Roll No. 2702235
Div ‘B’
SOLUTION 1:
According to me, Bharat is entitled to get compensation from Arvind, because
the house which was constructed by Arvind before 1st January and after taking
possession of that house, it finally fell down.
So, we can say that this is a case of “discharge of contract
because of non performance and suit for damages” as well. This compensation
can include the rent amount of the house till the new flat is constructed and the
price of that flat will be paid by Arvind only.

SOLUTION 2:
As per my opinion, ABC Ltd. will succeed because it was clearly mentioned in
the contract that the machine is to be delivered on an urgent basis without any
delay i.e. on time, but Fast Ltd delayed the delivery of the machine without any
rhyme and reason and because of which ABC Ltd. lost a profitable contract
with the Bosco Ltd. So we can say that this is a case of Non-Performance of the
contract within the stipulated time period. That means ABC Ltd can claim for
the compensation for the loss and can impose penalty hand-in-hand.

Solution 3:
In this case, the Manager is entitled to sue Sunidhi for the specific performance
of the contract, Sunidhi was appointed on the daily basis performance, the
manager was ready to pay for her daily performance, but Sunidhi broke the
contract in between and hence she is not liable to claim for the payment of a
particular day. So we can say that Manager can claim for the losses whereas
Sunidhi is not entitled to file a complaint against the Manager.
Solution 5:
Subash will not succeed, although Subhash made an agreement with Ahmed for
drawing plans, but unfortunately Ahmed was injured in a bomb blast and
suffered from severe injuries and was unable to draw the plan of the house.
Here in this case, we can see that this case is somewhere related to ‘Contingent
Contract’ which talks about the uncertain incident that can take place in the
future. So this contract will become void as per the Indian Contract Act, 1872.
