Abstract
The criterion of obligating In Islamic Jurisprudence is to establish balance between the kind of
obligation (Taklif) and the ability of the Mukallaf. The obligations in Islamic legislation however,
should be within the ability of the Mukallaf so it would be under his control. Otherwise the Mukallaf
would be unable to do or to act upon the obligation. This should be the base of Islamic legislation
when talking about the rulings of Islam and they should be related to the ability of the Mukalaaf.
Therefore this can be considered an evidence of the moderation of Islamic legislation, its justice,
comprehensiveness and realism. It also shows the rationale of Islamic legislation of keeping the
obligations within the Mukallaf ability.
