HB16-1302 Colorado Career Advancement Act

Why is this bill necessary?


With the enactment of the federal Workforce Innovation and Opportunity Act in
2014 (WIOA), Colorados Work Force Investment Act (WIA) became
inconsistent with federal law. In order to maintain alignment with current
federal law, the Colorado Work Force Investment Act (WIA) must be updated to
align with the federal Workforce Innovation and Opportunity Act (WIOA), which
became effective July 1, 2015.
The Colorado Way
Colorado Counties, Inc. has led the development of House Bill 16-1302 in
partnership with numerous stakeholders including business, the Colorado
Workforce Development Council and the Colorado Department of Labor and
Employment.
What the bill does:
1)

Throughout Colorado WIA statutes, citations to the federal Workforce


Investment Act of 1998 are being removed and replaced with citations to
the new federal WIOA. These updates will bring the act into compliance
with new federal law.

2) Definitions are being added to clarify the use of terminology in the law.
3) The bill repeals existing requirements for memoranda of understanding
agreements (MOUs) between partners.
WIOA requires new partners to be involved in the workforce system and
has specific stipulations for MOUs among the service providers.
Repealing this section gives local workforce areas maximum
flexibility
4) Establishes that counties get to determine the expenditure of any TANF
funds for cash contributions to infrastructure costs or service delivery
contracts. Allows for the greatest local flexibility.
5)

Adds references to Title III funding and clarify that any


recommendations for changes to in-state allocation formulas go into
effect the following program year and are subject to approval by the
United States Department of Labor.
