Governor's Memorandum 03/2006

ABSENCE FROM DUTY ON WORKING DAYS

It is observed that abstaining from duties by Public officers at the behest of unauthorize:d calls from unidentified person had been taking place during past three months in the Provincial administration in the Northern & Eastern Provinces.

02. It is to be noted that Public officers cannot keep away from office without proper leave being approved by the relevant authority in terms of Section 1: 1 of Chapter XII of the Establishment Code, which states that "leave is not a right but only a privilege and it is granted subject to the exigencies of service and may be curtailed or cancelled at any time by the authoritv granting the leave". It is further provideo by succeeding Section 2:1 that proper arrangements have to be made for the perfonnsr.ce ~;f :~;.;;fh~:- ~~tie$ while C~ :ea'l8.

03. Accordingly an officer who does not comply W!~., the above stated provisions and abstain himself from attending duty shall be deemed to nave committed an offence under Item (9) of the First Schedule of Offences Committed by Fublic Officers and punishable with forfeiture of day's ,pay for each day of absence or part thereof in terms of Section 24:2:8 of Chapter XLVIII of the Establishment Code.

04. Therefore in future in the event of any occurrence of such un-authorized absence from duty by Public officers, Secretaries, Deputy Secretaries, Head of Departments and Project Directors 3~E: hereby directed to take appropriate action and place them on no pay ieave on those cays the officers have absented themselves without proper approval.

05. Any aggrieved officer may appeal agai.nst such imposition of no pay order. The Head of Department may forward such appeals with his recommendation through Secretary of the relevant Ministry to this office for a ruling.

06. This will come into force with effect from 6th September, 2006.

03. The GlF will consist of donations or contributions received from the members of the public, organizations, societies both local as well as foreign, or by the Provincial Council, and also from the income generated through projects under taken by the GTF with the approval of the Governor.

04. ADMINISTRATION AND MANAGEMENT

The administration, management and control of the GTF is vested in a Board of Management (80M) constituted as hereinafter provided, to ensure the foregoing objectives are met and GTF developed to meet the demand. With immediate effect the BOM of the GTF shall consist of

(a) The Chief Secretary

(b) The Secretary to the Ministry of Education, Cultural Affairs and Sports (c) The Secretary to the Ministry of Health and Indigenous Medic1ne

(d) The Secretary to the Provincial Public Service Commission

(e) Additional Secretary to the Governor and

(f) The Deputy ,.,Secretary to the Provinoai Treasury

OS. OffICE BEARERS

(a) The Chief Secretary shah be the Ex-Officio Chairman of the BOfvl of the GTF

(b) Additional Secretary to the Governor shall be the Secretary to the BOM of the GTF

(c) The Deputy Chief Secretary to the Provincial Treasury shall be the Treasurer to the BOM of the GTF.

06. Additional Secretary to the Governor shall be in charge of the general administration and management of the affairs of the GTF and related matters, subject to the overall control of the Governor.

07. There s~all be An Assistant secretary appointed to assist the Secretary to the BOM who shan be appointed QY the Governor and s;laill.o:d offtce for such period specified in the letter of appointment issued to him by the Governor. The Governor may in his absolute discretion revoke such appointment at any time and re-appoint another for SULP post.

08. FUNCTIONS Of THE BOARD OF MANAGEMENT

(a) i. The BOM may regulate the procedure with regard to its meetings

and the transaction of business at such meetings.

ii. BOM will meet at least once every quarter or as an when necessary.

iii. Quorum for a meeting shall be four including the Chairman of the BOM.

iv. The Secretary of the BOM shall cause the copies of the minutes of each and every meeting to be forwarded to the Governor.

v. No acts, proceedings of the BOM shall be deemed to be invalid by reasons only of the existence of a vacancy among its members or any defect in the appointment of a member thereof.

(b) The BOM shall in the name of the GlF, have the power with the concurrence of the Governor to recommend grants as per paragraph 2 of this Memorandum for deserving persons/institutions in the NEP for approval of the Han. Governor. In case of medical qrants the payments will be made

09. CONTROL Of fINANCES

(a) The BOM shall maintain an Account called "The Governor's Trust Fund" in any recognized Bank approved by the BOM and all moneys that may accrue to the GTF shall be credited to such account.

(b) All disbursements will be made by cheques, the siqnatories to such cheques shall be determined by the BOM in consultation with the Governor.

(c) Any moneys belonging to the GTF may be invested by the BOM in such manner as the BOM may determine, in Govemment approved banks, Treasury bills etc. subject to the approval of the Governor.

(d) The Treasurer of GTF shall maintain proper accounts cf the GTF, and prepare a quarterly Balance Sheet for the purpose of Audit.

(e) The Governor shall appoint a Board of Audit for Auditing the accounts of GTF. For the purpose of assisting them, they may employ the services of any other staff who shall act under their direction and control.

The Audited Balance sheet must be forwarded to BOM & Governor within one month at the end of each quarter.

(g) Annual Financial Statement of the Governor's Trust Fund shall be audited by the Auditor General.

10. As the Governor's Trust Fund is established for the benefit of all citizens living in the Northern and Eastern Provinces, ~t 15 incumbent on ali concerned to make every endeavour to create awareness among the Public in the NEPC in order to enable them to obtain benefits when necessary ..

GOVERNOR'S MEMORANDUM 04/2006 ADMINISTRATION OF GOVERNOR'S TRUST FUND

01. Governor's Trust Fund (GTF) has been established on the 27th November 2000 for the benefit of those living in the NEP and public officers serving the NEP.

02. The GTF will provide Funds to the deserving people in the North & East Provinces taking in the consideration their flnancial state in following areas.

(a) For the relief of poverty

(b) For the advancement of education, sports or cultural affairs (maximum Rs. 25,000/-)

(c) for the maintenance of places of worship (maximum Rs.40,000/-)

(d) For making of awards to persons who have served the Northern and Eastern Provinces in an exemplary manner with dedication for the betterment of the people.

(maximum Rs. 25,000/-)

(e) To grant part relief for life saving surgery or to obtain life saving drugs (maximum Rs. 50,000/-)

(f) For any other purposes/ which is in the opinion of the Governor and the Board of Management, of benefit or interest to the people of the Northern and Eastern Provinces.

4 Expenditure Limits on Telephone Charges

Public Finance Circular No. 393(3) of 31.12.2002 and No. 393 (4) of 02.04.21)03 specifies the combine Monthly Telephone Expenditure Limits. All Secretaries and . Heads of Department should comply with this circular instructions strictly from May, 2007.

Public Administration circulars should be applied for strict compliance in order to ensure the smooth functioning of Provincial Administration within the provisions of the Establishment code.

Therefore, it is hereby directed to give utmost pnonty to Circulars issued In connection with the Public expenditure and curtailment immediately.

1 Supply of fuel for official vehicles:

ublic Administration Circular 1112006 of 14 July, 2006 and new provisions I ade effective in the circulars shall be implemented.

Allocation of Quarters & Recovery Rent

Immediate steps should be taken to recover the quarters rent from the salary of the officers concerned in terms of the Para of Chapter XIX Section 5 of Establishment Code from May, 2007.

Assigned Vehicles

Public Officers who are entitled to official vehicles may be assigned vehicles in accordance with the regulations laid down in terms of Public Administration Circular 22/99 of s" October 1999 and amended by Circular 22/99/IV - 2004
