REOUEST FOR REVIEW OF CASE MANAGER RECOMMENDATIONS

COMES NOW Claudine Dombrowski and pursuant to K.S.A. 23-1003(d)(6)

shows the Court as follows:

I. The responses and objections to the Case Manager Recommendation of 30

October 2001 which is contained in Case Manager's 22 October 2001

letter is responded to as follows:

a. Paragraph 1 of 22 October 2001 letter. Ms. Dombrowski does not

withdraw her Motion for Change of Custody. However, she, in the

alternative, is seeking unsupervised visitation. The remainder of that

paragraph deals with a website which should not have been addressed

in any way in the Case Manager's Recommendations in that it is not

relevant to the proceedings.

b. The second paragraph deals with comments which are prejudicial to Ms. Dombrowski and should not have been addressed in any recommendations.

c. The third paragraph dealing with comments about Leonard M.

Robinson or his client advocate any kind of threats of violence or otherwise and the matter has been discussed.

2. Pictures of both Rikki and Ms. Dombrowski have been previously provided to Mr. Harry Moore and to Don Hoffman. Copies of those photos are attached hereto and marked Exhibit A.

3. The case manager indicates that he cannot agree to change of custody and being candid with the Court, Ms. Dombrowski, although not withdrawing her Motion for Change of Custody, and not waiving any of the claims contained in her Motion or any evidence which would support the same and the use of that in the future, she indicates through counsel that she would not make objection to the case manager's recommendation for unsupervised visitation rather than change of custody under the following conditions set out in her paragraphs numbered I through 5. Paragraphs IS corresponding with the Case Manager's Recommendations set out in his paragraphs numbered 1 through 5:

a. Attached hereto is a letter dated September 18, 2001 from Bonnie Uffinan, Ph.D., Outpatient Therapist with Pawnee Mental Health Services and her Intake Evaluation of Claudine Dombrowski. (Both attached and cumulatively marked Exhibit B) As can be seen in the

evaluation, Page 2, "there is no evidence of suicidal or homicidal ideation or plan." Ms. Dombrowski continues to be in therapy with Bonnie Uffman, Ph.D. and sees her weekly and it would be counterproductive to have the Court choose some other person to do such an evaluation.

b. Case Manager recommends that Ms. Dombrowski agree to never again summon the electronic or print media to visitation exchanges. That is a reasonable recommendation and request and Claudine Dombrowski agrees to the same.

c. The Case Manager recommends that Ms. Dombrowski agree that under no condition will she ever remove Rikki from the State of Kansas without prior Court approval. That is a reasonable recommendation and request and Claudine Dombrowski agrees to the

same.

d. The presence and behavior of Ms. Betty Stumpf has been apparently very aggravating towards the Case Manager. However, the Case Manager does not indicate nor is there any evidence that her relationship with the minor child, Rikki, is anything other than that of a loving grandmother and, thus, Claudine Dombrowski objects to the recommendation that the maternal grandmother and Rikki not have any visitation. It should be noted there are people in this world who have contempt for both the court and other establishments or people who aside from that have appropriate relationships with their families.

e. Further recommendations should be made that Rikki commence

counseling and that the Court enforce its Order of October 29, 1997

wherein the Court ordered at page 6, paragraph H. Both parties were

directed to complete anger management classes and Claudine

Dombrowski has done so and the petitioner, Hal Richardson, has not.

Dear Mr. Robinson:

This is to confirm that I met with Claudine Dombrowski on August 23, 2001 for evaluation and have seen her for four subsequent psychotherapy sessions. The major stressor with which Ms. Dombrowski is attempting to cope, is related to the custody of her daughter Rikki. Ms. Dombrowski is distressed that Rikki is living with her father, a man with a history of perpetrating domestic violence. Ms. Dombrowski is therefore, very concemed about her daughter's welfare.

I have no reason to believe that Ms. Dombrowski is not a loving and competent parent, who wants what is best for her daughter. Ms. Dombrowski's anxiety and depression appear to be situational, a normal response to a distressing situation.

IDENTIFYING DATA:

The client is a thirty-six year old married Caucasian female. She shares a home in Manhattan with her husband. She is not currently employed.

REFERRAL SOURCE AND REASON FOR REFERRAL:

The client is self-referred. She states that she that she is a victim of domestic violence and that her child is in the custody of the abuser.

PRESENTING PROBLEM:

The client reports that she is here for support as she faces custody issues of her six-year-old daughter. The client reports that since December of last year her six-year-old daughter has been in the custody of her daughter's father. The client reports that this father has been abusive both to the client and to the child. The client reports that she is allowed only two one-hour supervised visits per week with her daughter. She states that this is the result because she reported her rape and battery to the police when she had been ordered by the authorities not to contact them for any reason. The client is very concerned about the current safety of her daughter. The client believes that her ex-husband's only reason in maintaining custody of their child is because he wants to punish her, the client.

BACKGROUND INFORMATION:

Family Configuration and DataiEarly Development: The client reports having grown up in western Kansas with her mother, step-father, two younger sisters, and one younger brother. She states that her mother and stepfather married when the client was four years of age. The client did not meet her biological father until she was eighteen years of age. The client describes her family life as having been "pretty much fun." She reports that the only exception to this was a one year period when she was in foster placement.

Educational History: The client completed high school in 1983 in Topeka, Kansas. She states that she has been in and out of the military for the past nine years and that during her years ~g the

military she completed a LPN (License Practical Nurse) certification. " Y'

Employment Histoxy: The client reports a total of approximately thirteen years of employment as a psychiatric LPN. She has worked at Larned State Hospital, Topeka State Hospital, and the VA Psychiatric Unit. She was employed at Larned State Hospital until approximately one year ago.

Medical Histoxy: The client lists Dr. David Jones of St. Marys, Kansas as her primary care physician. She states that she has known him for a number of years. The client reports having had a head-on collision with a school bus on ice in January of 1999. She reports that her most serious injury at that time was a crushed foot and she reports that she experiences residual disability as a result of this. She is able to be on her foot for a maximum of one-and-a-half hours per day at this time. The client's medications include Klonopin, one milligram up to four times daily; Serzone, 200 mg BID; Prilosec; Halcion, .25 mg which she takes as needed for sleep. The client lists her general health as being good; however, she describes her appetite, sleep, and energy level as poor.

Alcohol and Drug Histoxy: The client reports that she uses wine approximately twice a week. She denies any usage of illicit drugs. She denies any history of abuse of alcohol or other drugs.

Legal History: Denied.

Treatment Histoxy: The client reports having seen a therapist in the mental health center in Great Bend for several years. She states that she sought counseling in order to cope with issues of domestic violence.

DatingIMarital History: The client first married at age twenty-four. This marriage lasted for five years. She states that it ended amicably as a result of she and her husband having different goals. Subsequent to this, the client met her second husband and they married when their daughter was ten months of age. The client states that this was an abusive relationship from the time that she was four months pregnant. She states that she married her daughter's father only so that she would be able to get her daughter back from the daughter's father. She states that she and her husband did not live together for more than several days past their marriage date.

Histoxy of Aggression Toward Sel£'Others: Denied.

MENTALSTATUSS~Y:

The client was alert and oriented in all three spheres. Her affect was dysphoric, congruent with her described mood. The client's intellectual functioning appears to be average to perhaps above average. She displays no impairment of either recent or remote memory. Her thought, sensory and perceptual processes are all within normal limits. The client's judgment and insight appear to be adequate. There is no evidence of a suicidal or homicidal ideation or plan.

Residual Disability from a car accident in 1999 according to client report. Psychosocial Stressors:Client reports having survived and left an abusive relationship and is now distressed that her child is in the custody of the abuser. This is of course a severe stressor.

RECOMMENDATIONS:

Psychotherapy with the undersigned is recommended. A psychiatric evaluation to evaluate the client's psychotropic medications is also recommended.

PROGNOSIS:

The prognosis depends greatly upon the outcome of the client's current legal battles to regain custody of her daughter.
