PublicationofVerdictandSentencingbymediapriortotheSentencingHearing.
Abstract: Review of the complaint showed that due to mistake by the office of
Spokeswoman of the Administration of Courts, media published Verdict and
SentencinginthematterofDefendantinamurdertrialpriortotheirrenderingin
court.Themistakeoriginatedinthefactthattherecord,whichwasviewedbythe
officeoftheSpokeswomanincludedgraphicsignatures(scannedsignatures)of
thejudges,andtherefore,theofficeoftheSpokeswomanmistakenlythoughtthatit
wasadecisionthatwasalreadyrenderedinopencourt.Inretrospectitturnedout
thattheprotocolrecordwasnotsignedwithanelectronicsignature,whichisthe
signaturethatcreatesavalidjudgmentrecordinNetHaMishpat. Itwasfurther
established,thatautomatictextisimplantedinthejudgmenttemplate,which
isusedbythejudgesinwritingjudgmentrecordsinmurdercases.Theautomatic
textincludesasentenceoflifeimprisonment,andthemaximalfineestablishedby
law.Thecomplaintagainstthejudicialpanelwasdenied.However,thecomplaint
againstthesystemwasfoundvalid.TheOmbudsmanoftheJudiciarydetermined
thatrulesandguidelinesshouldbeestablishedinordertopreventtherepeatofsuch
incidents, and the wording of the automatic text and its usage. Given the
requirement for a corrective measure, and pursuant to the Ombudsman of the
JudiciaryAct(2002),Article22(b),theDirectoroftheAdministrationofCourtswas
asked to update the Ombudsman regarding lessons learned, in order to prevent
repeat of a similar incident in the future, and actions that were undertaken to
implementthelessonsamongtherelevantpersonnel.
1.Priortothehearingbythejudicialpanelinthecaseofthedefendantinamurder
trial, and prior to the hearing of the arguments, relative to sentencing, media
publishedreports,whichdetailedtheverdictandsentencinginthecase. Counsel
fortheDefendantinformedtheCourt,offtherecord,thatreportsarecirculatedby
mediaregardingtheverdictandsentencing.TheCourtansweredthattheCourtis
notpartofit,andcannotbeheldresponsibleforit.
2.IntheirresponseoninstantComplaintthatjudgesstatedthattheydidnotknow,
whoforwardedtotheSpokeswomanoftheAdministrationofCourtstheVerdictand
Sentencingrecords,andaccordingly,theydidnotknowwhentheywereforwarded.
As far as they could tell, the office of the Spokeswoman, on its own initiative,
enteredNetHaMishpatsystemandforwardedtherecordstomedia,priortotheir
editingandsignature.TheSentencingrecordwaswrittenbythemonlyafterthey
heardtheargumentsonsentencing,andonlyafterthat,itwassigned.Astothe
Sentencingrecord,thejudgessaidthattheyuseautomatictextasapreliminary
templateforwritingsentencesinmurdertrials,wherelifesentenceismandatory.
Accordingly,theautomatictextlistslifesentence,andthemaximalfinepermitted
bylaw.However,thetemplateisintendedonlytofacilitatethewritingandbeused
asabaseandadraft,giventhatthemandatorysentence,prescribedbylaw,islife
imprisonment. In cases, where the Defendant argues for a shorter prison term,

basedonthe PenalCode (1977),Article300a,thetemplatebecomesmoot,andis

erased.Inthecaseinquestion,thejudgeslistenedverycarefullytothearguments
by the parties, left for chambers, wrote the Sentencing record, returned to the
courtroom,readtheSentencing,andthensignedit.
3.The(joined)responsebytheDirectorofAdministrationofCourtsandtheoffice
oftheSpokeswomanofAdministrationofCourtssaysthatsomeonefromtheoffice
of the Spokeswoman checked in NetHaMishpat to see if a judgment had been
rendered. Atthattimetheysawontherecordintheelectroniccourtfileinthe
Protocols folder, with the judges' signatures on it. Following such check, and
abouthalfanhourafterthescheduledhearingtime,theofficeoftheSpokeswoman
distributed the record to media. Soon afterward it became apparent that the
judgment had not been read yet, and the office of the Spokeswoman contacted
mediaandinformedthemthattherecordmustnotbepublished.Itwasfurther
explainedthatthesourceoftheproblemisthefactthattherecord,whichwasseen
by the office of the Spokeswoman included graphic (scanned) signatures of the
judges,andtherefore,theofficeoftheSpokeswomanmistakenlythoughtthatthe
recordhadalreadybeenreadtotheparties. Inretrospectitturnedoutthatthe
record had not been signed by an electronic signatures, which is the signature,
which creates a valid judgment in NetHaMishpat (the protocol was eventually
signed a short time after the end of the hearing). In the same manner, the
judgment record was included in the Protocols folder, and the office of the
Spokeswoman mistakenly thought that it was the final judgment. In retrospect,
what happened was that the panel was asked to review the question of
compensationtothevictim'sfamily,andthereforehearingwasconductedinthe
courtroom, and then the panel went to chambers and wrote the full Sentencing
record,whichwastheone,whichwaspublishedbytheendoftheday. Thisisa
rareandunusualfailure,andtheAdministrationofCourtsinformedusthatwould
acttolearnthelessonstomakesurethatjudgmentsofthecourtsarenotpublished
bytheofficeoftheSpokeswomanpriortotheirsignaturebythejudges.
4.Theconclusionisthatnoneofthejudgesofthepanelforwardedthejudgmentto
media prior to the sentencing hearing, as claimed in the complaint. The
AdministrationofCourtsandtheofficeoftheSpokeswomanstatedintheirresponse
thattheforwardingofthejudgmenttomediawastheresultofmistakebysomeone
intheofficeoftheSpokeswoman,whothoughtthat,giventhatgraphicsignatures
appeared on the record, it had already been read to the parties. However, the
signatures, which were seen by someone from the Spokeswoman's office were
graphicsignatures(prescanned),tobedistinguishedfromtheelectronicsignature,
whichisthesignaturesthatgeneratesthefinaljudgmentrecordinNetHaMishpat.
5.Thisisnotthefirstevercaseofpublicationofjudgmentpriortoitsreading(see
introductiontoJudgmentincriminalcaseStateofIsraelvRuthLeitner(published
in Nevo), where the judge expressed his regret that due to a problem the
Judgmenthadbeenpublishedpriortoitsreadingincourt.).

Regarding the computer issues, related to graphic signatures and electronic

signatures and the distinction between the two, we have learned from another
complaint,whichwasreviewedanddecidedbymypredecessorin2012(88/12).
Fromreviewofthatcomplaintwelearnthatanattempttoprintouttheprotocol
through the Protocol Application (in contrast to printing it out from the
Protocols folder) would fail in case the protocol had not been signed by an
electronicsignature,andanderrormessagewouldappear,thattheprotocolhadnot
beenelectronicallysigned(seeparagraphs21,389oftheDecision).
Eitherway,theendresultinthecasebeforeusisthatsomeoneintheofficeofthe
Spokeswoman,whoproducedthejudgment,andmistakenlythoughtthatitwasa
finaldocument, anddidnotknoworcouldnotdistinguishthatithadnotbeen
electronicallysigned,and/orhadnotbeenuploadedtothePublicFolder,which
wasindicatedintheresponsebytheDirectoroftheAdministrationofCourtsand
theofficeoftheSpokeswoman,aswasdoneafterthehearinginthecourtroom.
Addressingthepreventionoftherepeatofsuchcasesisthereforeagaindirectedto
theAdministrationofCourts.
6.Needlesstoaddregardingtheimportanceofappearanceofjustice. Retroactive
explanations, goodasthey may be, cannot repair the impression, createdin the
mind of the Defendant, counsel, and the public at large, when verdicts and
sentencingarepublishedbymediapriortotheirreadingincourt,nottomention,
priortothehearingofargumentsregardingsentencing.Theresultingimpressionis
that there is no use to arguments, since the sentence had been predetermined,
regardlessofanyclaimsbytheparties.
7.Evenifforefficiencyreasonsuseismadeofautomatictext,itshouldbedone
wisely and carefully, lest impression is created that judicial decisions are pre
determined by a set formula. Especially so, when the matter is a substantial
punishment, which according to the judges themselves, may vary according to
argumentsbytheparties,accordingtoprovisionsofthelaw. Itshouldbeadded
that the distinction between scanned graphic signatures and electronic
signatures,asdescribedintheresponsebytheAdministrationofCourtsandthe
officeoftheSpokeswomanisnoteasytocomprehendsurelynotbythepublicat
large; from the case at hand, it appears that the distinction is not adequately
understoodbytheofficeoftheSpokeswomanand/orapersononherbehalf.The
problematicuseofautomatictexthasbeenpreviouslyaddressed(inadifferent
context),whenwenotedthattheinscriptionBehindClosedDoors,whichappears
automaticallyonprotocols,oftenwhenthehearingisconductedinopencourt.(See,
OmbudsmanoftheJudiciaryAnnualReport(2014)pp567).
8. Thecomplaintregardingthepublicationofverdictandsentencingpriortothe
hearingofargumentsonthesentencingisjustified.However,theresponsibilityfor
the early publication was not the judges'. The Judges did not authorize the
publicationoftheverdictandsentencing,andtheycompletedtheirworkonlyafter
hearingtheargumentsonthesentencingandelectronicsignatureoftherecord.The

complaintagainstthejudgesisdenied.
Thecomplaintisfoundvalidatthesystemlevel.Thesystemfailedrelativetothe
handling of the publication of the verdict and sentencing. There is a need to
establishrulesandguidelinesinordertopreventtherepeatofsuchincidentsinthe
future.Attentionshouldbegivenalsotothephrasingoftheautomatictextsand
theirusage.
Giventherequirementforcorrectivemeasures,andpursuanttotheOmbudsmanof
theJudiciaryAct(2002),Artile22(b),theDirectoroftheAdministrationofCourtsis
asked to update the Ombudsman regarding lessons learned, in order to prevent
repeat of a similar incident in the future, and actions that were undertaken to
implementthelessonsamongtherelevantpersonnel.
