We’ve already discussed the relevant opinions and arguments of both parties regarding this issue.
Obviously, it is the best interest of the public that the DOH took into consideration in implementing this
administrative order. On the other hand, it is nothing but a threat to the fast growing
food/dietary/herbal industry for the manufacturers.

As we have learned in other areas of the law, every right is subject to the limitations, rules and
regulations imposed by the state for the purpose of protecting the rights of others and making sure that
it is in accordance with our commitment to morals and public policy.

No doubt, everyone who enters into the world of business has the right to make profit or to returns of
investment, it is every businessman’s purpose. But again, it’s not just about making money. There is a
greater responsibility behind it, and that is to make sure that the consumers get what they deserve out
of what they pay. It may sound too ideal but what is ideal in this issue is what is just and ought to be
done.

We do recognize and appreciate the courage of Former Secretary Cabral in coming up with this law. We
find no other intention but to protect and promote the welfare of the consumers. On the other hand,
we do not question the stand of the industry regarding this matter, it is their right to take necessary
measures to protect their investments. We even recognize their role in the economy by contributing to
the employment rate of the country. But more than anything, we believe that the issue must be
resolved in favor of the public who deserves the right to protection against any abuses and misleading
information for them to be able to exercise a sound choice.
