2a THE STATUS, TASKS, FUNCTIONS, ORGANIZATIONAL STRUCTURES AND WORKING ARRANGEMENTS OF STATE MINISTRIES OF THE REPUBLIC OF INDONESIA (Presidential Regulation No, 9/2005 dated January 31,2005) BY GRACE OF GOD THE ALMIGHTY, THE PRESIDENT OF THE REPUBLIC OF INDONESIA, Considering: In the framework of supporting the execution of ‘tasks of the United Indonesia Cabinet and better enhanc ing coordination as well as smoothing the implementa- tion of effective and efficient state administration, it is deemed necessary to stipulate the status, tasks, func- tions, organizational structures and working arrangements of state ministries of the Republic of Indonesia; In view of: 1. Article 4 paragraph (1) and Article 7 of the Constitu- tion of 1945 (BN NO. 7152 pages 14A - 23A); . Law No, 32/2004 on regional administration (Statute Book of 2004 No, 125, Supplement to Statute Book No. 4437); . Presidential Decree No. 187/M/2004 (BN No. 7128 pages 30A - 31A) as already amended by Presidential Decree No. 8/M/2005; DECIDES: To stipulate THE PRESIDENTIAL REGULATION ON THE STATUS, TASKS, FUNCTIONS, ORGANIZATIONAL STRUCTURES AND WORKING ARRANGEMENTS OF STATE MINISTRIES (OF THE REPUBLIC OF INDONESIA CHAPTER I FORMS OF STATE MINISTRIES OF ‘THE REPUBLIC OF INDONESIA Artide 1 ‘The state ministries of the Republic of Indonesia shall consist a. Coordinating Ministries; b. Ministries in the form of Departments, hereinafter called Departments; State Ministries G Business News 7184/9-3-2005 CHAPTER IL COORDINATING MINISTRIES Part One Status, Task and Function Article 2 (1)Coordinating Ministries shall be executive organs of the government. (2)Coordinating Ministries shall be led by Coordinating Ministers subordinate and responsible to the Presi- dent, Article 3 Coordinating Ministries shall be assigned to help the President coordinate the planning and formulation of policies as well as synchronizing the implementation of policies in the respective fields. Article 4 In executing the task as meant in Article 3, Co- ordinating Ministries shall function: a, to coordinate the planning and formulation of policies, in the respective fields; to synchronize the implementation of policies in the respective fields; to control the implementation of policies as meant in letters a and b; to manage state property/assets becoming their re- spective responsibilty; to supervise the execution of the respective tasks; f. to execute certain tasks granted by the president; |. to convey report on results of evaluation, recommen- dations and considerations in the respective fields of tasks and functions to the President. b. Article 5 Coordinating Ministries shall consist of: Coordinating Ministry for Political, Legal and Security Affairs; Coordinating Ministry for Economic Affairs; Coordinating Ministry for People's Welfare. Part. Part Two Coordinating Ministry for Political, Legal and Security Affairs Article 6 ‘The Coordinating Ministry for Political, Legal and Security Affairs shall have the task of assisting the Presi- dent in coordinating the planning and formulation of poli- cies, as well as synchronizing the implementation of poli- ies in the pofitical, legal and security sector article 7 In executing the task as meant in Article 6, the Coordinating Ministry for Political, Legal and Security Af- fairs shall Function: 2. to coordinate the planning and formulation of policies, in the political, legat and security sector; b. to synchronize the implementation of policies in the political, legal and security sector; . to control the implementation of policies as meant in letters a and b; d. to manage state property/assets under responsibilty of the ministry; e. to supervise the execution of the tasks; to execute certain tasks assigned by the president; to convey report on results of evaluation, recommen- dations and considerations in the respective fields of tasks and functions to the President. Article 8 In executing the tasks and functions as meant in Articles 6 and 7, the Coordinating Ministry for Political, Legal and Security Sector shall coordinate: a, Home Affairs Department; Foreign Affairs Department; Defense Department; Law and Human Right Department; Attorney General Office; f. State Intelligence Board; Indonesian Military; |. Indonesian Police; i. Other institutions deemed necessary. Part Three Coordinating Ministry for Economic Affairs Article 9 The Coordinating Ministry for Economie Affalrs Business News 7184/9-3-2005 3A shall have the task of assisting the President in coordi- nating the planning and formulation of policies as well as synchronizing the implementation of policies in the eco- nomic sector. Article 10 Jn executing the task as meant in Article 9, the Coordinating Ministry for Economic Affairs shall function: 2. tocoordinate the planning and formulation of policies in the economic sector; to synchronize the implementation of policies in eco- nomic sector; to control the implementation of policies as meant in letters a and b; to manage state property/assets under responsibility of the ministry; to supervise the execution of the tasks; i, to execute certain tasks assigned by the president; j. to convey report on results of evaluation, recommen- dations and considerations in the respective fields of tasks and functions to the President, Article 11 Tn executing the tasks and functions as meant in Articles 9 and 10, the Coordinating Ministry for Economic Affairs shall coordinate: a. Finance Department; b. Energy and Mineral Resource Department; . Industry Department; 4d, Trade Department; . Agriculture Department; f. Forestry Department; g. Transportation Department; h. Marine and Fishery Department; |. Manpower and Transmigration Department; 4. Public Work Department; k. Communication and Information Department; |. State Ministry for Research and Technology; rm, State Ministry for Cooperatives and Small- and Me~ dium-scale Businesses; 1, State Ministry for Less Developed Region Develop- ment; ©, ‘State Ministry for Development Planning/National De- velopment Planning Board; p. State Ministry for State-owned Enterprises; q. Other institutions deemed necessary. Part. Part Four Coordinating Ministry for People's Welfare Article 12 ‘The Coordinating Ministry for People's Welfare shall have the task of assisting the President in coordi- nating the planning and formulation of policies as well as synchronizing the implementation of policies ia the people's welfare and poverty alleviation sector. Article 13 In executing the task as meant in Article 12, the Coordinating Ministry for Economic Affairs shall function: a. to coordinate the planning and formulation of policies in the people's welfare and poverty alleviation sec- tor; b. to synchronize the implementation of policies in the people's welfare and poverty alleviation sector; c. to control the implementation of policies as meant in letters a and b; 4, to manage state property/assets under responsibility of the ministry; e. to supervise the execution of the tasks; f. to execute certain tasks assigned by the president; g. to convey report on results of evaluation, recommen- dations and considerations in the respective fields of tasks and functions to the President. Article 14 In executing the tasks and functions as meant in Articles 12 and 13, the Coordinating Ministry for Eco- nomic Affairs shall coordinate: Health Department; National Education Department; Social Affairs Department; Religious Affairs Department; Culture and Tourism Department; State Ministry for Environmental Affairs; State Ministry for Women Empowerment; State Ministry for Enhancement of Efficiency of State Apparatuses; i. State Ministry for People's Housing; State Ministry for Youth and Sports; k. Other institutions deemed necessary. Part Five Organizational Structure Business News 7184/9-3-2005 Article 15 Every Coordinating Ministry shall be assisted by: 2. Secretariat of the Coordinating Ministry; b. Deputies; . Senior Advisors. Part Six Secretariat of Coordinating Ministry article 16 (1)The secretariat of the Coordinating Ministry shall be an auxiliary management organ subordinate and re- sponsible to Coordinating Minister. (2)The secretariat of the Coordinating Ministry shall be led by a secretary to the Coordinating Ministry. Article 17 ‘The secretariat of the Coordinating Ministry shall be assigned to coordinate the execution of tasks as well ‘as the fostering and provision of administrative support of the Coordinating Ministry. Article 18 In executing the task as meant in Article 17, the secretariat of the Coordinating Ministry shall function: to coordinate activities of the Coordinating Ministry; to perform the management of general administra- tion to support the smooth execution of tasks and functions of the Coordinating Ministry; ¢. to perform working relations in the administrative field with other coordinating ministries, state ministries, departments, non-department government institutions and other institutions concerned; d. to execute other tasks assigned by the coordinating minister. Article 19 (1) The secretariat of coordinating ministry shall consist of 2 (two) bureaus. (2)Every bureau shall consist of S (five) divisions at the maximum. (3)Every division shall consist of 3 (three) sub-divisions at the maximum, (4) Division
