fay POLICE CRIMINAL COMPLAINT AFFIDAVIT CONTINUATION PAGE Samer wars — ova ——yrscparateos nN | [cctr-oans I re oe aia autuowy | ep | SPARAR - AFFIDAVIT OF PROBABLE CAUSE CONTINUATION FACTS OF THIS INVESTIGATION: On November 10, 2021 Sergeant Anthony Sparano of the West Cain Police Department was on duly, in full uniform, operating a marked police vehicle, assigned to the patrol division of West Caln Township police department. At approximately 0029 hours, Sergeant Sparano observed a white Chrysler 300 sedan turn left agairst a Steady red light on Route 340 at Compass Road, West Cain Township, Chester County, Pennsylvania, At this time, Sergeant Sparano activated his lights and sirens and initiated a traffic stop on the 100 block of Octorara Trail Road. Sergeant Sparano approached the driver-side of the white Chrysler 300 and made contact with the Oriver of the vehicle, Takeshia Landry, Sergeant Sparano then requested Landry's driver's license and vehicle registration. Sergeant Sparano's body worn camera (BWC) was activated during the stop and recorded the entirety of the incident. During the traffic stop Landry was hclding a camera In her right hand that appeared to be recording the interaction. Sergeant Sparano repeatedly requested Landry's license and registration, but Landry refused to comply. The interaction between Sergeant Sparano and Landry bagan to escalate, At this time, Sergeant Sparano opened Ihe driver's door, in an apparent attempt to remove Landry from the vehicle. As this occurred, Landry began to drive away, As Landry was driving away, Sergeant Sparano fired one round {from his duty weapon al the vehicle, striking the rear driver's side window. The impact of the projectile caused glass to shatter into the interior passenger compartment of the vehicle. Landry was not struck and sustained 10 injuries. Sorgeant Sparano re-entered his patrol vehicle and a pursuit of Landry ensued for approximately two miles. The vehicle came to a stop on tho 700 block of Octorara Trai Road. Sergeant Sparano ordered Landry out of the vehicle. Landry explained to Sergeant Sparano that she was unable o comply due to being strapped into her seatbelt. Sergeant Sparano eventually removed Landry trom the vehicle and took her in to custody, As part of this investigation Your Alfiant, along with Chester County Detectives interviowed all responding officers and obtained all BWC and MVRs from their respective agencies. Landry was also photographed and interviewed, Review of Sergeant Sparano's mobile video recorder (MVR) and body worn camera (BWC), and other evidence showed that there was no imminent threat of death or bodily injury to Sergeant Sparano, or anyone else, during the incident.
