GOVERNOR'S MEMORANDUM 01/2007 ADMINISTRATION OF GOV~RNOR'S TRUST FUND
01. Governor's Trust Fund (GTF) has been established on the 27th November 2000 for the benefit of those living in the Northern and Eastern Provinces and public officers serving the NEP .: With the establishment of separate ad-uinistratlons in the Northern and Eastern Provinces, . 1:!. separate Trust Fund will be established for Eastern Province with effect from 01st January, 2007.

02. The GTF will provide Funds to the deserving people in thr:: Eastern Province taking in the
consideration their financial state in following anas.
(a) For the relief of poverty
(b) For the advancement of education, sports or cultural affairs (maximum Rs. 25,000/-) ..
(c) for the maintenance of places of worship (maximum Rs.40,OOO/-)
(d) For making of awards to persons who (lave served the Eastern Province in an exemptarv manner with dedication for the betterment of the people.
(maximum Rs. 25,000/-)
(e) To grant pari: relief for life saving surgery or to obtain life saving drugs (maximum Rs. 50,000/-)
(f) For any other purposes, which is in the opinion cf the Governor and the Board of Management, of benefit or interest t(, the people of the Eastern Province.

03. The GTf will consist of donations or contributions received from the members of the public; organizations, societies both local as well as foreign, or by the Provincial Council, and also from the income generated through projects undertaken by the GTF with the approval of the Governor.
04, ADMINISTRATIQN AND MANAGEMENT
The adrninlstratlon, management and controi of the GTf is vested in a Board of. Management (BOM) constituted as hereinafter provided, to ensure the \'oregoing objectives are met and GTF developed to meet the demand. With immediate effect the BOM of the GTF shall consist of
(a) The Chief Secretary
(b) The Secretary to the Ministry of Education, Cultural Affairs and Sports (c) The Secretary to the Ministry of Health and Indigenous Medicine
(d) The Secretary to the Provincial Public Service Commission
(e) Secretary to the Governor and
(f) The Deputy Secretary to the Provincia! Treasury
05. OFFICE BEARERS
(a) The Chief Secretary shall be the Ex~Officio Chairman of the BaM of the GTF
(b) Secretary to the Governor shall be the Secretary to the BOM of the GTF
(c) The Deputy Chief Secretary to the Provinclet Treasury shall be the Treasurer to the BOM of the GTF.
06, Secretary to the Governor, Eastern Province shall be in charge of the genera) administration and management of the affairs of the GTf- and related matters, subject to the overall control of the Governor,
07. There shall be An Assistant secretary appointed to assist the Secretary tc the BOM who shall be appointed by the Governor and shall hold office for such period specified in the letter of appointment issued to him by the Governor. The Governor may in his absolute discretion revoke such appointment at any time and re-appoint another for such post.

08. FUNCTIONS OF THE BOARD OF MANAGEMENT
(a) i. The BOM may regulate the procedure with regard to its meetings
and the transaction of business at such meetings.
if. BOM will meet at least once every quarter or as an when necessary.
ili. Quorum for a meeting shall be four including the Chairman of the BOM.
iv. The Secretary of the BOM shall cause the copies of the minutes of each and every meeting to be forwarded to the Governor.
v. No acts, proceedings of the BOM shall be deemed to be invalid by reasons only of the existence of a vacancy among its members or any defect in the appointment of a member thereof.
(b) The 80M shall in the name of the GTF, have the power with the concurrence of the Governor to recommend grants as per paragraph 2 of this Memorandum for deserving persons/institutions in the Eastern Province for approval of the Han. Governor. In case of medical grants the payments will be made on production of relevant bills with the relevant documents.
09. CONTROL OF FINANCES
(a) The BOM shall maintain an Account called "The Governor's Trust Fund" in any recognized Bank approved by the BOM and all moneys that may accrue to the GTF shall be credited to such account.
(b) All disbursements wHI be made by cheques, the signatories to such
,cheques shalf be determined by the 80M in consultation with the Governor.
(c) Any moneys belonging to the GTF may be invested by the BOM in such manner as the 80M may determine, in Government approved banks, Treasury bills etc. subject to the epprovel of the Governor.

(d) The Treasurer of GTF shall maintain proper accounts of the GTF., and pre-pare a quarterly Balance Sh~et for the purpose of Audit.

(e) The Governor shall appoint a Board of Audit for Auditing the accounts of GTF. For the purpose of assisting them, they may employ the services of any other staffwho shan act under their direction and control.
(f) The Audited Balance sheet must be forwarded to BOM & Governor within one month at the end of each quarter.
(g)
Annual Financial Statement of the Governor's Trust Fund shan be audited by the Auditor GeneraL
10. As the Governor's Trust Fund is established for the benefit of aU citizens living in the Eastern Province it is incumbent on all concerned to make every endeavour to create awareness arnonqthe Public in the Eastern Province in order to enable them to obtain benefits when necessary ..
11. This memorandum will supersede promulgation dated 27th November, 2000 and come into force from 1st January, 2007.

DELEGATION OF POWERS -PROVINCIAL PUBLIC SERVICE-NORTHERN PROVINCIAL COlINCIL
1. LOon Sarath Mohan Wijcwickrama, acting for Governor of the Northern Province delegate the power vested in me by section 32 of the Provincial Council Act No. 42 of 1987. read with section 3. 4. 5 and 6 of the Provincial Councils (Amendment) Act No. 28 of 1990. to the Provincial Public Service Commission of the Northern Province, of appointment transfer. dismissal and disciplinary control of the members of the Northern Province Provincial Public Service including the employees of Statutory Bodies, subject to Illy exclusive exercise of these powers in respect of the following categories of ern ployecs:

I further authorize and empower the Northern Province Public Service Commission to delegate as follows.
(a) To the Chief SecretarY of the Northern Province.
(i) The power of placements. transfers and disciplinary control of officers in the Provincial Public Service who arc members of the All Island Service as defined by the Public Administration circular No. 56/89, other than reserved in paragraph 1 above.
(ii) The power of transfer and disciplinary control of staff level officers, not belonging to the All Island Service working under him.

( This power of inter Ministry transfer is to be exercised in consultation with the respective Secretaries of the Ministries concerned)

The powers to serve vacation of post orders, interdict any officer within the department. and power to impose -miIH'n: punishments as stipulated in the Establishment Code, Part 11 chapter XI.VII Section 16:2 or suspend. stop. differ increment for a period not exceeding one year to non-staff level officers and
minor employees-coming under their administrative control. .
(c) Local Heads Departments
The powers to issue vacation of post orders, to severely reprimand or reprimand. or censure, or impose a fine not exceeding one week's pay in the case of employees coming under their administrative control who are termed as minor employees within definition given in the administrative circular No. 387 of 11.12.87.
Guidelines
The powers should be exercised according to the Guidelines issued by me to Prbvincial Public Service Commission, Northern' Province and any other instruction that may be issued from lime to time.
(iii) The power of transfers and disciplinary control of Combined Services officers working under him and in non classified institutions.
(iv) The power of appointment, transfer and disciplinary control of minor employees working under him and in non classified institutions.
(v) The power of inter Ministry transfer, within the Northern Province, of employees of all services and grades except Heads of Departments and officers appointed by the Governor. ( This power of inter Ministry transfer is to be exercised in consultation with the respective Secretaries of the Ministries concerned)

DELEGATION OF POWERS -PE;l0VINCIAL PUBLIC SERVICENORTHERN PROVINCIAL COUNCIL
1. I, Don Sarath Mohan Wijewickrama, Governor of the Northern Province delegate the power vested in me by section 32 of the Provincial Council Act No. 42 of 1987, read with section 3, 4, 5 and 6 of the Provincial Councils (Amendment) Act No. 28 of 1990, to the Provincial Public Service Commission of the Northern Province, Recruitment, appointment, transfer, dismissal and disciplinary control of the members of the Northern Province Provincial Public Service including the employees of Statutory Bodies, subject to my exclusive exercise of these powers in respect of the following categories of employees:
(a) The staff of the Governor's Secretariat.
(b) The Secretaries to the Provincial Council Ministries.
(c) Secretary to the Governor.
(d) Secretary to Provincial Public Service Commission.
(e) Heads of Department of Provincial Ministries.
(f) Municipal Commissioner
(g) Regional Commissioner

(a) To the Chief Secretary of the Northern Province.
(i) The power of placements, transfers and disciplinary control of officers in the Provincial Public Service who are members of the All Island Service as defined' by the Public Administration circular No. 56/89, other than reserved in paragraph 1 above, as listed in Para (1) of appendix 91.
(ii) The power of transfers and disciplinary control of staff level officers, not belonging to the All Island Service working under him and in non classified institutions.

3. Guidelines
The powers should be exercised according to the Guidelines issued by me to Provincial Public Service Commission, Northern Province and any other instructions that may be issued from time to time.
4. Appeal
a) An appeal lies to the Provincial Public Service Commission from any officer or employee aggrieved by any order under these delegated powers.
b) An appeal lies to the Governor against any order made by the Provincial Public
Service Commission
c) In the case of officers of the All Island Service, an appeal lies to the National Public Service Commission against any order made by the Provincial Public Service Commission.

Public Administration circulars should be applied for strict compliance in order to ensure the smooth functioning of Provincial Administration within the provisions of the Establishment code.

1 Supply of fuel for official vehicles:
Public Administration Circular 1112006 of 14 July, 2006 and new provisions made effective in the circulars shall be implemented.

Allocation of Quarters & Recovery Rent
Immediate steps should be taken to recover the quarters rent from the salary of the officers concerned in terms of the Para of Chapter XIX Section 5 of Establishment Code from May, 2007.

Public' Officers who are entitled to official vehicles may be assigned vehicles in accordance with the regulations laid down in terms of Public Administration Circular 22/99 of 8th October 1999 and amended by Circular 22/99/IV - 2004

Required standing orders and instructions for the efficient nmning are to be issued by Secretary, Ministry of Provincial Publ-ic-Administrat-ion keeping me informed. These instruction should include eligibility, persons authorized to use these facilities, charges for occupancy, conduct and discipline to be observed by occupants, inventory instructions liability of the temporary occupants etc.

After approximately 18 years as the North, East Provindal Council and one year as the -Eastern Provincial Council/ i_t has been revealed that 'in order to, .ensure effective admin'stretion and dellvery of: services to the people, some

From the time of the existence of NEP this had been a subject that was extensively discussed at various levels, among the Secretaries and 'Departmental Heads. Now a finality is' reached' with consensus of the mejority which is ready for implementation. This would entail re-adjustment

This has reference your Honour's Memorandum of dated 19.04.2007.
I wish to submit the followings, relating to the para - 2 under caption Allocation of Quarters & Recovery of Rent.
a. Key officers serving m peripheral atyas are generally provided with residential facilities. Particularly they are provided with rent free quartets if the area has scarcity for housing stock.
b. Officer below the rank of secretaries who are serving in the peripheral areas ie Govt.
Agent, Divisional Secretaries and certain sector Head of Departments are provided with
rent free quarters,

c. Trincomalee is one such area where housing is not easy. _
Considering the above situation, in order to attract and retain able servmg officers the then Board of Ministries decided to offer rent free quarters to the Secretaries.
Since the situation is very much same even now, I request your Honour to consider maintaining the statues-quo.
