Dear Representative Lee:

The Board of the Office of Congressional Ethics (“OCE”) referred the above numbered matter to the
Committee on Standards of Official Conduct (“Standards Committee”) for dismissal.

Pursuant to H. Res. 895 of the 110th Congress as amended (the “OCE Resolution”), the Board is
providing you with a copy of the “written report” of the Board. The OCE Resolution provides that
this “written report,” is “composed solely” of (1) “a recommendation that the committee should
dismiss the matter that was the subject of such review; a statement the matter requires further review;
or a statement that the matter is unresolved because of a tie vote,” (2) “the number of members
voting in the affirmative and in the negative,” (3) “statement of the nature of the review” and (4) the
“individual who is the subject of the review.” OCE Resolution Section 1(c)(2)(C)(i)(I).

In addition to this enclosed report, the OCE Resolution also provides that the Board may, but need
not, provide “findings” to the Standards Committee, including findings of fact.” OCE Resolution
Section 1(c)(2)(C)(i)(II). Under the OCE Resolution the Board is not permitted to provide these
findings to you at this time. OCE Resolution Section 1(c)(2)(C)(ii). While, under the OCE
Resolution, the Standards Committee must, in all but one circumstance, publicly disclose the Board’s
findings within specific time frames they must notify you before they do so.1
