IN THE SECOND DISTRICT COURT - FARMINGTON DEPARTMENT IN AND FOR DAVIS COUNTY, STATE OF UTAH AFFIDAVIT FOR SEARCH WARRANT STATE OF UTAH ) “88 County of Davis ) The undersigned affiant, Officer Jeremy M Brown of Centerville Police, upon an oath or written affidavit subscribed under criminal penalty, declares: That your affiant has reason to believe: THAT On the vehicle(s) described as: a silver Chevrolet Suburban, Wyoming veterans license plate AR83G, In the City of Centerville, Utah, County of Davis, State of Utah, there is now certain property or evidence described as’ duct tape, zip ties, firearms, ammunition, methamphetamine, and paraphernalia which could be used to carry, contain, or consume methamphetamine and that said property or evidence: Was unlawfully acquired or is unlawfully possessed; has been used or is possessed for the purpose of being used to commit or conceal the commission of an offense; or is evidence of illegal conduct. Affiant believes the property and evidence described above is evidence of the crime or crimes of Aggravated Assault, Kidnapping, and Possession of Methamphetamine. ‘The facts to establish the grounds for issuance of a Search Warrant are: Your affiant is currently assigned to the Centerville Police Investigations Division. He is a certified police officer. He has worked in this department since July 2011 - Page 1 of Affidavit for Search Warrant No. 1447614 - Prior to this, he worked for West Bountiful Police Department as a patrol officer from July 2008, through July 2011. Your affiant is a certified drug recognition expert instructor. He is certified in advanced roadside impaired driving enforcement as well. He is currently a standardized field sobriety test instructor at the Utah Law Enforcement Academy at Salt Lake Community College. Your affiant is certified as a phlebotomist, having completed a course in phiebotomy at Davis Applied Technology College. Your affiant has made over 80 drug and alcohol-related driving arrests. Your affiant has attended a mobile crime scene academy and been trained in the collection and handling of evidence, including buccal swabs, blood evidence, and DNA evidence. Your affiant has been a Drug Recognition Expert Instructor certified with the International Association of Chiefs of Police since August 1, 2014. Your affiant has been assigned to the Investigations Division of Centerville Police Department since 2015. ‘On May 10, 2016, around 1800 hours, Centerville Police responded to 190 North 700 East in Centerville, Utah on an assault call. Your affiant was called to assistin searching the house for evidence of what had happened. When | arrived, Officer Jason Read told me the following account. There five victims in front of 180 N 700 E when he arrived. The victims were five females. One mother, Hiedi Harkins, and four daughters. Hiedi had an injury to her head which required treatment at the hospital. All five female victims gave consistent stories about what had taken place inside 190 N 700 E. They said they were invited over for a barbecue by one suspect, Dereck Harrison. When they arrived, they said Dereck's father, Flint Harrison, was also on scene. Both Dereck and Flint told the five females to go to the downstairs area of the residence. When they were down there, Dereck pulled out a handgun and began ordering them all to the ground. They were tied up with zip ties, duct tape was placed over their mouths, and the mother had a bag placed over her head. Flint began swinging a baseball bat around and told the mother that Flint had paperwork showing that the mother was a snitch and that this was retribution. At some point during the altercation, the mother received a head injury as mentioned above. One of the daughters also received an injury when she was hit in the head with the baseball bat. One of the daughters was also transported to Lakeview Hospital with the mother. The females escaped one by one, at which point the males panicked and fled in a silver Chevrolet Tahoe. = Page 2 of Affidavit for Search Warrant No. 1447614 - | received witness statements from Officer Jason Read that were filled out by the four daughters and are summarized as follows. age 13, indicated that when they walked into the house, everything was going fine until “he” [unknown who] told them to go downstairs. DJ, probably referring to Dereck James Harrison, had a gun. His dad had a bat. "He" [unknown who] threatened them when they went to call the police. He put a gun to her head and said if you don't get inside | will kill you. said that at this time she ran outside and the police came. , age 15, indicated that they came to the house for a get together. "They" told the girls to go downstairs and lay on the ground. "He" had duct tape on the center and a gun and a bat and "he" told them to get on the ground and "he" tied them up and put duct tape on their mouths and put abag overs mother’s head. They got up because they thought it was for fun, but it wasn't. DJ's dad started swinging his bat and "chucking" sisters. tried to call the cops and "he" started pushing them to the ground. , age 18, indicated in her statement that "he" said come downstairs anu tney aid. "He" came out with a gun and said to get on the ground and "he" pushed them and tied them up with zip ties. He started duct taping them and s mother said, "What's this about?" [Someone] said they would talk later. nother got up and "busted out" and ran. "He" stopped all of them to go back |sic.] The dad, presumably meaning Flint Harrison who is Dereck's father, choked when she tried to pull away he choked her harder and hit her mother in the head with the bat. They ran out and called the police and the suspects drove off. age 17, indicated that DJ, presumably meaning Dereck James Harrison, and his dad, presumably meaning Flint Harrison, tried to tie them up and hit them with the bat. The suspects also choked the girls until they escaped one by one and then the suspects left. The house was secured by police officers and no one was allowed inside. A baseball bat was found on the front lawn of 180 N 700 E where the girls were found when police arrived, and is in plain view on the front lawn. Hiedi Harkins, the mother, was interviewed on May 11, 2016 by Detective Mike Dingman. Hiedi told Detective Dingman the following account. Dereck Harrison had her and her four daughters go downstairs where Dereck pointed a long gun at her. She initially thought it was a joke and went upstairs. When she did so, Flint Harrison was at the top of the stairs with a baseball bat. Flint told Hiedi that it was not a joke and sent them back downstairs. Flint jabbed Hiedi in her gut with the baseball bat and they went back downstairs. Hiedi said flint put her hands in zip - Page 3 of Affidavit for Search Warrant No. 1447614 - ties and put her on the ground. He puta hood on Hied's head and she then fought and was able to escape. While Hieidi was getting away, Flint hit her in the head and once in her side. Hiedi ran upstairs. The back door was locked, She unlocked it and was able to escape. On the night of May 11, 2016, your affiant acquired and assisted in the service of a search warrant at 190 N 700 E where the incident was said to have occurred. During the search, we found evidence that corroborated the statements from the four girls. There were used and unused zip ties found throughout the basement. There were several pieces of used duct tape, some of it with strands of hair attached to it. There was a lock of hair found on the stairs which lead to the downstairs. There was blood on the wall and on the floor in a hallway at the bottom of the stairs. There was a red wallet/case which contained a white crystal substance with appearance consistent with methamphetamine. The baseball bat on the front lawn of 180 N 700 E was collected. There were also three cell phones found downstairs. Two of them are believed to belong to the victims. One of the phones is believed to belong to Dereck James Harrison. It rang while we were searching the house. Officer Jason Read answered it and a female who identified herself as Melissa Harrison, who is Flint Harrison's wife and Dereck Harrison's step-mother. When Officer Read answered the phone, she immediately told him that she could not find Flint, sounding like she was continuing a conversation. On May 11, 2016, a silver Chevrolet Suburban, Wyoming veterans license plate AR83G, registered to Flint and Melissa Harrison was found abandoned at 1340 S Firebreak Road in Farmington, Utah. It was towed to Centerville Police Department. | submitted an affidavit and acquired Search Warrant number 1447604, which was written for a Chevrolet Tahoe. When | went out to the garage at Centerville Police Department where the car was towed, | noticed that the vehicle was actually a Chevrolet Suburban, not a Chevrolet Tahoe, for which the warrant was written. These vehicles are very similar in appearance, but they are different models, so this warrant is updated with this more accurate information Warrant number 1447604 will not be served. WHEREFORE, your affiant prays that a Search Warrant be issued for the seizure of said items. I declare under criminal penalty of the State of Utah that the foregoing is true and correct.
