Jerry Grabina petitioned the Supreme Court for a writ of certiorari to review his sentencing by the United States Court of Appeals for the Second Circuit. The Solicitor General conceded error in Grabina's sentencing. Based on this concession and its own review of the record, the Supreme Court granted Grabina's petition, vacated his sentence, and remanded the case to the district court for resentencing. Justices Frankfurter and White took no part in the consideration or decision of the case.
