Mardemootoo for the applicants and after taking cognizance of the praecipe and affidavit, both dated 20 May 2016 and the documents filed in support thereof, and being satisfied that the matter is so urgent as to require the immediate intervention of a Judge before notice of the application is served on the respondents and co-respondents; LET an interim order in the nature of an injunction be issued (a) restraining and prohibiting the respondents directly or indirectly from pledging, assigning, selling, and/or disposing of their assets and their rights in the brands ~ Hugo Boss, Jennyfer, Tommy ifiger, Btam, Mango, Celio, Esprit, Ralph Lauren, Armani, Armani Jeans, Zegna, Gant and Zara ~ without the prior w itten authorization of the applicants and (b} staying all iransactions, including sales, transfers and assignments of rights and interest in aforesaid brand names which would have already been effected between the respondents and co: respondents Nos. 2, 3, 4 and 5 and/or other unknown parties.‘The above interim order to remain in force until the determination of the present matter and I order that service be effected upon the above-named respondents and co-respondents to show cause, if' any, why the present interim order should not be made interlocutory. ‘The above interim order in the nature of an injunction is issued at applicants’ own risks and perils, and upon their undertaking, through their attorney to abide by any order which the Court or Judge may thereafter make as to damages to the respondents and co- respondents by the granting of this interim order in the nature of an injunction. ‘The stand of the respondents and co-respondents to be communicated through the e-filing system on or by Friday the 10% day of June 2016, date on which the present matter is made returnable.
