it eliminate or curtail the size or scope of government?

The bill expands licensing requirements to include relatives of the student athlete. The measure
also contains a number of disclosures that a license applicant will have to supply in order to be
properly credentialed. Among the required disclosures, the applicant must inform the government
of any civil proceeding case in the last 15 years that he or she has been named as a defendant or
respondent. (-1)
