Case Manager Harry Moore submitted recommendations to the Court on visitation which would modify the Court's ‘November 24, 1999, Order. In the November, 1999, Order, unsupervised visitation was scheduled on Saturdays and Wednesdays for Mr. Richardson, Overnight visits were not scheduled. Christmas and New Years holidays for 1999 were addressed. Mr. Moore has now recommended alternating weekend visitation beginning Friday evening and ending Sunday evening. The proposed holiday schedule would be in accordance with the Shawnee County Family Law Guidelines. He recommended three weeks of summer visitation. Mr. Moore’s recommendations would eliminate Wednesday evening visitation, Mr, Moore reported that Mr. Richardson was developing a positive relationship with Rikki and that Ms. Dombrowski recognized that the father/daughter relationship was 2 positive relationship. The Case Manager also made other recommendations regarding Ms. Dombrowski's residence. restraining orders and financial issues. On March 27. 2000. Mr. Richardson filed his Objection to Case Manager Recommendations. The Objections are not specific. Mr. Richardson alleges that the Case ‘Manager did not fully take into account Rikki’s best interest and that the recommendations are inconsistent with the “well-developed Court Order.” Then, on April 17, 2000, Mr. Richardson Donald R. Hoffman Rebecca A. King Page 2 May 12. 2000 filed a Motion to Change Residential Custody. His primary complaint is that Ms. Dombrowski remains out of compliance with the Court’s June 28, 1999 Order requiring her to relocate to Topeka, Kansas. Mr. Moore has pointed out in his April 18, 2000 correspondence that a dispute over change of custody has not been presented to him and is thus, premature. On April 26, 2000, Ms. Dombrowski responded with a Motion to Dismiss Petitioner's Motion to Change Residential Custody. Also, on April 26, 2000, Ms. Dombrowski requested a Pretrial Conference noting that two motions had been scheduled before the Court on June 8, 2000. Those matters were Mr. Richardson's Motion to Change Residential Custody and Mr. Richardson's Objection to Case Manager Recommendations. Ms. Dombrowski requested a Pretrial Conference to address pretrial matters. Ms. Dombrowski's Motion for Pretrial Conference was scheduled for hearing on the Court’s Motion Docket May 25, 2000, at 11:00 a.m. I have now been informed that there are some scheduling conflicts that need to be considered to accommodate counsel In reviewing this matter, the Court will make the following rulings: 1 Mr. Richardson's Motion to Change Residential Custody filed April 17, 2000 (Motion #46) is dismissed as premature. This case is in case management. The parties have not addressed Mr, Richardson's request for change of residential custody with the Case Manager. The Court will not entertain any Motion to Change Residential Custody prior to consideration of all relevant factors by the Case Manager 2, Ms. Dombrowski"s Motion to Dismiss Petitioner’ s Motion to Change Residential Custody (Motion #47) is denied as moot 3, Ms, Dombrowski’s Motion for Pretrial Conference filed April 26, 2000 (Motion #48) is denied as moot. The Motion for Change of Custody is premature. There will be no evidentiary hearing relative to a custody change until the matter is properly processed through ‘case management. Donald R.
