RE:
Ise and Misleading Campaign Materials
Dear Mr. Arnold,
I write to you as the Chairman of the Board of Trustees of Marymount College. On
‘Wednesday, September 8, 2010, Los Angeles Superior Court judge David Yafee found “clear
and convincing evidence” that the following ballot argument in favor of Measure P was false
and misleading:
“[Pact - Measure P]...guarantees that Marymount College meets all City codes
and obtains City permits with strict construction time limits for every part of
the plan.”
Judge Yafee ordered the above words stricken from the ballot arguments. Thereafter, T (and
most residents of RPV) received in the mail a flyer (entitled “Now is the Time”) that
repeated these very same false and misleading statements. I also note that the website for
Marymount’s “plan” has a “Myth vs, Facts” flyer that repeats these same false and
misleading statements. Finally, 1 noticed that the most recent issue of the Palos Verdes
Peninsula News contained a full-page ad that repeated these false and misleading statements.
I call upon you to present this letter to the entire Board of ‘Trustees so that the other
trustees have the opportunity to review my letter and following such review, to: 1) retract
these false and misleading flyers; 2) mail corrected flyers that omit each falsehood; 3) publish
only truthful information on Marymount's plan website, in flyers and in newspaper ads; and
3) apologize on behalf of Marymount for deceiving RPV voters. On several occasions,Page2

Marymount representatives have pledged to “take the high road in the election.” This is
Marymount’s opportunity to fulfill tha pledge. I await your written reply and, more
importantly, your prompt action on behalf of Marymount.
