AFFIDAVIT
(Sworn Statement)
I, JESSIE T. GANIBE, 47 years of age, Filipino citizen, and currently residing at
Blk 321, Lot 143, Farmland Subd., E. Rodriguez Sr., Quezon City, after having
been sworn to in accordance with law, do hereby depose and state that:
1. I know the spouses JESUS BUENCONSEJO and MARIA NEGI
LATORENA;
2. The spouses hired me as a family driver in the year 2003 and I am a stay-in
driver;
3. Every day, I am tasked to drive Mr. Buenconsejo to Makati Medical Center
and their children to St. Theresas College in Quezon City and went home
after that;
4. Ms. Latorena, however was always at home, helping JANE AUSTRIA, their
house helper to attend to some household chores and errands while waiting
until the afternoon wherein she will accompanied me to fetch their children
from school;
5. Every weekend, the family will go out for family bonding, attend the church,
and buy groceries and other necessities, this was a weekly family routine;
6. However, sometime in the year 2005, Mr. Buenconsejo has frequent trips out
of town mostly on weekends, specifically in Ilocos Norte because he always
asked me to drive him to the airport and told me that he'll just text me about
his flight schedule back here in Manila so I could wait for him in the airport.
The duration of which was from January to March;

7. During those days that Mr. Buenconsejo was out of town, Ms. Latorena had
her frequent night outs. She asked me to drive for her and to wait for them to
finish. She assured me that she was out with her friends and have a light
drinking spree and chitchat, I saw her friends, 3 ladies and 1 guy;
8. During one of her night outs, in January 2005, she asked me to drive her to
SSS Village, Fairview Quezon City, which was different from the places the
she used to hang out with her friends. I am surprised that the address was
neither a bar nor a restaurant but a house belonging to the guy who was with
them during their night outs;
9. She introduced me to his guy friend, his name was EARL. Then she
instructed me to return their after several hours, and I complied;
10. Upon returning to the house to fetch Ms. Latorena, I noticed that she was in
a different state compared to the time that I left her there, her eyes stares
blankly, her skin and mouth seems dry, she barely managed to stand on her
own, she suddenly laughs as if there was a joke that I have missed and a bit
shaky. It was EARL who helped me to brought her inside the car;
11. This set up continued whenever Mr. Buenconsejo was out of the town,
however I noticed that she frequently wanted to go to Earls house in SSS
Village Fairview. One evening, sometime in February 2005 her husband was
out of town again and the usual routine, she asked me to drive her to Earls
house and offered me a large amount of money. I was shocked since Mr.
Buenconsejo has been faithfully paying my wages, she told me that the
money was for me not to tell her husband about her late night business;
12. While I was waiting for her, I saw her and Earl smoking but the thing that
theyre using was unusual for me since it was not a cigarette but a rolled foil,
then they started making out at the garage. Im shocked when I witnessed
that since Im fully aware that she was married and I thought theyre just
friends. They saw that Ive witnessed such act and hurriedly approached me;
13. Ms. Latorena threatened me that if I confided to her husband what I have
witnessed, Earls group will beat me to death. Earl was just smirking at that
time but Im fully aware that he was holding his gun at his back pocket, so I
agreed;

14. After threatening me, Ms. Latorena asked me to wait outside and not to
meddle with their business, the two went inside of the house. Earl
accidentally dropped the rolled foil and I curiously examined the same, it
was a powdery substance and recognized it as shabu;
15. I cannot bear hiding Ms. Latorenas scandalous secret anymore, when Mr.
Buenconsejos out of town trips were over, I talked to him privately and
revealed to him that while he was away, his wife was seeing another guy
whom he thought at first was her friend, but upon witnessing their intimate
act and recounting to him their frequent dates, I started to get suspicious
about their real status and revealed to him that his wife and Earl threatened
me that Earls troop will beat me to death if I will tell him all about their
secret affair;
16.I also confided with him the sudden changes in his wifes behavior like
being high whenever we came home after her late night business in Earls
house, that she was a bit shaky, laughing unexpectedly, stares blankly and
became violent;
17.I told him that I saw them smoking some substance in a rolled foil, that after
threatening me, Earl accidentally dropped the rolled foil and I discovered
that the substance was shabu. They were engaged in drug dealing;
18. I further attest that the above information is true and correct to the best of
my knowledge and belief; and
19. I am executing this sworn statement to attest to the truth of the foregoing
facts, for information of proper authorities concerned and for whatever legal
purpose this affidavit may serve.
