SUMMARY OF EVIDENCE

IN THE CASE OF
NO. 15747 P.C. SMITH
VERSES
KESTER JAMES
FOR THE OFFENCE
OF
BURGLARY, MALICIOUS WOUNDING & ASSAULT BY BEATING

On the night of Friday 8th August 2009 at 3:30 am at Arnos Vale Road
Woodlands Moriah, the virtual complainant Carlotta Fordyce; secured all of
the doors and windows to her home and retired to bed, along with her friend
Trenton Small. Around 4:00am they were both awoken by the sound of a loud
banging on the front door, which was quickly followed by the sound of
breaking glass, they both got up and the virtual complainant #1 turned on the
light in the bed room and tried to barricade the door and was over powered by
the defendant Kester James who entered her bedroom armed with a piece of
broken glass and proceeded to attack the virtual complainant #2 and stabbed
him in the face, and they began to struggle and was stabbed twice more by the
defendant in the back. The v.c.#1 was able to flee and ran into her neighbors
house who lives close by and was followed into the house by the defendant,
who was able to corner her in a room in that house and proceeded to cuff and
kick her about her body violently. The defendant was then subdued by the
members of the house thus allowing the v.c.#1 to escape and both virtual
complainants were able to make their way to the Moriah Police Station, where
they both made a report, and with the assistance of the complainant and other
officers were both taken to the Scarborough Regional Hospital for treatment,
which they both received and later discharged. Whilst at the said hospital, the
defendant was pointed out to the complainant by, who was approached by the
complainant, who identified himself to the defendant by the means of his
Trinidad and Tobago Police I.D. Card and told him of the report that he was
investigating cautioned him and he remained silent. He was then arrested,
cautioned told of his rights and privileges and he made no reply of requests,
taken to the Moriah Police Station where he was processed and brought to
court to answer the charges preferred against him
