2andCalculationCeilingunderSection12ofthePaymentofBonusAct,2015
ThePaymentofBonus(Amendment)Bill,2015waspassedbytheParliamentinthejustconcludedWinterSessionofthe
Parliament.ThePaymentofBonus(Amendment)Act,2015hasbeenpublishedintheGazetteofIndia,Extraordinaryon1st
January,2016asActNo.6of2016.TheprovisionsofthePaymentofBonus(Amendment)Act,2015shallbedeemedto
havecomeintoforceonthe1stdayofApril,2014.
The Payment of Bonus (Amendment) Act, 2015 envisages enhancement of eligibility limit under section 2(13) from
Rs.10,000/permonthtoRs.21,000/permonthandCalculationCeilingundersection12fromRs.3500toRs.7000orthe
minimumwageforthescheduledemployment,asfixedbytheappropriateGovernment,whicheverishigher.ThePayment
of Bonus (Amendment) Act, 2015 also mandates previous publication of draft subordinate legislations, framed under the
enabling provisions under the said Act, in the Official Gazette for inviting objections and suggestions before their final
notification.
The Government has been receiving representations from trade unions for removal of all ceilings under the Payment of
BonusAct,1965.ItisalsooneofthedemandsmadebythemduringthecountrywideGeneralStrikeheldinFebruary,2013
andSeptember,2015.Asthelastrevisioninthesetwoceilingsweremadeintheyear2007andwasmadeeffectivefromthe
1stApril,2006,itwasdecidedbytheGovernmenttomakeappropriateamendmentstothePaymentofBonusAct,1965.
ThesechangesinthePaymentofBonusAct,1965willbenefitthousandsofworkforce.
