Yours faithfully, ‘Signature of Applicant TERMS AND CONDITIONS: 1 ‘The name of the project shall be “Signature Towers & Mall” which is being built/constructed on Survey No. 95, Deh Jamshoro Opp. Rajputana Hospital, Jamshoro Road, Qasimabad, Hyderabad by IM. Itiam Associates referred to as company for the purpose of their terms & conditions. ‘The Units to be offered to the buyers in the project shall be on ownership basis and allotment shall be strictly on “first come first served’ basis on prescribed terms and conditions. Monthly Installments shall be payable by the 10th of each month in cash or through Cheque/Demand/Draft/Pay Order. In case of default a surcharge @ 10% per month shall be payable by the Allottee. Prompt payment of installment on the due dates as per payment schedule is the essence of this contract. ‘The Allotment shall be liable to cancellation in case monthly installments are not paid for three consecutive months. A final Notice will be issued to make payments within the prescribed period, in case of failure, allocation/allotment will stand CANCELLED. The amount deposited by the applicant shall be refunded 12 months after the completion of the project or afier re-sale of the subject Unit to other prospective buyer. An amount equivalent to 10% of the total cost of Unit wiill be deducted from the refundable amount. ‘SUB-LEASE of the booked Unit shall be executed by the Company in favour of the allottces at the time of mortgaging, ‘the unit with any Loan giving agency for the purpose of obtaining loan, In case the Allottee decides to SURRENDER the booking of the Unit for whatsoever reasons, and informs the company in writing before cancellation, 10% deduction will be made and the remaining amount shall be refunded only after re- booking of the surrendered Unit or 12 months after the completion of the project. The Allotee shall sel, transfer/or assign the unit prior to taking over possession ofthe same, subject to written consent of the promoter/builder. Allowing such sale/transfer after recovering all the outstanding dues form the allottte, the company shall charge Rs, 50,000/- towards TRANSFER FEE of Commercial Unit Rs. 30,000 towards residential Unit ‘The Applicant will pay transfer expenses, documentation charges, water, electric and all other ancillary and miscellaneous expenses to the Company as determined by them for fulfillment of the formalities of various departments/agencies as and when asked by the Company within the prescribed period. ‘The Company reserves the right to make changes in building plan of the project. |. Company shall, however, not be responsible for non-delivery of any letter of Notice (5) etc., due to any reason whatsoever or change of the Allottee’s address, For all contacts and correspondence, company will use the Allottees last given address as per record. Any change in address of Allottee shall be notified to the Company in writing. ‘The use of exterior walls, front, roof and common areas is reserved by the Company for any Commercial or other use at the discretion of the Company. . The availibility of all the Electric, Gas, Water & Sewerage and other conservancy connection depend upon the Government Departments, In case of delay, a temporary arrangement will be made on the expenses of Allottces and will be charged in advance. ‘That in case of delay by HESCO in providing permanent Electricity connection/meter in the Units booked by the Allottee, Company shall in the interim period provide Electricity to the Allotted Unit through standby generators at the Commercial rates for which sub-meters will be installed at the Allotttees cost. . The Allottee shall not bring inside the Unit (ofthe project) any goods or machineries which are hazardous and combustible ‘and shall not use the Unit other than the purpose for which it was constructed and alloted. The Applicant shall not carry additions or alterations involving structure ofthe building within the Unit alloted to him/her (The structure includes columns, labs and beams) nor shall change the present elevation ofthe building or any part thereof under any circumstances. This restriction will continue even after the possession of unit is taken by the applicant. The same could be done with approval of Association/competent authority. The Allottee must take over POSSESSION of the booked Units ofthe project within Fifteen (15) days of the issuance of completion fete from the company. The Company shall not be responsible for the maintenance, theft or damages to the property after the expiry of completion letter.
