Constitutional law- to effect equilibrium between authority and liberty so that rights are exercised

within the framework of the law.

Constitution- according to cooly “that body of ruls and maxims in accordance with the powers of
sovereignty are habitually exercised.

Purpose of the constitution- to prescribe the permanent framework of a system of government, to


assign to the serveral department their respective powers and duties and to establish certain first fixed
principles on which government in founded.

Parts of constitution-

Liberty-civil and political rights of citizens/ imposing limitation on the powers of the government

Government-power of the government/rules on its administration and defining electorate.

Sovereignty- mode or procedure in accordance with whcih formal changes in th fundamental law may
be brought about.

The fundamental power of the state:

Police power – lies in the descrtion of the legislative department.

The interest of the public generally, as distinguished from those of a particular class require the
exercise of the police power.

The means employed are reasonable necessary for the accomplishment of the purpose and not
unduly oppressive upon individuals.

The power of taxation

Right to due process

Equal protection clause

Unreasonable search and seizures

Freedom of expression

The impairment clause
