Brief Chronology:
1) The Supreme Court decided to conduct the proceedings in Katzav v State of
Israel in open doors.
2) No access was provided in the online public access system to papers filed by
parties in the Appeal. However, initially, the list of records (docket), and the
Courts decisions (at times, redacted) were accessible to the public.
3) Starting in early August 2011, public access has been denied also to the list
records and the Courts decisions.
4) Therefore, request was filed with the Court, for access to the presumed Sealing
Order, and to the list of records in the case.
5) The September 5, 2011 Decision of the Court denied the request, stating that the
terms Sealing Order and List of Records were undefined and
incomprehensible.
6) Therefore, the September 20, 2011 Clarification attempted to better define these
two terms:
a. Sealing Order was defined as the presumed court paper, which is the
legal foundation for the fact that online public access to the records,
which is normally permitted in most cases, is denied in this case, and
instead the writing Sealed appears in the online system.
b. List of Records was defined as the electronic records, where online
public access is permitted in most cases, but in this case denied, and
instead the writing Sealed appears in the online system.
