Definition
Section 2(b) of the contact act defines Acceptance as; When the person to the proposal is made signifies his assent thereto, the proposal is said to be accepted. A proposal when accepted become a promise . Acceptance can be made only by words spoken or written.
Acceptance must be made by the offeree Acceptor must be aware of the proposal at the time of the offer Acceptance must be made only after the offer is made Acceptance must be given before the offer lapses or revoked Acceptance concludes the contract
COMMUNICATION OF ACCEPTANCE
Communication of acceptance is necessary for forming a contract. It can be effected by act or commission. Act includes conduct or by words, written or oral, letter, telegram, telephone etc Commission includes conduct or forbearance on the part of one person which has the effect of communication.
Completion of offer
The communication of offer is complete as soon as it comes to the knowledge of the offeree. A proposes by letter to sell his house to B for Rs.2 lakhs. The communication or the proposal is complete when B receives the letter.
Completion of acceptance
Against the proposer when it is put in a course of transmission to him as to be out of the power of the acceptor Against the acceptor when it comes to the knowledge of the proposer.
REVOCATION OF ACCEPTANCE
According to sec 5 an acceptance of proposal may be revoked at any any time before the communication of acceptance is complete as against the accepter but not after words.
