AFFIDAVIT OF DESISTANCE
I, JOEL A. SICAD, Filipino, of legal age married, and a resident of P-8,
Brgy. PangPang, Sorsogon City, after having been duly sworn to in accordance
with law, hereby depose and say:
1. That my wife, ELMA J. SICAD, is one of the victims in a vehicular
accident that transpired along Maharlika H-Way, Brgy. Pangpang, Sorsogon City;
2. That she is presently confined in the Sorsogon Doctors MMG Hospital
due to the injuries that she have sustained as a result of the accident;
3. That on February 20, 2016, upon agreement with the driver and the
representative of the Legazpi Premium Development Corporation (LPDC), the
owner of the transit mixer, one of the vehicles involved in the accident, a
settlement has been reached;
4. It was agreed upon that the LPDC will shoulder the necessary
hospitalization and medical expenses that will be incurred by my wife as a result
of the accident;
5. That as a representative and on behalf of my wife, We are not anymore
interested in pursuing any civil, criminal or administrative case against the driver
and LPDC since we already settle our differences amicably;
5. That my wife and I hereby voluntarily waive any right to file a civil,
criminal or administrative case against the driver of the transit mixer and LPDC
in connection with the abovementioned incident;
6. That I am executing this affidavit of desistance of my own free will, free
from any threat, compulsion or inducement;
7. That I have caused the preparation of this affidavit of desistance whose
contents have been read and explained to me in the Sorsogon dialect which I fully
understood as true and correct of my own personal knowledge.
IN WITNESS WHEREOF, I have hereunto affixed my signature this
February 20, 2016 in Legazpi City for Sorsogon City, Philippines.
