GUIDELINES ON PETITIONS FOR CHANGE OF NAME/ CANCELLATION OR

CORRECTION OF ENTRIES IN THE CIVIL REGISTRY

2. Rule 108 – Cancellation or correction of entries in the Civil Registry

Venue: RTC of the province or city in which the person whose name is sought to be
changed resides shall be the venue of the petitions for change of name and
cancellation or correction of entries in the civil registry.

For a publication for a change of name to be valid, the title thereof should include,
first, petitioner’s real name, and second his aliases, if any.

3. In petitions for cancellation or correction of entries in the Civil registry, the OSG
appears, as counsel for the Republic.

4. Section3 of Rule 108 thereof requires that the Civil Registrar and all persons who
have or claim any interest which may be affected thereby shall be made parties to
the proceedings.

5. Petitioner’s failure to implead the civil registrar as an indispensable party and/or


to give notice by publication of the petition of the petition for correction of entry
renders the proceedings of the trial court null and void for lack of jurisdiction both
as to the party and as to the subject matter.
