The Court has considered the States Motion to Set Aside Order Vacating Judgment. The Court alerted Hearing Officer Carl Eckhardt to the motion. In conjunction with Hearing Officer Eckhardt, IT IS ORDERED vacating the 7/16/01 Order that vacated judgment and restored civil rights because the Defendant was convicted of an offense involving a gun, and therefore cannot have this judgment set aside, A.R.S. Section 13-907(B)(2).
