(11) prescribedmeansprescribedbyrules; (12) publicsecuritiesmeans (a)securitiesoftheCentralGovernmentoranyStateGovernment , (b) stocks, debentures or shares in Railway or other
public,religiousorcharitablepurposeorbothandincludesatemple,amath,a wakf, church, synagogue, agiaryorother place of public religious worship, a dharmadaoranyotherreligiousorcharitableendowmentandasocietyformed eitherforareligiousorcharitablepurposeorforbothandregisteredunderthe SocietiesRegistrationAct,1860. (14) Regionorsubregionmeanstheareasdesignatedassuchand forwhichaPublicTrustsRegistration Officehasbeenestablishedunderthis Act; (15) RulesmeansrulesmadeunderthisAct; (16) Deleted(ByBom.ActNo.39of1951); (17) Templemeansaplacebywhateverdesignationknownandused asaplaceofpublicreligiousworshipanddedicatedtoorforthebenefitofor
withotherpersons,thetrustpropertyisvestedandincludesamanager; (19) Wakf means a permanent dedication by a person professing Islamofanymovableorimmovablepropertyforanypurposerecognisedbythe MuslimLawaspious,religiousorcharitableandincludesawakfbyuserand grants(includingmashrutulkhidmat)foranypurposerecognisedbytheMuslim Lawaspious,religiousorcharitableandawakfallalauladtotheextenttowhich thepropertyisdedicatedforanypurposesorecognised;butdoesnotincludea wakfsuchasisdescribedinSection3oftheMussalmanWakfValidatingAct, 1913,underwhichanybenefitisforthetimebeingclaimableforhimselfbythe person by whom the wakf was created or by any member of his family or descendants; (20) Words and expressions used but not defined in this Act and definedintheIndianTrustsAct,1882,shallhavethemeaningassignedtothem inthatAct.

CHAPTERII ESTABLISHMENT
3.
CharityCommissioner:
TheStateGovernmentmay,bynotificationintheOfficialGazette,appoint
an Officer to be called the Charity Commissioner who shall exercise such powers and shall perform such duties and functions as are conferred by or undertheprovisionsofthisActand shall,subjecttosuch generalorspecial ordersastheStateGovernmentmaypass,superintendtheadministrationand carryouttheprovisionsofthisActthroughouttheState. 3A. (1) JointCharityCommissioner: TheStateGovernmentmay,bynotificationintheOfficialGazetteappoint oneormoreOfficerstobecalledJointCharityCommissionerswhoshall, subjecttothecontroloftheCharityCommissionerandtosuchgeneralor specialorders,astheStateGovernmentmaypass,exercisealloranyof the powers and perform all or any of the duties and functions, of the CharityCommissioner. (2) TheStateGovernmentmay,bygeneralorspecialorder,declareaJoint CharityCommissionertobetheregionalheadtosuperintend,subjectto the control of the Charity Commissioner, the administration in one or moreregionsorsubregions,asmaybespecifiedinsuchorder.
4.
QualificationsforappointmentofCharityCommissionerandJoint
CharityCommissioner: ApersontobeappointedastheCharityCommissioneroraJointCharity
thatofaDistrictJudgeoftheBombayCityCivilCourt,ortheChiefJudgeofthe PresidencySmallCausesCourt:
Providedthat,apersontobeappointedasaJointCharityCommissioner maybeonewhoisholdingorhasheldaJudicialOfficenotlowerinrankthan thatofanAssistantJudgeoranAdditionalChiefJudgeoftheCourtofSmall Causes, Bombay; or who has held the office of the Deputy Charity Commissionerfornotlessthanfiveyears,or (b) whohasbeenfornotlessthantenyears: (i)anadvocateenrolledundertheIndianBarCouncilsAct,1926 (38of1926)ortheAdvocatesAct,1961(25of1961); (ii)anattorneyofaHighCourt;or (iii) a pleader enrolled under the BombayPleaders Act,1920 (Bom.17of1920).

DeputyandAssistantCharityCommissioners: The State Government may also appoint such number of Deputy and
thatofaCivilJudge(SeniorDivision)oraJudgeoftheCourtofSmallCausesof Bombay or any office which in the opinion of the State Government is an equivalentoffice,or (b) whohasbeenfornotlessthaneightyears, (i)anadvocateenrolledundertheIndianBarCouncilsAct,1926 ortheAdvocatesAct,1961;
whohasheldtheofficeofanAssistantCharityCommissionerfor
notlessthanfiveyears; (2A) ApersontobeappointedasanAssistantCharityCommissioner shallbeaperson (a) whoisholdingorhasheldajudicialofficenotlowerinrank thanthatofaCivilJudge(JuniorDivision),fornotlessthan oneyear, (b) whohasbeenfornotlessthanfouryears, (i) anadvocateenrolledundertheIndianBarCouncils Act,1926(38of1926)ortheAdvocatesAct,1961 (25of1961); (ii) (iii) anattorneyofaHighCourt,or apleaderenrolledundertheBombayPleadersAct, 1920(Bom.17of1920),or (c) who holds a degree in Law of any University in India establishedbylaworanyotherUniversityrecognisedbythe State Government in this behalf and has worked in the CharityOrganisationafterobtainingsuchdegreefornotless than five years in an office not lower in rank of SuperintendentorLegalAssistant. (3) The Deputy and Assistant Charity Commissioners shall exercise such
powersandperformsuchdutiesandfunctionsasmaybeprovidedbyorunder theprovisionsofthisAct.
6.
SubordinateOfficers: For the purpose of carrying out the provisions of this Act, the State
Government may appoint the Director of Accounts and Assistant Director of Accounts possessing the prescribed qualifications, Inspectors and other subordinateofficersandassigntothemsuchpowers,dutiesandfunctionsunder thisAct,asmaybedeemednecessary: Provided that, the State Government may,bygeneral orspecial order andsubjecttosuchconditionsasitdeemsfittoimpose,delegatetotheCharity Commissioner,theJointCharityCommissionerandtheDeputyandAssistant CharityCommissioners,powerstoappointsubordinateofficersandservantsas maybespecifiedintheorder. 6A. Charity Commissioner and other officers to be servants of State
Government. TheCharityCommissioner,theJointCharityCommissioner;theDeputy
and Assistant Charity Commissioner, the Director of Accounts, the Assistant DirectorofAccounts,theInspectorsandothersubordinateofficersandservants appointedunderthisActshallbetheservantsoftheStateGovernmentandthey shalldrawtheirpayandallowancesfromtheConsolidatedFundoftheState. Theconditionsofserviceofsuchofficersshallbesuchasmaybedetermined bytheStateGovernment. 6B. Costofpay,pension,etc.,ofCharityCommissioneretc.,tobepaid
toGovernmentoutofthePublicTrustsAdministrationFund: There shall be paid everyyear out of the Public Trusts Administration
Fund to the State Government such cost as the State Government may determineonaccountofthepay,pension,leaveandotherallowancesofthe

Charity Commissioner, the Joint Charity Commissioner, the Deputy and Assistant Charity Commissioners, the Director of Accounts, the Assistant DirectorofAccounts,theInspectorsandothersubordinateofficersandservants appointedunderthisAct. 7.AssessorsDeletedbyMah.22of1967 8.Delegations: (1) The State Government may delegate any of its own powers or functionsunderthisActtotheCharityCommissioneroranyother officersubjecttosuchconditionsasitthinksfit. (2) The State Government may also direct that any powers exercisable and duties or functions to be performed by any particular officer appointed under this Act may be performed by anyotherofficersubjecttosuchconditionsasitthinksfit.

(3A)provisionforfacilitiesforrecreationorotherleisuretimeoccupation (including assistance for such provision), if the facilities are provided in the interestofsocialwelfareandpublicbenefit,and (4) theadvancementofanyotherobjectofgeneralpublicutility,but
The requirement of this section that the facilities are provided in the
interestofsocialwelfareshallnotbetreatedassatisfied,unless a) the facilities are provided with the object of improving the conditions of life for the persons for whom the facilities are primarilyintended;and b) either (i) thosepersonshaveneedofsuchfacilitiesasaforesaid byreason oftheiryouth,age,infirmityordisablement, povertyorsocialandeconomiccircumstances,or (ii) thefacilitiesaretobeavailabletothemembersofthe publicatlarge. (3) Subjecttothesaidrequirement, subregion (1)ofthissectionappliesin
particular to the provision offacilitiesat village halls,community centres and women institutes, and to the provision and maintenance of grounds and buildingstobeusedforpurposesofrecreationandleisuretimeoccupation,and extendstotheprovisionoffacilitiesforthosepurposesbytheorganizingofany suchactivity. 10. PublicTrustnottobevoidongroundofuncertainty:

Notwithstandinganylaw,customorusage,apublictrustshallnotbevoid

PublicTrustnottovoidongroundthatitisvoidfornoncharitable
ornonreligiouspurpose: A public trust created for purposes some of which are charitable or

religious nature or for the benefit of a society or institution constituted for a charitableorreligiouspurpose,suchtrustshallnotbedeemedtobevoidonly ontheground

(a)
that the performance of the specific object for which the trustwascreatedhasbecomeimpossibleorimpracticable, or
(b)
thatthesocietyorinstitutiondoesnotexistorhasceased toexist,notwithstandingthefactthattherewasnointent for the appropriation of the trust property for a general charitableorreligiouspurpose.
CHAPTERIV REGISTRATIONOFPUBLICTRUSTS 14. Regionsandsubregions: (1) For the purposes of this Act, the State Government may form
withthelimitsthereofanyeveryalterationofsuchlimitsshallbenotifiedinthe OfficialGazette.

PublicTrustsRegistrationOffice: IneveryregionorsubregionthereshallbeaPublicTrustsRegistration

StateGovernmentmaysetupofficesinallthedistrictsunderanyregionorsub region.
16.
DeputyorAssistantCharityCommissionertobeinchargeofPublic
TrustsRegistrationOffice: TheStateGovernmentmayappointaDeputyCharityCommissioneror
AssistantCharityCommissionertobeinchargeofoneormorePublicTrusts RegistrationOfficesorJointPublicTrustsRegistrationOffices.
17.
Registration Offices, it shall be the duty of the Deputy or Assistant Charity Commissionerinchargetokeepandmaintainsuchbooks,indicesandother registersasmaybeprescribed.Suchbooks,indicesandregistersshallcontain suchparticularsasmayalsobeprescribed.
18. (1)
Registrationofpublictrusts: ItshallbethedutyofthetrusteeofapublictrusttowhichthisActhas
beenappliedtomakeanapplicationfortheregistrationofthepublictrust.

(2)
Commissioneroftheregionor subregion withinthelimitsofwhichthetrustee hasanofficefortheadministrationofthetrustorthetrustpropertyorsubstantial portionofthetrustpropertyissituated,asthecasemaybe. (3) Such application shall be in writing, shall be in such form and
accompaniedbysuchfeeasmaybeprescribed. (4) Suchapplicationshall (a) inthecaseofapublictrustcreatedbeforethisActwasappliedto it,bemade,withinthreemonthsfromthedateoftheapplicationof thisAct,and (b) inthecaseofapublictrustcreatedafterthisActcomesintoforce, withinthreemonthsofitscreation. (5) Suchapplicationshallinteraliacontainthefollowingparticulars (ai) the designation by which the public trust is or shall be known (hereinafterreferredtoasthenameofthepublictrust), (i) thenamesandaddressesofthetrusteesandthe
manager, (ii) (iii) themodeofsuccessiontotheofficeofthetrustee, the listofthe movable and immovable trustproperty and such description and particulars as may be sufficient for the identificationthereof, (iv) (v) theapproximatevalueofthemovableandimmovableproperty, thegrossaverageannualincomeofthetrustpropertyestimated ontheincomeofthreeyearsimmediatelyprecedingthedateon

whichtheapplicationismadeoroftheperiodwhichhaselapsed sincethecreationofthetrust,whicheverperiodisshorter, (vi) theamountoftheaverageannualexpenditureinconnectionwith suchpublictrustestimatedortheexpenditureincurredwithinthe periodtowhichtheparticularsunderclause(v)relate. (vii) theaddresstowhichanycommunicationtothetrusteeormanager inconnectionwiththepublictrustmaybesent, (viii) suchotherparticularswhichmaybeprescribed. Providedthat,therulesmayprovidethatinthecaseofanyor
all public trusts it shall not be necessary to give the particulars of the trust propertyofsuchvalueandsuchkindasmaybespecifiedtherein. (6) Everyapplicationmadeundersubsection(1)shallbesignedandverified
intheprescribedmannerbythetrusteeorhisagentspeciallyauthorizedbyhim inthisbehalf.Itshallbeaccompaniedbyacopyofaninstrumentoftrust,ifsuch instrumenthadbeenexecutedandisinexistence. (6A) Whereonreceiptofsuchapplication,itisnoticedthattheapplicationis incompleteinanyparticulars,ordoesnotdisclosefullparticularsofthepublic trust,theDeputyorAssistantCharityCommissionermayreturntheapplication tothetrustee,anddirectthetrusteetocompletetheapplicationinallparticulars or disclose therein the full particulars of the trust, and resubmit it within the period specified in such direction; and it shall be the duty of the trustee to complywiththedirection. (7) It shall also be the duty of the trustee of the public trust to send a
memorandum in the prescribed form containing the particulars, including the nameanddescriptionofthepublictrust,relatingtotheimmovablepropertyof

Inquiryforregistration: Onthereceiptofanapplicationundersection18,orupononapplication
madebyanypersonhavinginterestinapublictrustoronhisownmotion,the Deputy or Assistant Charity Commissioner shall make an inquiry in the prescribedmannerforthepurposeofascertaining: (i) (ii) (iii) whetheratrustexistsandwhethersuchtrustisapublictrust, whetheranypropertyisthepropertyofsuchtrust, whetherthewholeoranysubstantialportionofthesubjectmatter ofthetrustissituatewithinhisjurisdiction, (iv) the namesand addresses ofthe trustees and manager ofsuch trust, (v) (vi) (vii) themodeofsuccessiontotheofficeofthetrusteeofsuchtrust, theorigin,natureandobjectofsuchtrust, the amountofgrossaverage annual incomeand expenditure of suchtrust,and (viii) anyotherparticularsasmaybeprescribedundersubsection5of section18.

FindingsofDeputyorAssistantCharityCommissioners: OncompletionoftheinquiryprovidedforunderSection19,theDeputyor
Assistant Charity Commissioner shall record his findings with the reasons thereforeastothemattersmentionedinthesaidsection,andmaymakean orderforthepaymentoftheregistrationfee. 21. (1) Entriesinregister: The Deputy or Assistant Charity Commissioner shall make entries in
registerkeptundersection17inaccordancewiththefindingsrecordedbyhim undersection20orifappealsorapplicationsaremadeasprovidedbythisAct, inaccordancewiththefinaldecisionofthecompetentauthorityprovidedbythis Act. (2) The entries so made shall, subject to the provisions of this Act and
subject to any change recorded under the following provisions, be final and conclusive.
22. (1)
Change: Whereanychangeoccursinanyoftheentriesrecordedintheregister
keptunder section 17, the trustee shall,within90 daysfrom the date ofthe occurrenceofsuchchange,orwhereanychangeisdesiredinsuchentriesin the interest of the administration of such public trust, report such change or proposedchangetotheDeputyorAssistantCharityCommissionerinchargeof thePublicTrustsRegistrationOfficewheretheregisteriskept.Suchreportshall bemadeintheprescribedform. (1A) Wherethechangetobereportedundersubsection(1)relatesto any immovable property, the trustee shall, along with the report, furnish a

memorandum in the prescribed form containing the particulars (including the name and description of, the public trust) relating to any change in the immovablepropertyofsuchpublictrust,forforwardingittotheSubRegistrar referredtoinsubsection(7)ofSection18. Suchmemorandumshallbesignedandverifiedintheprescribedmanner bythetrusteeorhisagentspeciallyauthorizedbyhiminthisbehalf. (2) Forthepurposeofverifyingthecorrectnessoftheentriesinthe
be, after receiving a report under subsection (1) and holding an inquiry, if necessary,under subsection (2),ormerelyafterholdinganinquiryunderthe saidsubsection(2),issatisfiedthatachangehasoccurredinanyoftheentries recordedintheregisterkeptundersection17inregardtoaparticularpublic trust,or that the trustshould be removed from the register byreason ofthe change,resultinginboththeofficeoftheadministrationofthe trustandthe wholeofthetrustpropertyceasingtobesituatedintheState,heshallrecorda findingwiththereasonsthereforetothateffectandifheisnotsosatisfiedhe shallrecordafindingwithreasonsthereforeaccordingly.Anysuchfindingshall be appealable tothe CharityCommissioner. The Deputyor Assistant Charity Commissioner shall amend or delete the entries in the said register in accordancewiththefindingwhichrequiresanamendmentordeletionofentries andifappealsorapplicationsweremadeagainstsuchfinding,inaccordance with the final decision of the competent authority provided by this Act. The

amendments in the entries so made subject to any further amendment on occurrence of a change or any cancellation of entries, shall be final and conclusive. (4) Wheneveranentryisamendedorthetrustisremoved,fromtheregister
under subsection (3),the Deputy or Assistant CharityCommissioner, as the casemaybe,shallforwardthememorandumfurnishedtohimundersubsection (1A), after certifying the amended entry or the removal of the trust from the register,tothesubregisterreferredtoin subsection (7)orsection18forthe purposeoffilinginBookNo.Iundersection18oftheIndianRegistrationAct, 1908,initsapplicationtotheStateofMaharashtra.
22or28,itappearstotheDeputyor AssistantCharityCommissioner thatany particularrelatingtoanypublictrust,whichwasnotthesubjectmatterofthe inquiryundersection19or subsection (3)ofsection22orsection28asthe casemaybe,hasremainedtobeenquiredinto,theDeputyorAssistantCharity Commissioner,asthecasemaybe,maymake,furtherinquiryintheprescribed manner,recordhismake,furtherinquiryintheprescribedfindingsandmake entriesintheregisterinaccordancewiththedecisionarrivedatorifappealsor applicationsaremadeasprovidedbythisAct,inaccordancewiththedecision ofthecompetentauthorityprovidedbythisAct.Theprovisionsofsection19,20, 21and22shall,sofarasmaybe,applytotheinquiry,therecordingoffindings andthemakingofentriesintheregisterunderthissection.

undersection18andsuchapplicationwaspendingonthesaiddate, thetrusteeofsuchpublictrustshallwithinthreemonthsfromthesaid datemakeanapplicationinwritingforregistrationofthepropertyofthepublic trustinthenameofsuchtrustandshallstateintheapplicationthenameofthe publictrust. (2) Such application shall be signed and verified in the prescribed
mannerbythetrusteeorhisagentspeciallyauthorizedbyhiminthisbehalfand made tothe Deputy or Assistant CharityCommissioner who made entries in respectofsuchpublictrustintheregisterkeptundersection17orwithwhom theapplicationforregistrationofthepublictrustwaspending,asthecasemay be. (3) On receipt of such application, the Deputy or Assistant Charity
Commissionershall a) in the case of a public trust which is deemed to have been registeredundersection28,orwhichhasbeenregisteredunder

thisActbeforethesaiddatespecifythenameofthepublictrust against the entries made in respectofsuch trustin the register keptundersection17,and b) inthecaseofapublictrusttheapplicationforregistrationofwhich waspendingonthesaiddatespecifythenameofthepublictrust atthetimeofmakingentriesundersection21inrespectofsuch publictrustintheregisterkeptundersection17.
a) whichisdeemedtohavebeenregisteredunderthisActundersection28 readwithScheduleA,or b) whichhasbeenregisteredunderthisActbeforethecomingintoforceof theBombayPublicTrusts(Amendment)Act,1955(hereinafterreferred toasthesaiddate)onanapplicationmadeundersection18,or c) inrespectofwhichanapplicationhasbeenmadeundersection18and suchapplicationwaspendingonthesaiddate, thetrusteeofsuchpublictrustshallwithinthreemonthsfromthesaiddatesend amemorandumintheprescribedformcontainingtheparticulars,includingthe nameanddescriptionofthepublictrust,relatingtotheimmovablepropertyof suchpublictrusttotheofficersspecifiedinsubsection(7)ofsection18orthe purposeoffilinginBookNo.Iundersection89oftheIndianRegistrationAct, 1908,initsapplicationtotheStateofMaharashtra.

Suchmemorandumshallbesignedandverifiedintheprescribedmanner

Procedurewheretrustpropertyissituateinseveralregionsorsub
regions. Ifanypartofthepropertyofanypublictrustissituatewithinthelimitsof more than one region or subregion, the Deputy or Assistant Charity Commissioner oftheregionorsubregionwithinthelimitsofwhichthepublic trustisregistered,shallforwardacopyoftheentriestotheDeputyorAssistant CharityCommissioner inchargeoftheregionorsubregionwithinthelimitsof whichsuchpartofthetrustpropertyissituate.TheDeputyorAssistantCharity Commissioner incharge ofsuchregionorsubregion shallmakeanentry in suchbookasmaybeprescribedforthepurpose.Acopyofsuchentryshallalso besentbytheDeputyortheAssistantCharityCommissioner,asthecasemay be,totheSubRegistrarappointedundertheIndianRegistrationAct,1908,of thesubdistrictwithinthelimitsofwhichsuchpropertyorpartthereofissituate.

beforemorethanoneCharityCommissionerwhetherDeputyor Assistant,the Charity Commissioner shall, on the application of any of the persons having interestinsuchpublictrustorofanyDeputyorAssistantCharityCommissioner beforewhomsuchinquiryispendingoronhisownmotion,determinewhichof suchDeputyorAssistantCharityCommissionershallproceedwiththeinquiryin regardtosuchtrust. (2) The determination of the Charity Commissioner under subsection (1)
shall be final and conclusive; and upon such determination, no Deputy or Assistant Charity Commissioner other than the Deputy or Assistant Charity Commissioner specified by the Charity Commissioner shall proceed with the inquiryinregardtothepublictrustundersection19or22,asthecasemaybe.
26. (1)
Entriesinregistertobemadeoramendedincertaincases. AnyCourtofcompetentjurisdictiondecidinganyquestionrelatingtoany
public trust which by or under the provisions of this Act is not expressly or impliedlybarredfromdecidingshallcausecopyofsuchdecisiontobesentto theCharityCommissionerandtheCharityCommissionershallcausetheentries intheregisterkeptundersection17tobemadeoramendedinregardtosuch publictrustinaccordancewithsuchdecision.Theentriessomadeoramended shallnotbealteredexceptincaseswheresuchdecisionhasbeenvariedin

appeal or revision by a Court of competent jurisdiction. Subject to such alterations,theentriesmadeoramendedshallbefinalandconclusive. (2) WheretheCharityCommissionerdecidesanyquestioninrelationtoany
public trust or passes any order in relation thereto, he shall also cause the entriesinsuchregistertobemadeoramendedinregardtosuchpublictrustin accordancewiththedecisionsogivenororderpassedbyhim;andthereupon, theprovisionsof subsection (1)shallapplyinrelation toentriessomadeor amendedastheyapplyinrelationtoentriesmadeoramendedaccordingtothe decisionororderoraCourt.

(1)mayappealtotheCharityCommissioner. (3) The provisions of this Chapter shall, so far as may be, apply to the

memorandumintheprescribedformcontainingentriesincludingtheentryofthe nameanddescriptionofthepublictrust,relatingtoimmovablepropertyofsuch publictrustmadebyhimintheregisterkeptundersection17 i. to the SubRegistrar of the subdistrict appointed under the Indian RegistrationAct,1908,inwhichsuchimmovablepropertyissituate.

whichhasbeenregisteredunderthisChapteroranypartoforanyshareor interestinsuchpropertyofsuchtrustshallbedeemedtohavenoticeofthe relevant particulars relating to such trust entered in the registers maintained under section 17 or filed in Book No. I under section 69 of the Indian RegistrationAct,1908,initsapplicationtotheStateofMaharashtra. Explanation.Forthepurposeofthissection,apersonshallbedeemed tohavenoticeofanyparticularsintheregister, 1) When he actually knows the said particulars or when, but for willful abstentionfromanyinquiryorsearchwhichheoughttohavemade,or grossnegligence,hewouldhaveknownthem; 2) If his agent acquires notice thereof whilst acting on his behalf in the courseofbusinesstowhichthefactofsuchparticularsismaterial.

CHAPTERV Budget,AccountsandAudit
31A. Trustees of certain trusts to submit budget to Charity Commissioner. (1) Atrustee ofapublictrustwhichhasan annual incomeexceeding the
prescribedamountshall,atleastonemonthbeforethecommencementofeach accounting year, prepare and submit in such form or forms as may be prescribed,abudgetshowingtheprobablereceiptsanddisbursementsofthe trustduringthefollowingyeartotheCharityCommissioner. (2) Every such budget shall make adequate provision for carrying out the
objects of the trust, and for the maintenance and preservation of the trust property.
CharityCommissionerandshallcontainsuchparticularsasmaybeprescribed.
33. (1)
Balancingandauditingofaccounts. Theaccountskeptundersection32shallbebalancedeachyearonthe
thirtyfirst day of March or such other day, as may be fixed by the Charity Commissioner.

(2)
Theaccountsshallbeauditedannuallybyapersonwhoisachartered
accountantwithinthemeaningoftheCharteredAccountantsAct,1949orby such persons as the State Government may, subject to any conditions, authorizeinthisbehalf: Providedthat,nosuchpersonisinanywayinterestedin,orconnected with,thepublictrust. (3) Every auditor acting under subsection (2) shall have access to the
accounts and to all books, vouchers, other documents and records in the possessionoforunderthecontrolofthetrustee;anditshallbethedutyofthe trusteetomakethemavailablefortheuseoftheauditor. (4) Notwithstandinganythingcontainedintheprecedingsubsections
a) TheCharityCommissionermaydirectaspecialauditoftheaccountsof anypublictrustwheneverinhisopinionsuchspecialauditisnecessary. The provisions of subsections (2) and (3) shall, so far as may be applicable,applytosuchspecialaudit.TheCharityCommissionermay directthe payment ofsuch fee asmaybe prescribed for such special audit;and b) StateGovernmentmay,bygeneralorspecialorder,exemptanypublic trustorclassoftrustsfromtheprovisionsofsubsection(2),subjectto suchconditionsasmaybespecifiedintheorder.

(1A) Itshallbethedutyofthetrusteeofapublictrusttofileacopyofthe balancesheetandincomeandexpenditureaccountforwardedbytheauditor beforetheDeputyor AssistantCharityCommissioner oftheregionorsub regionortotheCharityCommissioner,iftheCharityCommissionerrequires himtodoso. (2) Theauditorshallinhisreportspecifyallcasesofirregular,illegalor
improper expenditure, or failure or omission to recover moneys or other propertybelongingtothepublictrustoroflossorwasteofmoneyorother propertythereofandstatewhethersuchexpenditure,failure,omission,loss orwastewascausedinconsequenceofbreachoftrust,ormisapplicationor anyothermisconductonthepartofthetrustees,oranyotherperson.
CHAPTERVA PowersandDutiesof,andRestrictionsonTrustees 35. (1) Investmentofpublictrustmoney. Where the trust property consists of money and cannot be applied

approved by the State Government for the purpose or to invest in it public securities: Provided that such money may be invested in the first mortgage of immovablepropertysituateinanypartofIndiaifthepropertyisnotleaseholdfor a term of 99 years and the value of the property exceeds by onehalf the mortgagemoney: ProvidedfurtherthattheCharityCommissionermaybegeneralorspecial orderpermitthetrusteeofanypublictrustorclassesofsuchtruststoinvestthe moneyinanyothermanner. (2) Nothingin subsection (1)shallaffectanyinvestmentordepositalready
madebeforethecomingintoforceoftheBombayPublicTrusts(Amendment) Act,1954,inaccordancewithadirectioncontainedintheinstrumentofthetrust: Provided that any interest or dividend received or accruing from such
investmentordepositonorafterthecomingintoforceofthesaidActorany sumsoinvestedordepositedonthematurityofthesaidinvestmentordeposit shallbeappliedorinvestedinthemannerprescribedinsubsection(1). 36.Alienationofimmovablepropertyofpublictrust: (1) Notwithstandinganythingcontainedintheinstrumentoftrust (a) nosale,exchangeorgiftofanyimmovableproperty,and (b) noleaseforaperiodexceedingtenyearsinthecaseofagricultural land or for a period exceeding three years in the case of non agriculturallandorabuilding, belongingtoapublictrust,shallbevalidwithouttheprevioussanctionof theCharityCommissioner. Sanctionmaybeaccordedsubjecttosuch

condition asthe CharityCommissioner maythinkfit to impose, regard beinghadtotheinterest,benefitorprotectionofthetrust; (c) if the Charity Commissioner is satisfied that in the interest of any publictrustanyimmovablepropertythereofshouldbedisposedof,he may,onapplication,authoriseanytrusteetodisposeofsuchproperty subjecttosuchconditionsashemaythinkfittoimpose,regardbeing hadtotheinterestorbenefitorprotectionofthetrust. (2) The Charity Commissioner may revoke the sanction given under clause(a)orclause(b)ofsubsection(1)or,thegroundthatsuchsanctionwas obtainedbyfraudormisrepresentationmadetohimorbyconcealingfromthe Charity Commissioner, facts material for the purpose of giving sanction; and directthetrusteetotakesuchstepswithinaperiodofonehundredandeighty daysfromthedateofrevocation(orsuchfurtherperiodnotexceedinginthe aggregate one year as the Charity Commissioner may from time to time determine)asmaybespecifiedinthedirectionfortherecoveryoftheproperty.
(3)Nosanctionshallberevokedunderthissectionunlessthepersonin whose favour such sanction has been made has been given a reasonable opportunitytoshowcausewhythesanctionshouldnotberevoked.
(4)If,intheopinionoftheCharityCommissioner,thetrusteehasfailed totakeeffectivestepswithintheperiodspecifiedinsubsection(2),oritisnot possibletorecoverthepropertywithreasonableeffortorexpense,theCharity Commissioner mayassessanyadvantage receivedbythe trustee and direct himtopaycompensationtothetrustequivalenttotheadvantagesoassessed.

36A.Powersanddutiesofandrestrictionson,trustees: (1)Atrusteeofeverypublictrustshalladministertheaffairsofthetrustand applythefundsandpropertiesthereofforthepurposeandobjectsofthetrustin accordance with the terms of the trust, usage of the institution and lawful directions which the Charity Commissioner or Court may issue in respect thereof,andexercisethesamecareasamanofordinaryprudencedoeswhen dealingwithsuchaffairs,fundsorproperty,iftheywerehisown.
(2)Thetrusteeshall,subjecttotheprovisionsofthisActandtheinstrumentof trust, be entitled to exercise all the powers incidental to the prudent and beneficialmanagementofthetrust,andtodoallthingsnecessaryforthedue performanceofthedutiesimposedonhim.
(3)Notrusteeshallborrowmoneys(whetherbywayofmortgageorotherwise) forthepurposeoforonbehalfofthetrustofwhichheisatrustee,exceptwith the previous sanction of the Charity Commissioner, and subject to such conditionsandlimitationsasmaybeimposedbyhimintheinterestorprotection ofthetrust.

36B.Registerofmoveableandimmovableproperties: (1)Apublictrustshallprepareandmaintainaregisterofallmoveable andimmovableproperties(notbeingpropertyofatriflingvalue)ofsuchtrustin such form or forms giving all such information as may be prescribed by the CharityCommissioner.
(2) Such register shall show the jewels, gold, silver, precious stones, vesselsandutensilsandallothermoveablepropertybelongingtothetrustwith theirdescription,weightandestimatedvalue.
(3)Suchregistershallbepreparedwithinthreemonthsfromtheexpiryof the accounting year after the commencement of the Bombay Public Trust (Amendment)Act,1970,
(4)Suchregistershallbesignedbyallthetrusteesorbyanypersonduly authorisedbytrusteesinthisbehalfafterverifyingitscorrectness,andshallbe made available to the auditor for the purpose of auditing ifthe accounts are requiredtobeauditedundertheprovisionsofthisAct.Wheretheaccountsare notrequiredtobeaudited,thetrusteesshallfileacopyofsuchregisterduly signedandverified,withtheDeputyorAssistantCharityCommissionerofthe region.
(5)Theauditorshallmentionintheauditreportwhethersuchregisteris properlymaintainedornot,andthedefectsorinaccuracies,ifany,inthesaid

registerandthetrusteesshallcomplywiththesuggestionsmadebytheauditor and rectifythe defects orinaccuraciesmentioned inthe audit report withina periodofthreemonthsfromthedateonwhichthereportissenttothetrustees.
(6) Every year within three months from the date of balancing the accounts, the trustee or any person authorised by him shall scrutinize such register, and shall bring it uptodate by showing alterations, commissions or additionstothesame,and suchchangesshallbereported to the Deputy or AssistantCharityCommissionerinthemannerprovidedinsection22.
CHAPTERVI Control 37.Powerofinspectionandsupervision: (1)TheCharityCommissioner,theDeputyorAssistantCharityCommissioner oranyofficerauthorised bytheState Government byageneralorspecial ordershallhavepower (a) toenteronandinspectorcausetobeenteredonandinspected anypropertybelongingtoapublictrust; to call for and inspect any proceedings of the trustees of any public trust, and any book of accounts or documents in the possession orunder the control ofthetrusteesoranyperson connectedwiththetrust; tocallforanyreturn,statement,accountorreportwhichhemay thinkfitfromthetrusteesoranypersonconnectedwithapublic trust;

(3)Ifoninspectionoftheaffairsofapublictrustunderthissection,itis noticed by the Deputy or Assistant Charity Commissioner or the officer authorisedundersubsection(1)thatthereisalosscausedtothepublictrust onaccountofgrossnegligence,breachoftrust,misapplicationormisconduct onthepartofatrusteeoranypersonconnectedwiththetrust,theDeputyor Assistant CharityCommissioner may submita reportthereof to the Charity Commissioner,andtheofficersoauthorised,totheDeputyorAssistantCharity Commissioner.
38.Explanationonreportofauditororoncomplaint:

Onreceiptofareportoftheauditorundersection34orofareport,if any, made byan officer authorised under section 37 or on receipt of a complaintinrespectofanytrusttheDeputyorAssistantCharityCommissioner towhomthereportissubmittedorcomplaintismadeshallrequirethetrustee oranyotherpersonconcernedtosubmitanexplanation thereonwithinsuch periodashethinksfit. 39.ReporttoCharityCommissioner: Onconsidering thereport referredtoinsection38,theaccountsor explanation,ifany,furnishedbythetrusteesoranyotherpersonconnectedwith the publictrustand after holding an inquiryinthe prescribed manner,the Deputy or Assistant Charity Commissioner shall record his findings on the question whether ornotatrusteeorthepersonconnectedwiththetrusthas been guilty of gross negligence, breach of trust, misappropriation or misconductwhichresultedinlosstothetrust,andmakeareportthereofto theCharityCommissioner. 40.PowerofCharityCommissionertoissue ordersonreport received undersection39ortoremandmatter,etc.: The Charity Commissioner may, after considering the report of the Deputy or Assistant Charity Commissioner , giving an opportunity to the personconcernedandholdingsuchinquiryashethinksfit, (1)determine (a) theamountoflosscausedtoapublictrust; (b) whethersuchlosswasduetoanygrossnegligencebreach of trust, misapplication ormisconduct on the partof any person;

whetheranyofthetrustees,oranypersonconnectedwith thepublictrustwasresponsibleforsuchloss; the amount which any of the trustees or any person connectedwiththepublictrustisliabletopaytothepublic trustforsuchloss,or

Orderofsurcharge. (1)IftheCharityCommissionerdecidesthatanypersonconnectedwith

PowerofCharityCommissionerandStateGovernmenttoissue directions in respect of hospitals, etc. to earmark certain beds etc. for poorerpatientstobetreatedfreeofchargeoratconcessionalrates (1) Notwithstandinganythingcontainedinanylawforthetimebeingin forceorinanyinstrumentoftrustorinanycontractorinanyjudgment,decree or order of any Court, Tribunal, Charity Commissioner or other Competent Authority,inthecaseofanyStateaidedpublictrust,whoseannualexpenditure exceedsfivelakhsofrupees,orsuchotherlimitastheStateGovernmentmay, fromtimetotime,bynotificationintheOfficialGazettespecify,withaviewto makingessentialmedicalfacilitiesavailabletothepoorerclassesofthepeople, eitherfreeofchargeoratconcessionalrates,itshallbelawfulfortheCharity Commissioner, subject to such general or special order as the State Governmentmay,fromtimetotime,issueonthisbehalf,toissuealloranyof thefollowingdirectionstothetrusteesof,orpersonconnectedwith,anysuch trust, which maintains a hospital (including any nursing home or maternity home), dispensary or any other centre for medical relief (hereinafter in this sectionreferredtoas"themedicalcentre")namely:

having regard to the accommodation and facilities available to keepadmissiontothemedicalcentreopentoanypersonwithout anydiscriminationonthegroundofreligion,race,caste,sex,place ofbirth,languageoranyofthem:
Providedthat,wheremedicalcentreisexclusivelyforfemales,treatment
foranymalesatsuchcentreshallnotbeinsistedupon: (b) to reserve and earmark ten percent of the total number of operationalbedsandtenpercent,ofthetotalcapacityofpatients treated at such medical centre, for medical examination and treatment in each department of the medical centre, in such manner as may be specified in the directions, of the indigent patients seeking admission ortreatment, whoshallbe medically examinedandtreatedandadmitted,asthecasemaybe,freeof charge; to reserve and earmark ten per cent of the total number of operationalbedsandtenpercentofthetotalcapacityofpatients treatmentatsuchmedicalcentre,for medical examinationand treatment in each department of the medical centre in such manner as may be specified in the directions, for the weaker sectionsofthepeopleseekingadmissionformedicalexamination andtreatment,whoshallbechargedaccordingtosuch ratesas the State Government may , by general or special order , determinefromtimetotime,havingregardtotherateschargesby the State Government in the corresponding medical centres maintainedbyit; tocomplywithsuchotherincidentalorsupplementalrequirements asmaybespecifiedinthedirectionsorinanygeneralorspecial ordersissuedthereunder:

suchfacilitiesmaygiveappropriatedirectionsifany,consistentwithandsubject tothepercentagespecifiedinclauses(b)and(c). (2) (a) ItshallbelawfulfortheofficerdulyauthorisedbytheState Governmentinthisbehalf,orfortheCharityCommissionerbyhimselforthrough his representative duly authorised by him in this behalf, to verify the implementation of the directions given under subsection (1) to any medical centre,and,forthatpurpose,visit,inspectandcallforinformationandreturns periodicallyorotherwise. (b) Itshallbethedutyofeverytrusteeof,orpersonconnected with,suchmedicalcentretocomplywiththedirectionsissuedundersubsection (1)and to afford allreasonable facilitiesand assistance required bythe said officerortheCharityCommissionerorhisrepresentativeforverificationofthe implementation of such directions under clause (a) and to comply with the requirementsthereunder. (c)Incasetherearisesanydisputerelatingtotheinterpretation, implementation or any matter whatsoever in respect of any direction issued undersubsection(1),itshallbereferredtotheStateGovernment,throughthe CharityCommissioner,forappropriatedirections. (3) Nothing in subsections (1) and (2) shall prejudicially affect any medicalfacilitiesofwhatevernaturewhichanysuchStateaidedpublictrusthas provided by virtue of any condition subject to which any grant, exemption, concession,etc.referredtoinclause(a)ofsubsection(4)hasbeengrantedor receivedbyitorotherwiseandsuchmedicalfacilitieswhichareinoperationon the date of commencement of the Bombay Public Trusts (Amendment) Act, 1984,(Mah.VIIIof1985),shallcontinueasbeforeiftheyexceedthepercentage ofreservedandearmarkedcategory. (4) forthepurposesofthissection,

"Stateaided public trust" means a public trust exclusively for medicalrelieforformedicalreliefandothercharitablepurposes; which maintains a hospital (including any nursing home or maternityhome),dispensaryoranyothercentreformedicalrelief, andwhich (i) has received any grant of land or building, either on ownership basis or on lease or leave and license, at a nominalorconcessionalrate,fromtheStateGovernmentor theCentralGovernmentoranylocalauthority;or hasbeengivenbytheStateGovernmentanyexemptionor permission to continue to hold any vacant land under section20or21oftheUrbanLand(CeilingandRegulation) Act,1976(XXXIIIof1976);or hasbeengivenanyconcessionorexemptionorrelaxation ofasubstantialnaturefromtheDevelopmentControlRules byanycompetentauthorityforthepurposeofthetrust;or has received any loan or guarantee or any nonrecurring grantinaidorotherfinancialassistanceorisreceivingany recurringgrantinaidorotherfinancialassistancefromthe State Government, the Central Government or any local authority.

itshallbethedutyofthegoverningbody(bywhatevernamecalled ) of every medical centre to get the category of a patient duly verified and recorded in a register kept for the purpose in the prescribed form because he is admitted or treated as a patient withinthereservedandearmarkedpercentageundersubsection (1).Ifthereisanydisputeastothecategoryofapatient,itshallbe referred to the State Government, through the Charity Commissioner,fortheappropriatedirection.
(5) Notwithstanding anything contained inthe foregoing provisionsof this section, any person, who desires to undergo an operation for sterilization or an intraocular operation or who desires to undergo any operationormedicaltreatmentspecifiedbytheStateGovernmentinthis behalf,shallnotbeentitled,andshallnotbeallowed,toseekadmission in any hospital or other medical centre in the reserved or earmarked quotaprovidedunderthissection. 41B.Powertoinstituteinquiries. (1)On receipt of a complaint inwriting fromanyperson having interest in respect of any public trust or suo motu the Charity CommissionerorDeputyorAssistantCharityCommissionermayinstitute an inquiry with regard to charities, or a particular charity or class of charitieseithergenerally,orforparticularpurposes. (2)Theofficersaforesaidmayeitherholdtheinquirythemselves orentrustsuchinquirytotheofficerauthorisedundersubsection(1)of section37.

(3) Forthe purposeofanysuchinquiry,theofficer holding the inquirymay,bynotice,requireanypersontoattendataspecifiedtime and place and give evidence or produce documents in his custody or controlwhichrelatetoanymatterinquestionattheinquiry.
(4) Forthepurposeofanysuchinquiry,evidencemaybetaken on oath and the person holding the inquiry may for that purpose administeranoathundertheIndianOathsAct,1873,ormayinsteadof administeringanoath,onsolemnaffirmationrequirethepersontomake andsubscribeadeclarationofthetruthofthemattersaboutwhichheis examined.
(6) After the completion of the inquiry, the person holding the inquiry(notbeingthecharityCommissioner)shallsubmithisreporttothe officerwhoentrustedsuchinquirytohim.
(7) ThedeputyorAssistantcharityCommissioneroftheregion concernedshallsubmithisownreportorreportreceivedbyhimunder this section to the Charity Commissioner or he may proceed under section 38, if necessary, or send a copy of the report of the Charity Commissionerwithhisremarksthereon.TheCharityCommissionermay,

ifheissatisfiedthatthereisaprimafaciecaseagainstthetrustees,take stepsasarenecessaryundertheprovisionsofthisAct.
(8) The Charity Commissioner may himself also call for the proceedingsofanyinquirymadeunderthissectionforsuchactionashe maythinkfit. 41C. Persons(otherthanpublicTrusts)collectingmoneysetc.for religiousorcharitablepurposetoinformCharityCommissionerof suchcollectionsforthwithetc. (1)Anyperson(notbeingapublictrustregisteredunderthisAct) collecting any money, subscription, donation or other property for religious or charitable purpose shall forthwith inform the Charity Commissioner in writing of such collection and the purpose for which suchcollectionismade.
(2)Onreceiptofsuchinformation,theCharityCommissionermay, on making such inquiry as he deems fit, permit such collection to be continued subject to such conditions as he deems fit, or may, after recordinghisreasonsinwritinginthatbehalf,directsuchpersontostop makingsuchcollectionforthwith,andrequiresuchpersontorenderan accountofthecollectionsmadebyhim.

41D. Suspension,removalanddismissaloftrustees. (1) The Charity Commissioner may, either on application of a trustee or any personinterestedinthetrust,oronreceiptofareportundersection 41Bor suomotususpend,removeordismissanytrusteeofapublictrust,ifhe (a) makes persistent default in the submission of accounts, reportorreturn willfully disobeys any lawful orders issued by the Charity Commissioner , under the provisions of this Act or rules madethereunderbytheStateGovernment; continuouslyneglectshisdutyorcommitsanymalfeasance ormisfeasance,orbreachoftrustinrespectofthetrust; misappropriatesordealsimproperlywiththe properties of thetrustofwhichheisatrustee;or accepts any position in relation to the trust which is inconsistentwithhispositionasatrustee; isconvictedofanoffenceinvolvingmoralturpitude.

The order of suspension, removal or dismissal shall state the charges framed against the trustee, his explanation and the finding on each charge,withthereasonstherefor.

(3) Pending disposal of the charges framed against a trustee, the Charity Commissionermayplacethetrusteeundersuspension.
(4)WheretheCharityCommissionerhasmadeanordersuspending,removing ordismissinganytrusteeandsuchtrusteeisthesoletrustee,orwherethereare morethanonetrusteeandtheremainingtrustees,accordingtotheinstrumentof trust,cannotfunctionoradministerthetrustwithoutthevacancybeingfilled, then in that case the Charity Commissioner shall appoint a fit person to discharge thedutiesand performthe functionsofthe trust,andsuchperson shallholdofficeonlyuntilatrusteeisdulyappointedaccordingtotheprovisions oftheinstrumentoftrust.
(7)The order of the CharityCommissioner shall, subject to anyorder of the Courtorinappeal,befinal. 41E.PowertoActforprotectionofCharities:

(1)WhereitisbroughttothenoticeoftheCharityCommissionereitherbythe Deputy or Assistant Charity Commissioner through his report or by an applicationbyatleasttwopersonshavinginterestsupportedbyaffidavit, (a) that any trust property is in danger of being wasted, damaged or improperlyalienatedbyanytrusteeoranyotherperson,or (b) thatthe trustee orsuchperson threatens,or intendsto removeor disposeofthatproperty, theCharityCommissionermaybyordergrantatemporaryinjunctionormake such other order for the purpose of staying and preventing the wasting, damaging, alienation, sale, removal or disposition of such property, on such terms as to the duration of injunction, keeping an account, giving security, productionofthepropertyorotherwiseashethinksfit.
(4)Incaseofdisobedienceorbreachofanyinjunction,anyofitstermsorany order passed under thissection, the CharityCommissioner may apply to the Court, which may, after hearing the Charity Commissioner and the party

affected, order the property of such person, guilty of such disobedience or breachtobeattached,andmayalsoordersuchpersontobedetainedinjailfor atermnotexceedingsixmonths. Noattachmentunderthissubsectionshall remain in force for more than one year, at the end of which time, if the disobedienceorbreachcontinues,thepropertyattachedmaybesold,andout oftheproceeds,theCourtmayawardsuchcompensationasitthinksfit,and shallpaythebalance,ifany,tothepersonentitledthereto,andthereupon,the temporary injunction granted, or any order passed, by the Charity Commissioner,underthissection,ifinforceshallstandvacated,orasthecase maybe,cancelled.
(5) Atrustee orapersonagainstwhomtheorderofinjunction oranyother order under this section is passed may, within ninety days of the date of communicationofeachorder,appealtotheCourtagainstsuchorder.

(3) The Charity Commissioner may, at any time, after hearing the trustees, modifytheschemeframedbyhimundersubsection(1)orsubsection(2).
(4)Thescheme framed undersubsection(1)orsubsection (2)ormodified undersubsection(3)shall,subjecttothedecisionofthecompetentcourtunder section72,haveeffectasascheme settledoraltered,asthe casemaybe, underadecreeofaCourtundersection50. 51.ConsentofCharityCommissionerforinstitutionofsuit. (1)Ifthepersonshavinganinterestinanypublictrustintendtofileasuitofthe naturespecifiedinsection50,theyshallapplytotheCharityCommissionerin writingforhisconsent.IftheCharityCommissionerafterhearingthepartiesand makingsuchenquiries(ifany)ashethinksfitissatisfiedthatthereisaprima facie case,hemaywithinaperiodofsixmonthsfromthedateonwhichthe applicationismade,grantorrefusehisconsenttotheinstitutionofsuchsuit.

TheorderoftheCharityCommissionerrefusinghisconsentshallbeinwriting andshallstatethereasonsfortherefusal.
(3)Ineverysuitfiledbypersonshavinginterestinanytrustundersection50, theCharityCommissionershallbeanecessaryparty.
(4) Subject to the decision of the Divisional Commissioner in appeal under section71,thedecisionoftheCharityCommissionerundersubsection(1)shall befinalandconclusive.
(2)
IfonthedateoftheapplicationoftheActtoanypublictrustanylegal
proceedings in respect of such trust are pending before any Civil Court of competent jurisdiction to which the Advocate General or the Collector exercising the powers of the AdvocateGeneral is a party, the Charity Commissionershallbedeemedtobesubstitutedinthoseproceedingsforthe

AdvocateGeneralortheCollector,asthecasemaybe,andsuchproceedings shallbedisposedofbysuchCourt.
52A.Suitagainstassigneeforvaluableconsiderationnotbarredbytime. NotwithstandinganythingcontainedintheIndianLimitationAct,1908,no
suitagainstanassigneeforvaluableconsiderationofanyimmovablepropertyof thepublictrustwhichhasbeenregisteredorisdeemedtohavebeenregistered underthisActforthepurposeoffollowinginhishands,suchpropertyorthe proceeds thereof, or for an account of such property or proceeds, shall be barredbyanylengthoftime. 53.Bequestunderwillforbenefitofpublictrust. (1)Whereunderanywillabequesthasbeenmadeinfavourofapublictrustor where such bequest itself creates a public trust, it shall be the duty of the executor under the will to forward a copy thereof to the Deputy or Assistant charityCommissionerfortheregionorsubregionwheresuchtrustmayhave been,orisrequiredtobe,registered.
(2) No probate of any such will or letters of administration with such will annexedshallbegrantedbyanyCourtwhatsoeverunlessitissatisfiedthata

copy of such will has been forwarded to the Deputy or Assistant charity Commissionerasprovidedbysubsection(1).
54.Dharmada. (1) Whereaccordingtothecustomorusageofanybusinessortradeorthe agreement between the parties relating to any transaction any amount is chargedtoanypartytothesaidtransactionorcollectedunderwhatevername, asbeingintendedtobeusedforacharitableorreligiouspurposetheamountso charged or collected in this Act called "dharmada" shall vest in the person chargingorcollectingthesameasatrustee.
(4)TheprovisionsofchapterIVshallnotapplytodharmada.

(1)Onsuchapplicationbeingmade,theCourtafterhearingtheparties(andthe CharityCommissioner)andmakinganinquiryshalldecidethematterandshall give directions. In giving the directions, the court, shall, so far as may be expedient, practicable,desirable (necessaryorproper)inpublicinterest,give effecttotheoriginalintentionoftheauthorofthepublictrustortheobjectfor whichthepublictrustwascreated.IftheCourtisofopinionthatthecarryingout of such intention or object is not wholly or partially expedient, practicable, desirable (necessary or proper) in public interest the court may direct the propertyorincomeofthepublictrustoranyportionthereoftobeappliedcypres toanyothercharitableorreligiousobject.Indoingso,itshallbelawfulforthe courttoalteranyschemealreadysettledortovarythetermsofanydecreeor orderalreadypassedinrespectofthepublictrustortheconditionscontainedin theinstrumentofthepublictrust.
(2)Anydecision ororderpassed bythecourtundersubsection (1)shallbe deemedtobeadecreeofsuchcourtandanappealshalllietherefromtothe HighCourt. 56A.Powersoftrusteetoapplyfordirections. (1)SaveashereinbeforeprovidedinthisAct,anytrusteeofapublictrustmay applytothecourt,withinthelocallimitsofwhosejurisdictionthewholeorpartof thesubjectmatterofthetrustissituate,fortheopinion,adviceordirectionofthe Courtonanyquestionaffectingthemanagementoradministrationofthetrust property or income thereof and the Court shall give its opinion, advice, or direction,asthecasemaybe,thereon:

(2) The Court, on an application under subsection (1), may give its opinion, advice or direction thereon after giving notice to the Charity Commissioner. TheCourtbeforegivinganyopinion,adviceordirectionshall afford a reasonable opportunity of being heard to all persons appearing in connectionwithapplication.
(3)Atrusteestatingingoodfaiththefactsofanymatterrelatingtothe trustinanapplicationundersubsection(1),andactingupontheopinion,advice or direction of the Court given thereon, shall be deemed as far as his own responsibilityisconcerned,tohavedischargedhisdutyassuchtrusteeinthe matterinrespectofwhichtheapplicationwasmade.
(4) No appeal shall lie against any opinion, advice or direction given underthissection. 56B. Proceedings involving question affecting public charitable or religiouspurpose. (1) If any suit or legal proceedings in which any question affecting a public religious or charitable purpose is involved, the Court shall not proceed to determine such question until after notice has been given to the Charity Commissioner.

TheStateGovernmentshall,fromsuchdateasitdetermines,andinthe
manner hereinafter provided, transfer the endowment, or the management thereoftoacommittee(hereinafterreferred toas"committee")andthereupon such endowment together with all the immovable or moveable property appertainingthereto,orasthecasemaybe,managementthereof,shallvestin themembersofsuchcommittee;andthemembersofthecommitteeshallbethe trusteesofsuchendowmentwithinthemeaningandforthepurposesofthisAct. 56E.Committeesofmanagement. (1)Notwithstandinganythingcontainedinsections47and50forthepurposesof vestingortransferringthemanagementoftheendowmentundertheprovisions ofthisChapter,toacommitteetheStateGovernmentshall,bynotificationinthe Official Gazette, appoint (under such name as may be specified in the

notification) one or more committees for one or more districts as the State Governmentmaythinkfit.
(3)Acommittee shallconsist ofnot lessthan fiveand not morethan seven membersandthemembersinthecaseofareligiousendowmentshall,andin anyothercasemaybeappointedformamongstpersonsprofessingthereligion or belonging to the religious denomination (or any section thereof), for the purposesofwhichorforthebenefitofwhomtheendowmentwasfounded,oris beingadministered.Themembersshallbeappointed,asfaraspossible,andin accordancesofarascanbeascertainedwiththegeneralwishesofthosewho areinterestedintheadministrationofsuchendowment. 56F.Termsofofficeofmembersofcommittee. (1)Amembershallbeappointedtoacommitteeforaperiodoffiveyears,but shallbeeligibleforreappointment.
(2) A member may, by writing under his hand addressed to the State Government,resignhismembershipofthecommittee;

(1) The State Government shall from amongst the members of a committee appointachairmanandshallalsoappointatreasurer.
(2)The State Government maydirect that the chairman, treasurer and other members of the committee may be paid such honorarium or fees and allowancesfromtheManagementFundconstitutedundersection56QQandin suchmannerasmaybeprescribed:

56L.Secretaryandotherofficersofcommittee. (1)TheStateGovernmentmayappointaSecretarytotheCommittee. (2) The Committee may appoint such officers (other than Secretary) and servantsasitthinksnecessaryfortheefficientperformanceofthedutiesand functionsofthecommitteeunderthisAct: Providedthatnoofficerorservantwhoispaidoristobepaidasalaryof over one hundred rupees per mensum shall be appointed by a committee withoutthepreviousapprovaloftheStateGovernment.
(2) The salary or allowances of the secretary, officer and servants of the committeeshallbepaidoutoftheManagementFund.
56N.Generaldutiesofcommittees. (1)SubjecttothegeneralorspecialordersoftheStateGovernment,itshallbe the generaldutyofacommittee to manage and administerthe affairsofthe endowmentwhichvestsin,orthemanagementofwhichvestsinit.Itshallbe thedutyofacommitteetosoexercisethepowersconferredanddischargethe duties and functions imposed upon it, by or under this Act or under any instrument of trust, ora scheme, for the time being in force relating to such endowment as to ensure that such endowment is properly maintained,

controlledandadministeredandtheincomethereofisdulyappliedtotheobject andpurposesforwhichitwascreated,intendedortobeadministered. (2)Inparticular,butwithoutprejudicetothegeneralityoftheforegoingprovision, acommitteeshall (a) maintain a record containing information relating to the origin, income,objectandthebeneficiariesofeverysuchendowment; (b) (c) prepareabudgetestimatingitsincomeandexpenditure; makeregularpaymentofsalariesandallowancesandothersums payable to the Secretary, officers and servants of a committee fromtheManagementFund; (d) (e) keepseparateaccountsforeachsuchendowment; ensurethattheincomeandpropertyoftheendowmentareapplied totheobjectsandforthepurposesofwhichsuchendowmentwas created,intendedoristobeadministered; (f) take measures for the recovery of lost properties of any such endowment; (g) instituteanddefendanysuitsandproceedingsinacourtoflaw relatingtosuchendowment; (h) supplysuchreturns,statistics,accountsandotherinformationwith respect tosuchendowment astheState Government mayfrom timetotimerequire; (i) inspect or cause the inspection of the properties of such endowment;and (j) generallydoallsuchactsmaybenecessaryforthepropercontrol, maintenanceandadministrationofsuchendowment.

56O.Actofcommitteenotinvalidbyreasonofvacancyordefect. Noactorproceedingofacommitteeshallbeinvalidbyreasononlyofthe
existenceofanyvacancyamongstitsmembers,oranydefectintheconstitution thereof.
TheCharityCommissionermay,withtheprevioussanctionoftheState
Government, provide for the performance of any duty which a committee is boundtoperformundertheprovisionsofthisAct,ortherulesordirectionsmade orgiventhereunder,andmaydirectthattheexpensesoftheperformanceof suchdutybepaidbyanypersonwhomayhavefromtimetotimethecustodyof any fund belonging to the committee. If such duty is in connection with any endowmentthepaymentshallbemadeoutofthefundsbelongingtothesaid endowment.
56QQ.ManagementFund. (1) For each committee there shall be constituted a fund to be called the "Management Fund" which shall vest in, and be under the control of the committee.

(2)ThereshallbeplacedtothecreditofeveryManagementFund, (a) save as otherwise provided in subsection (3) in respect of Kolhapur,thetotalbalance(whetherincash,securitiesorinany otherform)standingtothecreditofanyendowmentheldbythe State Government immediately before such endowment or the managementthereofistransferredto,andvestedin,themembers ofthecommitteeundersection56D; (b) asumnotexceedingtenpercentofthegrossannualincomeof eachendowmenttransferredto,orunderthemanagementof,the members of the committee as the committee may, with the approvaloftheStateGovernmentfixinthisbehalf.Infixingsuch sum regard shall be had to the gross annual income of the endowment,theannualexpenditureincurredtogiveeffecttothe objects and purposes for which or for, the benefit of whom the endowment is founded, created, intended, or is being administered, the liability, if any, to which the endowment is subject,andanyotherfactorswhichtheState Governmentmay eithergenerallyorspeciallyspecifyinthecaseofanyendowment orclassofendowments; (c) thefeeschargedforinspectionofproceedingsofthecommittee, andforcopiesofrecordsmaintainedbythecommittee; (d) anyothersumwhichtheStateGovernmentmaybyorderspecify inthisbehalf.
(3)Thecontributionleviedknownas"Devashthancess"orbywhatovername calledonDevashtanInamlandsintheformerStateofKolhapur,andcollected

intheDevasthanFundasprovidedbytheSarSubhaVatNo.20,dated29th September 1917 and continued to be levied and collected in that Fund as aforesaidundertheprovisionsofSarSubhaJahirnamaNo.36,datedthe5th November 1932, shall, on the commencement of the Bombay Public Trusts (Amendment) Act, 1963, cease to be levied and collected on the Devasthan Inamlandsaforesaid;andthetotalbalance(whetherincash,securitiesorinany otherforms)tothecreditofthesaidDevashthanFundatsuchcommencement including the sum accumulated out of the income of the endowments in the formerStateofKolhapur(suchaccumulatedsumbeingcommonlyknownasthe AmanatFund)shallbeplacedtothecreditoftheManagementFundofsuch committeeorcommitteesinthedistrictofKolhapurasmaybespecifiedbythe StateGovernmentinthisbehalf.
(4)TheManagementFundshall,subjecttotheprovisionofthisActandsubject toanygeneralorspecialorderoftheStateGovernment,beappliedto (i) thepaymentofhonorarium,feesandallowanceofthechairman, treasurerandothermembersofthecommittee; (ii) thepaymentofsalaries,allowancesandothersumspayabletothe secretary,officersandservantsofthecommittee; (iii) thepaymentofanyexpenseslawfullyincurredbythecommitteein theexerciseofitspowersandintheperformanceofitsdutiesand functionsandprovidedbySection56N. (5) The custody and investment of the moneys credited to the Management Fundandthedisbursementandpaymenttherefromandtheauditofaccountsof theFundshallberegulatedintheprescribedmanner.

56R.Powertosupersedeacommittee. (1)IftheStateGovernmentisofopinionthatacommitteeisunabletoperform orhaspersistentlymadedefaultintheperformanceof,thedutiesimposedupon it by or under this Act, or has exceeded or abused its powers, the State Government may, by notification in the official Gazette, supersede the committeeforsuchperiodasmaybespecifiedinthenotification:
Provided that, before issuing a notification under this subsection, the StateGovernmentshallgiveareasonableopportunitytothecommitteetoshow cause, why it should not be superseded and consider the explanations and objections,ifanyofthecommittees. (2)Uponthepublicationofanotificationundersubsection(1)supersedinga committee (a) all the members of the committee shall, as from the date of suppression,vacatetheirofficesassuchmembers; (b) allthepowers,dutiesandfunctionswhichmay,byorunderthe provisionsofthisAct,beexercisedorperformedbyoronbehalfof the committee, shall, during the period of suppression, be exercisedandperformedbysuchpersonorpersonsastheState Governmenthavingregardtotheprovisionsofsubsection(1)of section56Gmaydirect;and (c) allpropertyvestedin,orthemanagementofwhichisvestedin;the committeeshallduringtheperiodofsuppressionvestintheState Government. (3) Ontheexpirationoftheperiodofsuppressionspecifiedinthenotification issuedundersubsection(1),theStateGovernmentmay

extendtheperiodofsuppressionforsuchfurtherperiodasitmay considernecessary;or.
(b)
reconstitutethecommitteeinthemannerprovidedinSection56E.
56RR. Power of removal of members of committee and appointment of Administratortemporarily. (1)NotwithstandinganythingcontainedinthisChapteroranyotherprovisionsof this Act or in any judgment, decree, order or scheme of any Court, Charity Commissioneroranyotherauthority,whereacommitteeof managementhas beenappointedbytheStateGovernmentundersection56Einrespectofany endowmentorendowments,andtheStateGovernmentisofopinion thatfor bettermanagementandadministrationoftheendowments,themanagementof thesaidendowmentsshouldbetakenovertemporarilybytheStateGovernment andthenshouldbegovernedbyaschemeorschemesframedbytheCharity Commissioner or should be handed over against to the committee as reconstituted, the State Government may, by notification in the Official Gazette. (a) terminate the appointment of all the existing members of the committee (including the Chairman and the Treasurer), even beforetheexpiryoftheirtermofofficeoffiveyears,onandfrom suchdateasmaybespecifiedinthenotification,whereuponthey shallbedeemedtohavevacatedtheirofficeonthatdate;
(b)
appoint a Government officer, from time to time, as the Administrator of the committee, for such period not exceeding threeyearsasmaybespecifiedinthenotification,whichmaybe

extendedbylikenotification,fromtimetotime,sohowever,that thetotalperiodshallnotexceedfiveyears;
Providedthat,ifduringthesaidperiod,thecommitteeisreconstituted,the Administrator shall cease to hold his office from the date the committee is reconstituted or as and when any scheme is framed by the Charity Commissionerinrespectofanyendowment,theAdministratorshallceaseto function in respect of that endowment from the day the scheme comes into operation.
(2)Duringtheperiodtheadministratorisholdinghisoffice,allthepowers,duties andfunctionsofthecommitteeanditsmembersandsubcommittees(ifany), underthisActoranyotherlawforthetimebeinginforce,shallbeexercised, performedanddischarged,bytheAdministratorandheshallbedeemedtobe the sole trustee inrespect ofthe endowments under hismanagement under section56D.
(3)TheAdministratormaydelegateanyofhispowers,dutiesandfunctionsto any officer or servant of the committee or,with the previous approval of the StateGovernment,toanyotherGovernmentOfficer.

56S.Powertomakeregulation. (1) The committee may with the approval of the State Government make regulations not inconsistent with this Act or the rules made thereunder for carryingoutitsfunctionsunderthisAct.
(2) In particular, but without prejudice to the generality of the foregoing provisionssuchregulationsmayprovideforalloranyofthefollowingmatters, namely:
(i)
(ii)
the manner in which any person who is not a member of a committee, or subcommittee may be associated with such committee orsubcommittee asthecasemaybe,under section 56K;
(iii)
56T.NonapplicationofcertainprovisionsofthisActtoendowments.
ExceptsofarasisexpresslyprovidedintheprovisionsofthisChapter
nothing in sections 18, 19, 20, 47, 50, 59, 66 and 67 shall apply to the endowmentstowhichthisChapterapplies;

CHAPTERVIII PublicTrustsAdministrationFund
57. PublicTrustsAdministrationFund:(1)Thereshallbeestablisheda fundtobecalledthePublicTrustsAdministrationFund.TheFundshallvestin theCharityCommissioner. (2) (a) (b) ThefollowingsumsshallbecreditedtothesaidFundnamely: feesleviableundersection18; contributionsmadeundersection58; theamountfromthefunds ortheportionthereofcredited undersection61; (d) (e) anysumreceivedfromaprivateperson. anysum allotted bythe State Government or any local authority;and (f) anyothersumwhichmaybedirectedtobecreditedbyor under the provisions of this Act or the interState Corporations Act, 1957 or the Bombay Statutory Corporations(RegionalReorganisation)Act,1960.

58. ContributionbypublictruststoPublicTrustsAdministration Fund (1) Subject tothe provisionsofthis section, every publictrust shall pay to the Public Trusts Administration Fund annually such contribution at a rate or rates not exceeding five percent of the gross annualincome,orofthegrossannualcollectionorreceipt,asthecase maybe,asmaybenotified,fromtimetotime,bytheStateGovernment, byorderpublishedintheOfficialGazette.Thecontributionshallbepaid onsuchdateandinsuchmannerasmaybeprescribed. Thecontributionpayableunderthissectionshall (i) inthecaseofadharmada,befixedatarateorratesonthe grossannualcollectionorreceiptsofthedharmada; (ii) inthecaseofotherpublictrusts,befixedatarateorrates onthegrossannualincomeofsuchpublictrust. Explanation1Forthepurposesofthissubsection,"grossannual collection or receipt" or "gross annual income " does not include any donations received by any dharmada or public trust from another dharmadaorpublictrustregisteredunderthisAct.
Explanation2(a)Forthepurposeofthissubsection"grossannual income" means gross income from all sources in a year (including all donations and offerings), but does not include any payment made or anythinggivenwithaspecificdirectionthatitshallformpartofthecorpus of the public trust, nor include any deductions which the State Governmentmayallowbyrules:

Providedthat,theinterestorincomeaccruingfromsuchpayment madeorthinggivenintheyearsfollowingthatinwhichtheyweregiven or made shall be taken into account in calculating the gross annual income:
(2) The State Government may exempt from payment of contribution public trusts which are exclusively for the purpose of the advancementandpropagationofeducationorexclusivelyforthepurpose ofwaterconservation,orexclusivelyforthepurposeofdevelopmentof forest,horticultureoragriculture,orexclusivelyforthepurposeofwelfare oftheScheduled Castes,Schedule Tribes,Denotified Tribes,Nomadic Tribes or women, or exclusively for the purpose of medical relief or veterinarytreatmentofanimals,orexclusivelyforthepurposeofreliefof distresscausedbyscarcity,drought,flood,fireorothernaturalcalamity; and may also exempt from the payment of contribution any donations formingpartofthegrossannualincomeandwhichareactuallyspenton the relief of distress caused by scarcity, drought, flood, fire or other natural calamity. If any question is raised whether a trust falls in any exemptedclassoftrustorwhether anydonationsaredonations which qualify for exemption from contribution under this subsection, the

(3)TheStateGovernmentmay,byorderpublishedintheOfficial Gazette, reduce, whether prospectively or retrospectively, the rate or ratesatwhichthecontributionfixedundersubsection(1)ispayableby anyclassofpublictrustsandmayinlikemannerremitthewholeofsuch contributionsoranypartthereof,regardbeinghadtothenatureofthe objectoftheclassofpublictrust,orthesmallnessoftheincomethereof.
(4)Indeterminingtherateorratesofcontributiontobenotifiedunder subsection(1),theStateGovernmentshalltakeintoconsiderationthebalance availableinthePublicTrustsAdministrationFundandtheestimatedincomeand expenditure(includinganycapitalexpenditure)ofthecharityOrganisationand ensurethatthelevyhasreasonablecorelationwiththeservicesrenderedorto berenderedoranyexpenditureincurredortobeincurredforcarryingoutthe purposesofthisAct.Forthispurpose,therateofcontributionmaybeincreased ordecreased,orreductionsorremissionsmaybegranted,fromtimetotime, prospectivelyorretrospectively,bytheStateGovernment,byanorderororders madeasprovidedinthissectionandpublishedintheOfficialGazette.
(5) Notwithstandinganythingcontainedintheforegoingprovisionsinthis section, on and after the commencement of the Bombay Public Trusts (Amendment)Act,1983,everytrusteeofapublictrustliabletopaycontribution, shall, while filing a copy of the balance sheet and income and expenditure accountundersubsection(1A)ofsection34,payinadvancethewholeamount

oftheannualcontributionofthepublictrustcomputedattheratefixedunder subsection (1) of this section, according to the specified percentage of the grossannualincomeorofthegrossannualcollectionorreceipt,asthecase maybe,asshowninthebalancesheetandincomeandexpenditureaccountin suchmanner,andsubjecttosuchadjustmenttobemadeafterthecontribution payableisassessed,asmaybeprescribed.
(2)TheCharity Commissionermayalsomakeanorderdirecting thebankin whichoranypersonwithwhomanymoneysbelongingtothepublictrustare depositedtopaythecontributionfromsuchmoneysasmaybestandingto thecreditofthepublic trustor maybeinthehandsofsuchpersonormay fromtimetotimeberecoveredfromoronbehalfofthepublictrustbywayof depositbysuchbankorperson andsuchbankor personshallbeboundto obeysuchorder. Everypayment made pursuant tosuch order shallbe a sufficientdischargetosuchbankorpersonfromallliabilitytothepublictrustin respectofanysumorsumssopaidbyitorhimoutofthemoneysbelonging tothepublictrustsodepositedwiththebankofperson.

61.StateGovernmenttodirectcreditingoffundsconstitutedunderActin Schedule to Public Trust Administration Fund constituted under this Chapter: Ontheapplicationofthisacttoanypublictrustorclassofpublictrustwhich

the Director and Assistant Director of Accounts, Inspectors and other subordinate officers appointed under this Act shall be deemed to be public servantswithinthemeaningofsection21oftheIndianPenalCode.
79.Decisionofpropertyaspublictrustproperty: (1)Anyquestion,whetherornotatrustexistsandsuchtrustisapublic
trustorparticularpropertyisthepropertyofsuchtrust,shallbedecidedbythe Deputy or Assistant Charity Commissioner or the Charity Commissioner in appealasprovidedbythisAct. (2)ThedecisionoftheDeputyorAssistantCharityCommissionerorthe CharityCommissionerinappeal,asthecasemaybe,shall,unlesssetasideby thedecisionoftheCourtonapplicationoroftheHighCourtinappealbefinal andconclusive.
79AA.Powertofinalisereconstructedrecord: (1)WheneveranyrecordkeptinanyPublicTrustRegistrationOfficeis
damagedordestroyedduetoanycausewhatsoeverandisreconstructed,the AssistantorDeputyCharityCommissionermaybynoticeintheprescribedform published in the Official Gazette, and also in any newspapers with wide circulationintheregionconcerned,announcethefactofthereconstructionof therecord,andcalluponallpersonshavinginterestinthepublictrustswhich areenteredinsuchreconstructedrecordtoshowcauseinwritingwithinaperiod ofthirtydaysfromthepublicationofthenoticeintheOfficialGazette,whysuch recordshouldnotbetreatedasfinalandconclusive.Acopyofsuchnoticemay besenttothetrusteesofsuchpublictrusts.

(2)Ontheexpiryoftheperiodofthirtydaysaforesaid,theAssistantor Deputy Charity Commissioner shall, after hearing the trustees and persons having interest, if any, after duly considering the objections and documents produced,ifany,andifnecessary,aftermakinganinquiry,recordhisfindings withthereasonstherefor,andeitherconfirmoramendtherecordincludingany entriesthereinaccordingly.Therecordsoconfirmedoramendedshall,subject totheprovisionsofthisAct,befinalandconclusive,asifsuchrecordwasmade ormaintainedunderthisAct.
79B.CostsofproceedingsbeforeCourtsincludingHighCourt: Thecostschargesandexpensesofandincidentaltoanysuit,appealor

79CC.Compensatorycostsforfrivolousorvexatiousproceedingsbefore CharityCommissioner,etc.: (1) If in an inquiry under the provisions of this Act, the Charity
Commissioner orthe DeputyorAssistantCharityCommissioner isofopinion thattheapplicationonwhichsuchinquirywascommencedwaseitherfrivolous or vexatious, the Charity Commissioner, the Deputy or as the case may be, AssistantCharityCommissioner,mayattherequestofthepersonagainstwhom suchapplicationwasmadehereinafterreferredtoastheOpponentcallupon thepersonmakingtheapplicationhereinafterreferredtoas"theapplicant"to showcausewhytheapplicantshouldnotpaycompensationtotheopponent and if the applicant is not present, direct the issue of a summons to him to appearandshowcauseaforesaid.
(2) If the Deputy or Assistant Charity Commissioner or the Charity Commissioner,asthecasemaybe,issatisfiedthattheapplicationwaseither frivolousorvexatioushemay,afterrecordingreasons,orderthatcompensation

tosuchamountnotexceedingfivehundredrupeesashemaydeterminebepaid bytheapplicanttotheopponent.
79D.CourtfeetobepaidasprescribedbyScheduleB: Notwithstanding anything contained in the Courtfees Act, 1870, the documentsdescribed incolumns1and 2of Schedule Bhereto shallbear a Courtfeestampofthevaluespecifiedincolumn3thereof.
80.Barofjurisdiction: Save as expressly provided in this Act, no Civil Court shall have
State Government or any officer or authority or representative of the Charity Commissionerinrespectofanythingingoodfaithdoneorpurportingtobedone underthisAct.

82.TrialofoffencesunderthisAct: NoCourtinferiortothatofaPresidencyMagistrateoraMagistrateofthe
FirstClassshalltryanoffencepunishableunderthisAct.
83. Previous sanction of Charity Commissioner necessary for prosecution: No prosecution for an offence punishable under this Act, shall be
institutedwithouttheprevioussanctionoftheCharityCommissioner.
84.Rules: (1)TheStateGovernmentmaymakerulesforthepurposeofcarrying
intoeffecttheprovisionsofthisAct. (2)Inparticularandwithoutprejudicetothegeneralityoftheforegoing provision such rules may be made for all or any of the following matters, namely: (a) the manner of publishing the notification under subsection (4) of section1; (aa) the qualifications of the Director, and Assistant Directors of Accountsappointedundersection6; (b)thepowers,dutiesandfunctionsoftheofficersotherthantheCharity Commissioner, Deputy or Assistant Charity Commissioners appointed underthisActinadditiontothoseprovidedforinthisAct; (c) the powers, duties and functions of assessors in addition to those providedforinthisAct; (d) the limits of regions and subregions to be prescribed under sub section(1)ofsection14;

(e)thebooks,indicesandregisterstobekeptandmaintainedinPublic TrustsRegistrationOfficeandtheparticularstobeenteredinsuchbooks, indicesandregistersundersection17; (f)theforminwhichanapplicationfortheregistrationofaPublicTrustsis tobemadeandthefeetobepaidforthesame,theotherparticularsto be entered therein and the manner in which an application for such registration to be signed and verified and the value and kind of trust propertyinrespectofwhichitshallnotbenecessarytogiveparticulars undersection18; (g) the manner in which an inquiry has to be made by the Deputy or AssistantCharityCommissionerundersection19and39; (h) the form in which the trustee has to make a report regarding the changeundersubsection(1),andthemannerofholdinganinquiryunder subsection(2)ofsection22; (i)thebookinwhichtheDeputyorAssistantCharityCommissionershall makeanentryundersection23; (j) the form of memorandum to be sent by trustees and Deputy and AssistantCharityCommissionerforregistrationandthemannerinwhich thememorandumshallbesignedandverified; (j1)theinquirytobemadeundersubsection(1)ofsection28; (j2)theamountofannualincomeofapublictrustexceedingwhichitis liable to prepare and submit budget, and the form or forms of such budget,undersubsection(1)ofsection31A; (k)theparticularstobeenteredintheaccountsundersubsection(2)of section32andthefeetobepaidforspecialauditundersection33;

(2)OnthedateoftheapplicationoftheprovisionsofthisActtoanypublictrust orclassoftrustsundersubsection(4)ofsection1hereinafterinthissection referredtoanthesaiddatetheprovisionsoftheActspecifiedinScheduleA whichapplytosuchtrustorclassoftrustsshallceasetoapplytosuchtrustor classoftrusts. In disposing of such proceedings the Charity Commissioner, the Deputy Charity Commissioner or the Assistant CharityCommissioner,asthecasemaybe,shallhaveandexercisethesame powerswhichwerevestedinandexercisedbytheCourtundertheMussalman WakfAct, 1923 asamended bytheMussalman Wakf(BombayAmendment) Act,1935,andbytheRegistrarsundertheBombayPublicTrustsRegistration Act,1935,andtheParsiPublicTrustsRegistrationAct,1936,andshallpass suchordersasmaybejustorproper.
