Rang Dong Terminal Regulations Page § of 44 ‘These Rang Dong Terminal Regulations (the “Reguletions”) apply to Cfftake Tanker Owners of Otfiake Tankers calling a Rang Dong Terminal (the "Terminal and are the conditions of use of the Terminal, The Terminal, jocated at the position Lat. 10°01"12.62" N and Long. 108°608.29" & in Block 16-2 offshore Viena, is operated by Japan Vieinan Petrclaun Co., Lid. ('JVPC"), a ‘company incorperated in Japan (‘Company’). The Company has coniracted for the provision and charter of the Floating Storage and Offaading System (F&O) named "RANG DONG MV?" from RANG DONG MV 17 BN, (MODEC"); Company and MODEC, their subcontractors, agents and servants being herein referred to jointly as the “COMPANIES” Offtake Tanker Owners agres to comply strictly with the provisions of the Regulations and all the safely msasures the Companies consider appropriate ta take under any given circumstances At the time of the Terminal representatives boarding Ofttake Tanker the Oftake Tanker Master thereof shall sign THE CONDITIONS OF USE OF THE RANG DONG TERMINAL in the form of Appendix A hersto, evidencing in particular thal they have knowledge of theee Regulations and thet they accept the terms hereot. However, should this formality not occur for any reeson whatsoever. the provisions of the Regulations shell in eny case remain full applicable. He shall ao indemnify the COMPANIES fiom the effects of any proceedings to be ‘aken against them as a result of any ditect or indirect damage caused by the Offiake Tanker to third parties. A-16' sub-sea gas pipeline connects the GPC with Bach Ho Field, which is a neighbour oil field situated approx. 30 nautical miles southwest of FSO “Rang Dong MVI7" Refer to the Appendix C "Rang Dong Marine Exclusion Zons" for more details about sub-sea pipelines. Rang Dong Terminal Regulations SECTION 2 - TIDES, CURRENTS, WIND AND WEATHER AND SEAS at 22 23 24 Currents The surface currents of the South Ching Sea are influanced mainly by the monsoon winds which control the flow of water into or from the Sulu Sea, Java Sea and trough Talwan Straight. The main current flows on the West side of the region and sets Souttwest during the Northeast monsoon (November to March} and Northeast on ihe Southwest monsoon (May to August). During the regime of either monsoon the appropriate current hae a high constancy but some variations, and even occasionally reversals may occur with regularities in the monsoon, The main currenttrends with the monsoonal wind direction. at up to 3 knots on the surface Winds ‘The direction of prevailing winds is determined by monsconal acivity Between May and ‘September, the south-west monsoon period, south-westedy winds are predominart. Wind direction is variable in October and then during the north-east monscon tram October to January, the winds are trom the north to east ‘The winter months are subject fo prevalent strong winde commencing in October. This petiod is also subject fo monsoonal surges which may be associated with winds up to 50 knots. This is aly to affect moozing and offtake operations, In February and March the cominant wind direction is south-east and in April, winds are again variable with the tranition from the winter to summer menecons. Typhoons, which can create wind speeds over 100 knots, are likely to be encountered in the latter months of the year, Waves Sea and swell conditions are directly related to the monsoons and since the Northeast monsoon (Noverrber to March) winds are stronger than those of ihe Southwest monsoon (ly to August), the maximum sea and swell condone therefore occur during the winter mentis. During the height of the Northeast monsoon (Decamber/February}, seas ara predominantly moderate with the occasional rough saa. These different water masses are raneported by the monsoonal currents to and fro Such thet many regions are allemately filed with waters of diferent origin resulting in large seasonal variations of sanity. Rang Dong Terminal Regulations SECTION 3 - SUMMARY OF THE MOST ESSENTIAL REQUIREMENTS TO EE MET BY OFFTAKE TANKERS LIFTING OIL AT RANG DONG TERMINAL 34 32 34 34 36 Offtake Tanker Size: ‘The Terminal only accepis Offtake Tanker between 20,000 and 180,000 DWT class. The Offtake Tanker shall be required to moor in tandem at the FSO “Rang Dong MV17" with the dow of Cfftake Tanker being made fast to the stem of FSO ‘Rang Dong MV17". Compliance with Vietnamese laws The Terminal has been classitied by the Government as an oifshore crude oil exoort terminal resiéing within the Rang Deng Marino Exclusion Zone, over which Vurg Tau Mariime Administration hes jurisdiction. Offtake Tankers visting the Terminal shall comply with the provisions of the Vienamess maritime lews, a8 they apply to the Terminal in this context, and other applicable Vietnamese iaws and regulations. Where there is no specific feguiation in Vietnamese iaw, Ofitake Tanker shall follow good internaticnal practiogs, Offtzke Tanker shall enter the MEZ only at the request or permission of the Terminal. Offleke Tanker Ownars shall comply with all dingetions by the Govemment having jurisdiction over ihe Terminal, the Regulations or any controversies arising from acis dene upon or relating to the sea or continental sheft_ Procedures specified by the Government whether relating to health, customs and immigration or othenwisa shall be strictly adhered to. Compliance with the intemnaticnal laws, codes Offtake Tanker shall comply with latest SOLAS and MARPOL conventions and protocols, and other relevant conventions of the IMO. They shall be in possession of valid cettificates a6 required by ebove conventions. including a Safety Management Certificate and Document. of Compliance as specified in the International Safety Management (ISM) Code. Operations at the Terminal are to be conducted by Offiake Tanker calling at the Terninal in accordance with tha recommendations of the current issue of the "Intemational Safety Guide for Cit Tankers and Terminals’ (ISGOTT). Compliance with the provisions of this Terminal Regulations Offteke Tanker Owners agree to comply stictly with the provisions of the Regulations and all the safely measures the COMPANIES consider appropriate to take under any given cirewnstances, At the time of Terminal Offtake Team boarding the Offteke Tarker and before: the Notice of Readiness is accepted by the JVC Representative, tho Oftako Tanker Master thereof shall sign THE CONDITIONS OF USE OF THE RANG DONG TERMINAL in the form of Appendix ‘A hereto, evidencing in particular that fig has knowledge of these Regulations and thal he accepts the terms hereof However, should this formality not occur for any feason whatsoever, the provisions of the Regulations shail in any case remain fully applicable. Offteke Tanker Vetting Before being accepted to lft erude oll from the Tampinal, Offtake Tankers shall pass VPC. ship vetting procedure which inctudes technical review cf the completed Offiake Vessel ‘Questiomaire and submited Forezasve Deck planis). The vessels forecastle dack plan(s) shalf conform in terms of details and clarity to OC\MF ‘Mooring Equioment Guidelines* example diagrams. The Offlake Vessel Cuestionnaire and the forecastle deck plans) shall be completed and duly signed by the Offtake Tanker Owners After having boarded the Offiake Tanker, JVPC Representative and Mooring Master shalt conduct a final inspection to confrm the vessel's acceptability. This final acceptance is a eondition, which shall be satisfied before the Offtaice Tanker may approach, berth ang lit crude oil from the Termine! Beocument n Japan Vietnam Petroleum Co, Ltd. Rang Dong Terminal Regulations Page 18 0f 44 38 38 38 3.40 ant |f the particulars given in the Offtake Vessel Questionnaire change in any respect or otherwise become inaccurate, the Offtake Tanker Owners shall promptly notify the Terminal in writing. Without prejudice to any other consaquence of such inaccuracy or change, fallute to so natfy may cause delay or rejection at the Terminal, and all and any cost incurred shall be to the account of Offtake Tanker Owners, Notwithstanding the other parts of this clause 3.8, COMPANIES reserves the right to refuse to aoept ary OfRtako Tanker with deficiencies that in their opinion consitule a safely or poliution risk or any other findings’ that would jeopardize the safely and afficenoy of the ‘offiake operation. COMPANIES shall rot fiable for any damages, direct, indirect or consequential due to the refusal to aesept for berthing the nominated Cftake Tanker dus to non-compliance with the Regulations. Tandem Mooring Offteke Tanker shall be fitted with the appropriate equipment in accordance with the Istest OGIMF "Recommendations fer Equipment Employed in the Mooring of Ships at Single Point Moorings” and “Mooring Equipment Guidelines’ The equipment shall include 2 200 MT ‘SWI. chain siopper designed for use with 76-mm chafe chain regarciess of OCINF category. Offteke Tanker's Equipment Offtake Tankers shall be equioped with equipment and systems as described in detall in the Section 7 “Offtake Tankers Equipment’ Oi Pollution Insurance Offteke Tanker Owners (inciuding Bare Boat Charterer) shalt have in place maxirum P&l Club Insurance fer oif pollution liability (at least US$ 1 bilion) Omteke Tanker Owners shall at all times remain responsible for any liability for pollution or contamination or the direct or indirect consequences of same (including, without limitation, deati, injury or liness or any person, loss or darttage to property, statutory and civil liability for penatles anc/or damages, lebility to all person having a clam against the Terminal, COMPANIES andlor the Offtake Tanker Owners) where such pollution or centemination occurs as a result of the escape, for whatever reason, of crude oll ot any other pollutant fom the Offtake Tanker. Offtake Tanker Cvners shall at all times indemnify and hold COMPANIES harmless agsinst all actions, suits, proceedings, claims, demands, damages, liabilities, losses, casts or expenses of whatsoever ature arising in connection with any pellution or contamination ‘occurting as a result af the escape of crude ail or other pollutants from the Offtake Tanker, Ballest System Configuration Offteke Tanker shall be fited with segregated ballast tanks (SBT) meeting the requirements of the MARPOL 73/78 Convention. The Terminal has ne faciliy for the dieposal of Offtake Tanker's dirty ballast. The Offtake Support Vessel will be directed ty the Mooring Master. Pollution Controj ‘The Offtake Tanker shall comply fully with all relevant provisions ofthe MARPOL anc with ail applicable Vieinamesé environmental laws. Any infringement of the International Regulations or Vietnamese faws regarding pollution of sea by oll may by dealt with most severely. Pollution of the sea by vil, dirly ballast water, bige discharge of any other, means may result in heavy fines beng imposed, anc, in severe cases, may resuk in imprisonment of the Oiftake Tenker Master and the arrest of the vessel concerned. Offtake Tanker must arrive with clean balast only. 4 is the Oftake Tanker Master responsbility to tee that no oil of any kind fs pumped, spilled or leaked overboard ftam the Offtake Tanker. Emorgancy Rosponses ‘The Companies have in place an emergency response plan, which is coordinated with VPC 's office in Vung Tau. Through this plan, shore based emergency support can be initiated and controlled. Nonetheless, the Offiake Tanker Master remains ultimately responsible for the Offteke Tanker, its crow and passengers at all times. Han emergency situation arises on the Terminal, the Mooring Master shall inform the Oftake ‘Tanker Master of the situstion and acvise of actions the Offtake Tenker Master should take. Hf any emergency situation arises on the Offiake Tarker, the Offake Tanker Masiér shall immediately inform the Mooring Master or hig delegate of the situation and the actions baing taken, who shall advise the Terminal. Where feasible the Mooring Master shall coordinate these and ensuing emergency response procedures with the masters of the various vessels concerned, who retzin legal ultimate fesponsbilty for the safety of their vessels, crew and other persons onboard.
