Defendants were permitted to and did appear via telephone. Based upon representations made at the pretrial, the above-captioned matter shall proceed according to the terms of the case management order set forth below: [1] Both parties shall have twenty-one (21) days from the date of entry of this Order upon the docket to file a dispositive motion, if any. [2] Both parties shall have ten (10) days from the deadline for filing dispositive motions to respond. [3] If this matter cannot be resolved by way of dispositive motion, both parties shall submit the following by Thursday, August 12, 2010: (1) stipulations; (2) trial briefs; (3) copies of all exhibits and joint exhibits intended to be offered into evidence at trial; and (4) witess lists, listing any and all witnesses that the parties intend to call at trial, including, but not limited to, the names of any expert witnesses and the substance of their proposed testimony.
