DSK: Dubious Timing Accusing Ken Thompson of Talking with DSK Defense Lawyers by Anna Silva 08-19-2011

I scanned the DSK (Dominique Strauss-Kahn) news this morning from the Daily Beast and Wall Street Journal the 2 news source claim today's headline news is leaked by the Manhattan prosecutors office regarding the secret "monetary" talk between Nafi Diallo's lawyer Ken Thompson & DSK defense lawyers Ben Brafman & William Taylor. I smell something fishy coming from the DSK camp or the DSK well-paid allies or both. The timing of this news leak by the Manhattan prosecutors office to the Daily Beast and Wall Street Journal is very suspicious (2 business days before the Aug 23 court date). It doesn't smell like what attorneys with normal IQ or above-average IQ would do. If DSK defense lawyers (Ben Brafman & William Taylor) truly had "monetary" settlement talk with Nafi Diallo's lawyer Ken Thompson in mid-June, why didn't Ben Brafman and William Taylor come forward in early July to the Manhattan prosecutors about their secret "monetary" settlement talk with Ken Thompson in mid-June? After all, in early July, Brafman & Taylor had the upper hand to pressure the Manhattan DA office to make the DSK criminal case disappear with much less controversies and much stronger conviction as people were still digesting the news. Because in early July, American were busy eating BBQ food, watching fireworks and going to the beach. If Brafman & Taylor presented the evidence of the "monetary" settlement talk from the get-go in early July, the Manhattan DA office could have gone along with DSK defense lawyers to make the criminal case disappear without attracting much attention from American enjoying their Independence Day celebration. Why did Brafman & Taylor waited more than 2 months to come forward with their alleged secret "monetary" talk with Ken Thompson? Although I'm not a lawyer, whatever happens to the "Discovery process" in court whereby both the prosecutors and the defense attorneys turn over information they have as soon as they become aware of the information? I think the defense attorneys have equal responsibilities to surrender any information to the prosecutors as soon as the defense lawyers become aware of the information. Can this alleged major delay (more than 2 months delay) in turning over information (if the secret "money" talk does exist) be construed as attorney professional misconduct? Or can we (ordinary New Yorkers on the street) call them something else? The timing of today's headline news leak is very suspicious. To an ordinary New Yorker like me, this smells like desperate attempt by the DSK camp and the DSK well-paid allies to spread false news and allegations, their last ditch attempt to have the DSK criminal case go away, and then by default after their planned criminal case dismissal, then the DSK camp want the civil case to go away also. The DSK defense lawyers are well-aware that their client DSK wants complete, 100% exoneration, that he's not willing to make any plea bargain with the prosecutors to lesser charges. And, the DSK defense team cannot use the prostitute defense to accuse Nafi Diallo because then, DSK will be found guilty of NY Penal Law Section 230 Patronizing a Prostitute. The DSK defense lawyers also realize the hotel encounter was too brief, raising doubts about the encounter being "consensual". The strong forensics, DNA and medical reports all point to potential problems for the DSK defense lawyers to overcome. The DSK defense lawyers need to do extra work to convince NY jury about these CSI-type of reports. To me and other fellow New Yorkers, the best thing is for the NY jury in Criminal Court examine and weigh in on all the evidences in the DSK case. American hate dishonesty, and want transparency. We are taught that our founding father George Washington was an honest man, we are brought up in school to value and treasure honesty and by extension, transparency. The more you hide something behind the veil, the more frustrated and angry American become, believing that you're a liar hiding behind the secret veil. The best thing to do is to lift up the veil (eg. gather and spread out all evidence in DSK criminal case for the NY Jury in Criminal Court to examine & decide). Let American (eg. NY Jury in Criminal Court) decide whether DSK, or Nafi Diallo is more truthful. This DSK case must be tried in Criminal Court. The Manhattan DA office must set good example, let the minority immigrants in NYC know that the Manhattan DA office fight as hard for a poor African immigrant (Nafi Diallo), as they did for the Caucasian female Wall Street Banker (the famous Central Park jogger rape case).
