| SUPPORTING AFFIDAVIT FOR ARREST WARRANT |
I, Detective Troy Bisgard, 98009, of lawful age do swear upon my oath to the facts set forth below
and on 2 continuation page(s):
Your affiant, Detective Troy Bisgard, 98009, a Police Officer with the Denver Police
Department, was assigned to investigate allegations of Murder In The First Degree in violation of
18-3-102(1){a), C.R.S. by ROBERT WALTERS , 2 White Male, 6°0" Tall, 150 Pounds, Blond
Hair, and Blue Eyes, against BRITTNEY BRASHERS on DPD offense number 2009656502,
The facts tending to establish the grounds for issuance of this Arrest warrant are as follows, and
were learned by Your Affiant through conducting interviews and/or the review of statements and
other police reports:
On November 17, 2009, at approximately 12:15 p.m., Your Affiant was informed of a fatal car
accident that detectives within the Traffic Investigation Bureau were investigating. Your Afiant
personally spoke with Detective Kenneth BRIGGLE, 92019, of the Traffic Investigations Bureau,
who said that earlier that moming at approximately 1:45 a.m., there was a car accident in the 100
block of South Yuma Street in the City and County of Denver. There were two occupants in the
vehicle; the driver, Brittney BRASHERS, dob: 05/06/1987, and a passenger, Robert WALTERS,
dob: 07/08/1986, The two were found in a 2004 Pontiac Vibe bearing Colorado License Plate
638TAA and VIN:SY2 57. The vehicle was registered to Britney BRASHERS at
Ent Avenue in Colorado Springs. Ms, BRASHERS was transported to Denver Health
Medical Center where she was later pronounced deceased. Robert WALTERS was transported
to Denver Health Medical Center with minor injuries. Mr. WALTERS stated to an officer at
Denver Health Medical Center that Ms, BRASHERS was driving but should not have been as
she was too intoxicated.
Detective BRIGGLE advised that he had just attended the postmortem examination conducted on
the victim at the Denver Coroner’s Office. Ms. BRASHERS was a member of the United States
Air Force; therefore Agents from the Air Force's Office of Special Investigations attended the
examination as well. Agent Sherman BROOKS informed Your Affiant that Ms, BRASHERS
and Mr, WALTERS were in a relationship with each other and there was a history of domesticPage 2
violence between the two. Detective BRIGGLE stated that he questioned whether or not her
injuries were consistent with a car accident.
On November 17, 2009, at approximately 1:20 pam, Your Affiant reviewed the photographs of
the scene obtained by the Traffic Investigations Bureau. Yuma is a dead-end street at the north
end of the South 100 block. Based upon a review of the photographs and the reports from Traffic
Investigations Bureau your A{ffiant determined that the victim’s Silver colored Pontiac Vibe was
traveling Northbound in the 100 block of South Yuma street when it struck a Red colored
Mercury Sable that was legally parked facing the opposite direction on the West side of Yuma.
The victim's vehicle then continued North past the Mercury Sable and struck a White colored
Dodge Van, legally parked in the same fashion behind the first. The Dodge Van was pusbed
‘North passed the dead end and down a hill. The victim’s vehicle then spun the opposite direction
and came to a stop facing South on Yuma Street.
Your Affiant learned through witness interviews that prior to the car crash the victim, Ms.
BRASHERS, had participated with other women in a photo shoot North of the crash site at ¢
club and that Robert WALTERS had been present for parts of the photo shoot. Ms, BRASHERS.
and Robert WALTERS had been driving back to Colorado Springs on I-25 prior to the crash. On
November 17, 2009, at approximately 1:35 p.m., Your Affiant spoke with Robert WALTERS
on the phone. He was unable to shed any light on the cause of the accident, stating only that he
nodded off prior to the crash. He was unable to say where they were or why they were there, He
was unable to say which “Strip Club” it was that the two were at prior to the accident. He said
that he was “sad” that she took her top off during the photo shoot but they did not argue about it
on the way home.
On December 10, 2009, Your Affiant spoke with Detective Nash GURULE. He stated that he
interviewed one of the victim’s friends, She told the detective that she
hheard a message on the vietim’s phone from Mr. WALTERS saying that he hated the victim and
wished she were dead. Your Affiant subsequently searched the victim's phones that Your
Affiant previously recovered from the vehicle. On one of the phones, Your Afffant found a
recording of a male yelling at the victim stating that he hated her and wished she were dead.
On December 14, 2009, Your Affiant was provided with a copy of a report from the Colorado
Spring Police Department. It was from a domestic violence report pertaining to an incident that
occurred on October 24, 2009, between the victim, Brittney BRASHERS and Robert
WALTERS. BRASHERS stated to the officers that Robert WALTERS threatened to cause her,
or the both of them, to have a car accident.
On January 18, 2010, at approximately 8:30 a.m., Your Affiant was provided with a copy of the
victim's autopsy report. Dr. John CARVER reported that the victim's cause of death was
undetermined as was her manner of death.
On March 29, 2010, at approximately 2:25 p.m., Your Affiant spoke with Mr, WALTERS"
estranged wife, »,dob: 07/1986, on the telephone. She told Your Affiant thatPage 3
when Mr. ROBERTS got back to California in the days after the accident he told her that he
killed Brittney then staged the car accident to get away with it. He said that they were at a photo
shoot and during the photo shoot she took her top off. Mr. WALTERS told
that he decided to kill her then. He told her that he and the victim were driving back to Colorado
Springs on the highway. He and the vietim were arguing about her taking her top off during the
photo shoot. He told her that he punched the victim in the face then grabbed the steering wheel,
forcing the car to exit the highway. He drove in an unknown area and parked the car. The victim
let out a scream so he began to knee her in the face, He then stopped and could not believe that
he assaulted her. He wanted to take her to the hospital, but knew that she would tell on him. He
decided that he had to finish her. Wherever they were the car was now stuck in the snow. He got
out of the car and began to push on the bumper. It is at that time that he realized his hands and
the bumper were bloody. He told her that he then got back into the car and the victim was still
breathing. He began to yell at her “Why won't you die, why won't you die? He then got on top
of her and using his forearms he began to push down on her throat to stop her breathing and
attempted to break her neck. He then pushed her into back into the driver's seat and unclipped
her seatbelt, He then drove to a dark residential street and accelerated the vehicle. He then
swerved the steering wheel into the park cars. The impact caused the victim to hit the
windshield. He then began to put on a show by screaming for help and crying out for people to
help his girlfriend. Mrs. WALTERS told Your Affiant that he has confessed the murder to her
several times since the incident and on several occasions she has been able to record him on her
cellular telephone talking about killing the victim. He has tried to commit suicide on two
occasions since the incident saying that he does not want to go to prison for the rest of his life.
On March 30, 2010, at approximately 8:18 a.m., Your Affiant spoke with Dr, John CARVER
regarding the statements that the suspect made to ». Dr. CARVER said that the
injuries he observed on the victim were consistent with the suspect's statements about how he
killed her.
Based on the foregoing, your affiant respectfully requests that an At Large Warrant be issued for the
arrest of ROBERT WALTERS, DOB: 7/8/1986 for Murder In The First Degree in violation of
18-3-102(1)(a), CRS.
