Sir:

I am the accused-appellant in the case People of the


Philippines vs. Roscelin Espejo y Garcia, G.R. No. 187739. I
was sentenced to life imprisonment for alleged violation of
R.A. 9165.

My appeal was dismissed by the Third Division of the


Supreme Court per resolution of the Court dated 20 January
2010, which resolution was quoted in the letter sent to me
by Clerk of Court Lucita Abjelina-Soriano. My appeal was
dismissed prior to the receipt of the Court of my appellant’s
brief. Thereafter, my motion for reconsideration was denied
with finality per resolution of the Court dated 26 April 2010,
which resolution was also quoted in the letter of the Clerk of
Court. The letters of the Clerk of Court are hereto attached
as Annex A and B for your ready reference.

As the resolutions of the Court were merely mentioned and


quoted in the letters of the Clerk of Court, I sent a letter
dated October 26, 2010 addressed to the Clerk of Court
requesting for actual copies of the resolutions dated 20
January 2010 and 26 April 2010. I was informed that they
could not give me copies for the reason that there were no
actual written resolutions signed by the Justices in their
record.

In this regard, may I respectfully request you to confirm if


indeed there were these resolutions of the Third Division
dated 20 January 2010 and 26 April 2010 and which you
have participated into and signed thereafter?

I hope that you will give this matter your preferential


attention as I am detained and I was denied of my
constitutional right to due process of law when the Third
Division dismissed my appeal even before the Court received
my appellant’s brief.
